RES-9019 Denying General Plan Amendment No. 1-98RESOLUTION NO. 9019 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE OVERRULING THE RECOMMENDATION OF THE PLANNING COMMISSION OF THE CITY OF ORANGE AND DENYING A GENERAL PLAN AMENDMENT REQUEST TO ELIMINATE A PLANNED PRIMARY ARTERIAL HIGHWAY SEGMENT ("WALNUT AVENUE") FROM THE CIRCULATION ELEMENT AND MASTER PLAN OF STREETS AND HIGHWAYS ON PROPERTY GENERALLY LOCATED AT 291 NORTH STATE COLLEGE BOULEVARD, ADJACENT TO INTERSTATE 5. General Plan Amendment No. 1-98 ( CE)Applicant: Circuit City Stores, Inc. / Carmax RECITALS:After report thereon by the Planning Commission and after due public hearings by the Plarming Commission and City Council, as required by law, the City Council of the City of Orarlge considered a recommendation of the Planning Commission of the City of Orange recommending by Resolution No. PC 44-98 that a planned primary arterial highway segment be diminated from the Circulation Element of the General Plan and from the Master Plan of Streets and Highways on property located at 291 North State College Boulevard, adjacent to Interstate 5. After finding and determining the hereinafter described facts, the City Council determined that General Plan Amendment 1-98 (CE) should be denied. The subject property is described more particularly in Exhibit" A", attached hereto and incorporated herein by this reference.During its public hearing, the City Council found the facts more particularly set forth as fi)llows:1. The applic:ant, Circuit City Stores, Inc. / Cannax, is proposing to develop the vacant Orange Drive-In Theater site as a sales facility for used and new cars.2. The project site is located partially in the City and partially in Anaheim. The City's General Plan Circulation Element shows a future primary arterial highway segment designated as "Walnut Avenue" running through the property.3. The location of the project is one of the key entryways into the City and is in close proximity to The Block project and other high traffic volume uses.4. One of the surrounding land uses is NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange as follows: I. That the foregoing recitals are true and correct. 2. That the recommendation of the Planning Commission be overruled and that General Plan Amendment 1-98 (CE) eliminating a planned primary arterial highway segment Walnut Avenue") from the Circulation Element and the Master Plan of Streets and Highways be denied because the amendment is not in the public interest; is not compatible with and will adversely affect surrounding land uses; and an environmental assessment has found that adverse environmental effects will result from the proposed amendment.Adopted this 13th day of October, 1998. // 7 ATTEST:2 LA ..--?
