A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE ADOPTING A TELE-
COMMUNICATIONS POLICY FOR THE CITY OF
ORANGE.
WHEREAS, the City of Orange ("City") believes that the recent advances in
telecommunications, including fiber-optic deployment, the advent of a competitive
local telephone market and the growth of the Internet, will support the beginning of a new
era where the ability to receive, utilize and send information will become essential
services to the residents, businesses, public agencies and institutions located in the City;
and WHEREAS, telephone, cable, wireless and telecommunication providers
will use advanced technologies to make new services available when it is
commercially practicable, the City must be in a position to take advantage of these new technologies
to serve the public and to insure that the largest number of citizens, businesses,
public agencies and institutions are able to participate fully in the information age;
and WHEREAS, upon study and consideration, the City is cognizant of benefits
that will accrue to its citizens and businesses as a result of the development of
advanced telecommunications facilities within the City in a manner that assures access to a
wide range of competitive services for citizens, businesses, institutions and public
agencies;
and WHEREAS, the public rights of way, municipal antenna sites and other
public assets are a limited, finite public resource the use of which is critical to the
development of the new telecommunications systems;
and WHEREAS, the citizens, businesses, institutions and public agencies located
in the City should not subsidize the development ofthese new telecommunications
systems by private companies;
and WHEREAS, construction to access the public rights of way necessarily
causes noise, air pollution, safety issues, traffic congestion and interruptions, which
negatively impacts normal business activity, the quality of life for the City's citizens and
imposes additional burdens on the City's community development and public safety
employees;
and WHEREAS, the City desires to minimize repetitive construction in the rights
of way by the plethora of telecommunication providers authorized to do business in
the State of California;
and WHEREAS, the City has traditionally employed its police powers to protect
the public interest in the sue of the public rights of
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
Orange adopts the following principles as its Telecommunications Policy to set the
framework for the growth of a robust environment supporting the development of a
multiple telecommunication systems in the City. The City shall seek to:
1. Minimize disruption to Public Property and ensure efficient use of the
City's rights of way through competitively neutral and nondiscriminatory
policies that include fair and reasonable compensation to the City for the
use of the public rights of way.
2. Enhance the City's economic development programs by encouraging the
development and growth of reliable telecommunication services at the
lowest cost to residents, businesses, institutions and public agencies
located in the City by encouraging the development of competition among
multiple telecommunication providers, both facilities based providers and
resellers of incumbent local exchange carrier services.
3, Protect the unique aesthetic qualities that make Orange an attractive place
to live and work, and protect the public health, safety and welfare by
encouraging wireless telecommunications providers to co-locate
their antenna facilities on approved City-owned sits and/or
appropriately zoned private antenna sites, with an emphasis on minimizing
visual impacts.4. Ensure that the City develops advanced telecommunication
facilities to support efficient municipal operations and support the
delivery of governmental services to the residents, businesses, institutions
and public agencies located in
the City,5. Preserve and support the development of
wireless telecommunication services for public use, including radio frequency bandwidth,
for police,fire and other
