RES-8940 Approving General Plan Amendment No. 1-98RESOLUTION NO. 8940 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE UPHOLDING THE RECOMMENDATION OF THE PLANNING COMMISSION OF THE CITY OF ORANGE AND APPROVING THE GENERAL PLAN CLASSIFICATION OF PROPERTY GENERALLY LOCATED ON THE WEST SIDE OF ORANGE- OLIVE ROAD ON THE NORTHWEST CORNER OF THE METROLINK RIGHT OF WAY AND LINCOLN AVENUE, General Plan Amendment No. 1- 98 Applicant: Greystone Homes RECITALS:After report thereon by the Planning Commission and after due public hearing by the PI31ming Commission on March 16, 1998, as required by law, the City Council of the City of Orange considered a recommendation of the Planning Commission of the City of Orange recommending by Resolution No. PC 16-98 that theapproximately 3.44 acre property situated on the west side of Orange-Olive Road on the northwest comer of the Metrolink right of way and Lincoln Avenue be redesignated from a combination of medium density residential (nMDRn) and public facilities (npFn) to the low-medium density residential nLMDRn) designation, After finding and determining the hereinafter described facts, the City Council determined that the project is categorically exempt from CEQA and that General Plan Amendment 1-98 should be approved, as recommended by the Planning Commission. The real property which is the subject of General Plan Amendment 1-98 is generally depicted on the map attached hereto as Exhibit " A" and incorporated herein by this reference as though fully set forth herein and shall be referred to herein as the "subject property".During its public hearing, the City Council found the facts more particularly set forth as follows:1. The applicant, Greystone Homes, is in the process of constructing 36 single family residential dwelling units on approximately 3.44 acres ofproperty at a density of 10.46 dwelling units per acre. The overall project ( herein referred to as the "project"or the "proposed project") will include 4 lettered lots on Santa Fe Place, and an adjacent part of the Lincoln Avenue public right of way.2. The project site is currently located in unincorporated Orange County and is designated in the County's general plan as Medium Density Residential (MDR) and Public FacilitieslFire Station (PF). The current County of Orange zoningfor the project site is R-4/PD (3000).3. The surrounding land use, zoning and jurisdictions are as follows: to the north --single family residence, R-I-7, the east -- manufacturing and warehouse uses, M-l zone, Industrial, County of Orange; to the south -- commercial building, C-l zone, Limited Business District, City of Orange; to the west -- residential condominiums, R-3 zone, Multi- Family Residential District, City of Orange.NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange as follows:I. That the foregoing recitals are true and correct.2, That the project is categorically exempt from the prOVtSlOns of the California Environmental Quality Act (CEQA) per Section 15319 of the State CEQA Guidelines.3, That the recommendation of the Planning Commission be upheld and that General Plan Amendment 1-98 redesignating the subject property generally depicted on Exhibit "A" attached hereto as low-medium density residential (nLMDRn) be approved because the amendment is in the public interest and the proposed designation is compatible with surrounding land uses.Adopted this 23rd day of June, 1998.ATTEST:C4AA~ &- a/.AA-:C Cassandra J.
