RES-9010 Approving Pre-Zone Change No. 1189-97RESOLUTION NO. 9010 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE UPHOLDING THE RECOMMENDATION OF THE PLANNING COMMISSION OF THE CITY OF ORANGE AND APPROVING THE PRE- ZONE CLASSIFICATION TO C-l OF PROPERTY LOCATED ALONG THE NORTHERLY PROPERTY LINE OF THOSE PROPERTIES IN THE CITY OF ORANGE ON THE NORTH SIDE OF CHAPMAN AVENUE BETWEEN EARLHAM AND HEWES, PARALLEL TO AND BETWEEN CHAPMAN AVENUE IN THE CITY OF ORANGE AND PEARL STREET IN THE COUNTY OF ORANGE,Pre- Zone Change 1189-97 Applicant: City of Orange on Behalf of William Mattern, Reynaldo Lozano,Larry Malone, Harvey Moreno and Margery Bassett RECITALS:After report thereon by the Planning Commission and after due public hearing by the Planning Commission as required by law, on December 9,1997, the City Council of the City of Orange considered a recommendation of the Planning Commission of the City Orange recommending by Resolution No. 46-97 that certain property located along the northerly property line of those properties in the City of Orange on the north side of Chapman Avenue,between Earlham and Hewes, parallel to and between Chapman Avenue in the City of Orange and Pearl Street in the County of Orange be reclassified from an unzoned status to the C-l District. After finding and determining the hereinafter described facts, and after having determined that the project is categorically exempt from CEQA, the City Council determined that Pre-Zone Change 1189-97 should be approved as recommended by the Planning Commission.The real property which is the subject of Pre-Zone Change 1189-97 is more particularly described on Exhibit "A", which is attached hereto and incorporated herein by this reference.During the public hearing before the City Council, the following facts were established:1. The property is a strip of land, 10 feet wide by approximately 420 feet in length,which was formerly a portion of the alley north of Chapman Avenue between Earlham and Hewes Streets. It consists of the rear 10 feet of the parcels 2, The property is currently located in unincorporated Orange County and is unzoned. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange as follows: 1. That the foregoing recitals are true and correct. 2. That the recommendation of the Planning Commission be upheld and that Pre- Zone Change 1189-97 classifying the property described on Exhibit "A" to the C- l District be approved for the following reasons:The C-l zoning classification IS consistent with the General Plan land use designation.The C-l zoning classification will complete the annexation process by applying zoning to an unzoned strip of land consistent with zoning of the abutting properties under the same ownership.ADOPTED this 22nd day of September, 1998.ATTEST: 44"ftA"flA-<. d- (p-;;,/,~ Cassandra J.
