ORANGE, CALIFORNIA AUGUST 20, 1991 n The Orange Redevelopment Agency of the City of Orange, California convened this 20th day of August, 1991 at 3:00 p.m. ~n the Council Chambers. 300 E. Chapman Avenue. Oranqe. California. 1. ROLL CALL PRESENT - Barrera, Chairman Beyer, Coontz, Spurgeon ABSENT - steiner 1.1 APPROVAL OF MINUTES 2.CONSENT CALENDAR TAPE 1070 2.1 Declaration of Clerk of the Orange Redevelopment Agency,Marilyn J. Jensen, declaring posting of Orange Redevelopment Agency Agenda of regular meeting of August 20, 1991, at Orange civic Center, Main Library, the New Police Facility at 1107 N.Batavia and the Eisenhower Park Bulletin Board; all of said locations being in the City of Orange and freely accessible to members of the public at least 72 hours before commencement of said regular meeting. ACTION: Accepted Declaration of Agenda Posting and authorized its retention as a public record in the Office of the Agency Clerk.2.2 Request authorization to approve First Time Homebuyer Loan and authorize the City Treasurer to prepare a check in the amount of $16,700. Case No. 268. (RC2500.G.1)ACTION: Approved.2. 3 Request authorization to approve First Time Homebuyer Loan and authorize the city Treasurer to prepare a check in the amount of $21,000. Case No. 276. (RC2500.G.1)ACTION: Approved.REMOVED AND HEARD SEPARATELY)2.4 Approve and authorize the execution of the Funding Agreement between the Orange Redevelopment Agency and the Orange Housing Development Corporation. (RA2100. 0 A.1836)The City Attorney reported he wanted to make sure there was no conflict with state law, with agency members also being non-compensated officers of OHDC, which is a non-profit corporation. The agency members who also serve on the OHDC are not deemed to have an interest in the contract, as long as this is noted in the official records. Therefore, he felt that Councilmembers Coontz and Spurgeon could vote on this issue.Page 1 34 ORANGE REDEVELOPMENT AGENCY MINUTES AUGUST 20, 1991 2. CONSENT CALENDAR (Continued) Councilmembers Coontz and Spurgeon indicated they would feel most comfortable abstaining from the vote. However, there would be no quorum. The City Attorney felt the rule of necessity could be used, where if two people abstain, they are allowing the other members to act on the issue. The Attorney for the Redevelopment Agency felt this was not an issue of the Political Reform Act, but rather section 1090 or 1091.5. Participation in this vote would not constitute a violation because as members of OHDC's board, they have no financial interest in this action being taken. Councilwoman Coontz indicated the Attorney for OHDC felt that actual monetary applications must be considered, which involve monetary land-use issues. councilman Spurgeon also preferred to abstain, from a perceptual standpoint. The Attorney for OHDC is looking at the possibility of Councilmembers Coontz and Spurgeon being ex-officio, non-voting members, representing the city Council, but not voting on business. MOTION - Beyer SECOND - Barrera AYES - Beyer, Barrera ABSTAINED - Coontz, Spurgeon ACTION: Authorized the Director and Agency Clerk to execute the agreement.MOTION - Barrera SECOND - Coontz AYES - Barrera, Chairman Beyer, Coontz, Spurgeon ABSENT - steiner Item 2. 4 was removed and heard separately.
