RES-9007 Approving Minor Site Plan Review No. 40-97RESOLUTION NO, 9007 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE UPHOLDING THE RECOMMENDATION OF THE PLANNING COMMISSION OF THE CITY OF ORANGE AND APPROVING A MINOR SITE PLAN REVIEW TO CONVERT A RESIDENTIAL STRUCTURE TO OFFICE SPACE UPON PROPERTY LOCATED ON THE NORTH SIDE OF SYCAMORE AVENUE, SO FEET EAST OF GLASSELL STREET, ADDRESSED AS 121 AND 123 EAST SYCAMORE AVENUE. Minor Site Plan Review 40- 97 Applicant: Chapman University RECITALS:After report thereon by the Planning Commission and after due public hearing as required by law, and after receiving a recommendation from the Planning Commission, recommending,by Resolution No. PC 34-97, that a minor site plan review to convert a residential structure to of1f1ce space upon property situated on the north side of Sycamore Avenue, 50 feet east of Glassell Street, addressed as 121 and 123 East Sycamore Avenue, be approved, the City Council considered said recommendation and the testimony received at said public hearing and determined that the recommendation of the Planning Commission should be upheld and Minor Site Plan Review 40-97 be granted. Subject property is more particularly described as follows:ALL THAT CERTAIN LAND SITUATED IN THE STATE OF CALIFORNIA,COUNTY OF ORANGE, CITY OF ORANGE, DESCRIBED AS FOLLOWS:PARCEL 1:THE EAST 62.00 FEET OF LOTS 22 AND 23 IN BLOCK "A" OF W. H. H.CLAYTON'S SUBDIVISION OF PART OF RICHLAND FARM LOT NO. 13,AS SHOWN ON A MAP RECORDED IN BOOK 4, PAGE 6 OF MISCELLANEOUS MAPS, RECORDS OF ORANGE COUNTY, CALIFORNIA.PARCEL 2:AN EASEMENT TO INSTALL AND MAINTAIN A PIPELINE FOR SEWER PURPOSES OVER THE NORTHERLY 5.00 FEET OF LOT 22 IN BLOCK "A"OF W. H. H. CLAYTON'S SUBDIVISION OF PART OF RICHLAND FARM LOT NO. 13, AS SHOWN ON A MAP RECORDED IN BOOK 4, PAGE 6 OF MISCELLANEOUS MAPS, RECORDS OF ORANGE COUNTY,CALIFORNIA.EXCEPTING THEREFROM THE EAST 62. Upon the public hearing before the City Council, the following facts were established: 1. The applicant, Chapman University, owns residential structures which it wishes to convl:rt to office use. The properties are immediately adjacent to the University's new Orange Stree1l parking lot. In conjunction with said conversion, a zone change was approved by the City Council. 2. Neighboring land uses include a mini-market, restaurant, and University parking lots.3. This project reuses an existing structure with interior modifications only.4. There is adequate parking immediately adjacent to this property that is under the same ownership, to support this change in use,NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange that Minor Site Plan Review 40-97 be granted for the following reasons:I. The project will not cause a deterioration of neighboring land uses.2. The project conforms to the City of Orange development standards and applicable special design guidelines and specific plan requirements.3. The project will not cause significant negative environmental impacts.4. On and off-site circulation is adequate to support the project.5. City services are available and adequate to serve the project 6. The project is compatible with community aesthetics.BE IT FURTHER RESOLVED that the following conditions of approval are imposed:1. Within two (2) days of the final approval of this project, the applicant shall deliver to the Planning Division a cashiers check for $38.00, payable to the County Clerk, to satisfY the County administrative fee for filing the Notice of Determination required under Public Resources Code 21152,14 Cal. Code of Regulations 15075.2. Any modification to the building shall be subject to review and approval by the Community Development Department.3. The applicant agrees to indemnify, hold harmless, and defend the City, its officers, agents and employees from any and all liability or claims that may be brought against the city arising out of its approval of this permit, save and except that caused by the City' s active negligence.Reso 4. The applicant shall comply with all federal, state, and local laws. Violation of any of those laws in connection with the use will be cause for revocation of this permit. 5. No use other than office use may occur in the structure. Any change in use requires reapplication for Minor Site Plan Review and design review, including conformance with all applicable landscape, parking, setback and building development standards for the project. The following Code provisions are applicable to this project and are included for information only. This is not a complete list of requirements and other code provisions may apply, Applicant shall pay all applicable development fees, including but not limited to Transportation System Improvement Program fees. The structure shall be made to comply with all applicable building and fire code requirements, including, but not limited to accessibility for the disabled and addition of fire sprinklers. If not used, this Minor Site Plan Review shall expire two years from the date of approval. Adopted the 22nd day of September, 1998.
