RES-8987 Amending Tentative Tract Map No. 14680RESOLUTION NO. 8987 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING TENTATIVE TRACT MAP 14680 AND MINOR SITE PLAN REVIEW 45-97 FOR THE SUBDIVISION OF PROPERTY SITUATED EAST OF PROSPECT STREET BETWEEN SPRING STREET AND WALNUT AVENUE.Applicant: Beazer Homes California, Inc. RECITALS:After report thereon by staff and after due public hearing as required by law regarding the subdivision of property situated east of Prospect Street between Walnut Avenue and Spring Street, the City Council considered said testimony received at said public hearing and determined that Tentative Tract Map 14680 and Minor Site Plan Review 45-97 be amended.Upon the public hearing before the City Council, the following facts were established:1. On December 9, 1997, the City Council approved Tentative Tract Map 14680 and Minor Site Plan Review 45-97 for the following reasons:11.The project will not cause a deterioration of neighboring land uses.The project conforms to City of Orange development standards.The project will not cause significant negative environmental impacts.On- and off-site circulation is adequate to support the project.City and other public services are available and adequate to serve the project.The project is compatible with community aesthetics. 3. 4.5.6.2. On April 14, 1998, the City Council approved Resolution No. 8907 documenting and imposing a number of conditions on said approval.3. Condition No. 24 of Resolution No. 8907 read as follows:Dedicate and construct a cul-de-sac per City Standard Plan No. 109 for WalnutAvenue just east of Vir age Drive.4. Condition No. 24 was not a mitigation measure in any environmental analysis.5. Subsequent to approving Resolution No, 8907, the City has received substantial opposition to construction of a cul-de-sac from the community.6. Staff has reviewed the purpose for construction of the cul-de-sac and determined that there are methods other than a the development. These alternative traffic measures could be funded by an amount of money equivalent to the cost to Beazer Homes of constructing the cul- de-sac.7.
