A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ORANGE UPHOLDING THE RECOMMENDATION OF THE
PLANNING COMMISSION OF THE CITY OF ORANGE AND
APPROVING THE SUBDIVISION OF PROPERTY SITUATED
NORTH OF SANTIAGO OAKS REGIONAL PARK, EAST OF
THE SOUTHERN CALIFORNIA EDISON SERRANO
SUBSTATION, SOUTH OF ANAHEIM HILLS AND WEST OF
NOHL RANCH ROAD IN THE SERRANO HEIGHTS
SPECIFIC PLAN AREA.

Applicant: California Quartet, a California limited partnership
RECITALS:
After report thereon by the Planning Commission and after due public hearing as required
by law, and after receiving a recommendation from the Planning Commission, recommending,
by Resolution No. PC 61-97 that the subdivision of property situated in the Peralta Hills north
of Santiago Oaks Regional Park, east of the Southern California Edison Serrano Substation,
south of Anaheim Hills and west of Nohl Ranch Road in the Serrano Heights Specific Plan Area
be approved, the City Council considered said recommendation and the testimony received at
said public hearing and determined that the recommendation of the Planning Commission should
be upheld and Tentative Tract Map 14359 be approved. The subject property is more
particularly described on Exhibit "A" attached hereto and incorporated herein by this
reference.Upon the public hearing before the City Council, the following facts were
established:1. The applicant, California Quartet, a California limited partnership, is proposing
to develop approximately 172 acres in the Peralta Hills into 245 lots to be developed with
223 dwelling units and a4.4 acre
park.2. The proposed development will have private streets, common open space
and reereational
areas.3. The Planning Commission recommended approval of the applicant's
requests because the proposal would allow the orderly development of the subject property in
accordance with the City's General Plan, the Serrano Heights Specific Plan and the Development
Agreement by and between the applicant's predecessor in interest and the
City.4. The City has heretofore prepared and certified Environmental Impact Report
954 in 1987 for General Plan Amendment 2.86-A, Supplemental Environmental Impact
Report 1305-90 in 1990 for the Serrano Heights Specific Plan, and that certain Addendum
thereto, dated January 21, 1997, for an amendment to a Development Agreement (
Environmental Reports"). The Planning Commission duly considered the information
contained in the Environmental Reports, together with any comments or testimony received from
the public, prior to taking any action to approve Tentative Tract Map 14359, and found and
determined that the environmental impacts of the proposed project have been addressed by the
Environmental Reports and that none of the conditions described in Section 15162 of the State
California Environmental Quality Act Guidelines would require a subsequent environmental
impact report.
5. In recommending approval of the proposed project, the Planning Commission
found that the proposal is consistent with the City's General Plan, the Serrano Heights Specific
Plan and the Development Agreement between the City and the applicant's predecessor in
interest, that the site is physically suitable for the proposed development, and that the project will
not cause substantial impact upon the environment.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange that
Tentative Tract Map 14359 be granted for the following reasons:
1. The proposed map and the design or related improvements are consistent with the
General Plan and the Serrano Heights Specific Plan.
2. The site is physically suitable for the type and proposed density of development.
3. With the mitigation measures imposed pursuant to the Environmental Reports and the
statement of overriding considerations made by the City in connection therewith, the
design of the subdivision or proposed improvements are not likely to cause substantial
environmental damage or substantially and unavoidably injure fish or wildlife or their
habitat.
4. The design of the subdivision or the type of improvements is not likely to cause serious
public health problems and will not conflict with easements required by the public at
large for access through or use of property within the proposed subdivision.
BE IT FURTHER RESOLVED that the following conditions are imposed with approval:
1. Prior to the approval of a Final Tract Map, the developer shall submit a fuel modification
plan for Tentative Tract Map 14359 in form and substance acceptable to and approved by
the city's Fire Department. In the event that the developer's proposed fuel modification
plan proposes any offsite improvement(s), it shall be accompanied by documentation of
the right to perpetually use and maintain any such offsite improvement(s) and access to
such property in form and substance acceptable to the City Attorney. Any proposed use
of any such offsite improvement(s) to comply with this condition is not mandated by the
city, but is a proposal of the developer as an alternative means of complying with this
condition, and the city shall have no obligation to institute eminent domain proceedings
or otherwise assist the developer to acquire any right in offsite property for purposes of
satisfying this condition.

2.Security fencing, rows of evergreen trees, or tall shrubs shall be located along the
development's perimeter and naturalized slope plantings to reduce the project's impact on
Santiago Oaks Regional Park biological resources and views.
Miti~ation Measure 4.4.3-1 - The proposed average 800 foot landscape buffer and
building setback will reduce the project's impact on the biological resources of Santiago
Oaks Regional Park. The proposed setback and buffer treatment will be of sufficient
depth and width to achieve visual blockage of human activity above the park habitat
areas (security fencing, rows of evergreen trees or tall shrubs located along the
development perimeter and naturalized slope plantings). Tentative Tract Map 14359
was conditioned to provide only the security fencing and/or screening landscaping since
the 800 foot wide buffer has already been created by the land exchange between
Woodcrest and the County of Orange.
3.The slope along the canyon adjacent to Serrano Avenue should be planted with native oak
and walnut trees to replace those lost as a result of grading the site. Details regarding the
planting and design of this area will be finalized during the subsequent California
Department of Fish and Game 1603 Permit Process. Plans for this replanted area shall
require review by the City's Design Review Board.
4.To assure compliance with the City's requirements on the maximum amount of noise
permitted within a structure, and per the "Noise Analysis for Serrano Heights" dated
April 18, 1991, a complete building interior noise mitigation analysis is required for
structures located on parcels abutting Serrano Avenue or parcels where only open space
areas are situated between the lot and Serrano Avenue (1-11, 85-106, 146-
160, 161 and 219-223 as indicated on Tentative Tract Map
reviewed by Planning Commission).5.A noise barrier is required at the top of slopes for parcels
1-11, 85-106, 146-160, and 219-223. The barrier shall be a minimum 6
feet in height. The barrier must have a surface density of at least 3.5 pounds per square
foot, and have no openings or racks. The noise barriers may be a wall, berm or a
combination of the two. The wall may be constructed of 1/4 inch plate glass, 5/
8 inch plexiglass, any masonry material, or a combination of these materials. Wood
and other materials may
be acceptable if properly designed as noise barriers.6.All single
family detached homes shall have roll-up garage doors.7.Consistent with the open
space provisions of the Specific Plan, private homeowners or homeowner
associations are expressly prohibited from extending fencing to encompass portions of said open space for
private
recreational uses such as view decks, patios, pools,etc.Conditions 8 through 17 shall be
completed to
the satisfaction of the
8. The tract design shall incorporate the concepts of Crime Prevention through
Environmental Design (CPTED). CPTED involves the placement and orientation of
homes, the access and visibility of common or public open spaces, and the design of
recreational trail areas. These designs shall promote public safety and physical security
while allowing the residents or public the ability to police their own neighboring areas.
9. All structures shall comply with the requirements of Municipal Code chapter 15.52
Building Security Standards), which relates to use of security hardware, doors, windows
and lighting.
10. All residential structures shall display the required address devices per Ordinance 7-
79.All structures that fail to meet visibility and legibility requirements shall display
an additional similar address device at a location approved by the Crime Prevention
Bureau.II. The design of all vehicular access gates, and any adjoining pedestrian gates within
the tract shall be subject to the design approval of the Police, Fire, and Public
Works Departments. All approved gates shall be equipped with a Knox Box for
emergency
access.12. Prior to issuance of grading permits, the Design Review Board, Fire and
Community Development Departments, and Crime Prevention Bureau shall review and approve
all public trail entrances, utility/maintenance road entrances and emergency access
road entrances which shall be treated with landscaping and vehicle gates or approved
security devices to restrict unauthorized vehicles from entering the roadway, open space areas,
or trail systems. Included in that review is entry design and placement of barriers,
fencing and landscaping. Approved vehicular gates shall be equipped with a Knox Box
for emergency
access.13. Where equestrian trails provide access across, through, or to the rear of residential
lots,security devices shall be employed along the trail, and be maintained to minimize
the opportunity for trespass or thefts from the neighboring residential properties.
Specific types of landscape plants may be considered for use as security
devices.14. Prior to issuance of any building permits, the Design Review Board, Department
of Community Development and Crime Prevention Bureau shall review and
approve fencing plans to assure conformance with the
following:All fencing required must be of solid construction shall have a minimum height of 6
feet above finished grade and be of a non-
climbable design.All fencing, including the design of slumpstone and glass, shall be of
a non-climbable design as approached from the exterior side of the fence when it is built
as a residential

Conditions 15 through 46 shall be completed to the satisfaction of the Public Works
Department/City Engineer:
Subject to conditions of Addendum sheet No.1, as attached.
A final map shall be recorded within 24 months after tentative map approval and prior to
the sale or lease of any lot.
Design, dedicate and construct Serrano Avenue according to plan and cross section
shown on Tentative Tract Map, including those lengths of Serrano that are shown on the
tentative tract map narrower that this cross section, consistent with the Settlement
Agreement between the developer, city and Peralta Hills Alliance.
Dedicate all public streets to City and Serrano Heights Specific Plan standards. Where
standards conflict, the Specific Plan standards shall take precedence over City standards.
Construct all public and private streets to city standards.
Install "No Parking" signs and striping along the 14 foot land width side of "A" and "B"
streets. Construct sidewalks along both sides of"B" street between Serrano Avenue and
easterly entrance to Lot #224.
Dedicate and construct storm drain system to City standards.
22. All permanent storm drain systems shall be constructed to Santiago Creek. Entrance into
Creek shall be as approved by the County Floor Control District.
23. Construct energy dissipaters at end of all temporary drainage facilities.
24. Erosion and dust control plans will be reviewed and approved prior to issuance of a
grading permit.
25. A bench 30 feet wide shall be constructed on all slopes greater than 100 feet in height.
26. Slope ratios of 1 Yd will only be allowed where deemed stable by a geologist or soils
engineer. All fill slopes greater than 2: 1 will require the installation of a soil stabilization
geo-grid, as required by the
geologist.27. Construct a paved access way to pad elevated 1,060 water reservoir tank
site.28. Developer shall establish Best Management Practices for eliminating of storm
water runoff contamination as outlined in the Drainage Area Management Plan, as required
by the National Pollution Discharge Elimination System Act. A copy of the
approved permit will be provided to City of Orange before grading permits are
issued.5 Reso No.
29. Vehicular Access Rights along Serrano Avenue shall be dedicated to the City of Orange.
30. No off-site grading or construction shall occur unless approval of property owners
is obtained and submitting in writing to the Public Works Department prior to approval
of the final tract map and the grading plan. Ifthe developer is not able to obtain
permission from the neighboring property owner to do off-site improvements, the grading
plan shall be redesigned so as not to require
off-site improvements.31. All grading shall be done in conformance with City
Landform Grading Concepts.32. Prior to occupancy of any residential structures, the developer
shall construct recreation trails as shown on the tentative map, also subject to review and
approval of the
Community Services Department.33. Subdrains shall be installed to prevent ground water runoff
and
nUisance water conditions.34. All drainage devices must conform to the City's Landform Grading Guidelines,
to be as inconspicuous as possible. Developer shall utilize colored concrete
to cause drainage facilities in slope areas to blend into surroundings, methods shall
be reviewed and approved by the Departments of Community Development
and Public Works.35. A homeowners association shall be established to maintain all
lettered lots, prominent slope areas slope irrigation systems, and slope drainage systems. Any
slope that is adjacent to streets or falls away from the building pad shall be
maintained by
the homeowners association.36. A Declaration of Covenants, Conditions and Restrictions ("CC&R's")
shall be prepared by the Developer and reviewed and approved by the City
Attorney and Community Development Department prior to approval of a Final Tract Map. The CC &
R's shall include specific details
for maintenance responsibilities.37. Street lights are required and will be installed by developer as
approved by the Department of Public Works, and the system dedicated to the
City of Orange.38. All street tree planting shall include the installation of Root Barriers on
the sidewalk side of the tree, or where conditions warrant, the installation of a Deep Root
Box as directed by the
Community Services Department.39. Approval is subject to payment of Eastern Transportation Corridor
Fee, Park Fees,Transportation System Improvement Program Fees, Fire Facilities,
Police Facilities Fee,and Library Fees, as specified by the Development Agreement between
City of Orange and Woodcrest

40. Cable television facilities shall be installed as required by the franchise cable T. V.
Company.
41. Off site construction of Serrano Avenue, west of the tract boundary, shall be completed
by the developer to provide an acceptable design speed of 50 M.P.H.
42. A raised landscape median is required for Serrano Avenue per Settlement Agreement
between the developer, city and Peralta Hills Alliance.
43. Developer shall prepare plans showing the alignment of Street "A"/Street "I" and Street
B"/Street "N" at their intersections with Serrano Avenue to confirm that street alignment
and striping conform to the City's Street Standards. These plans shall include striping,
striping transitions, on-street parking and or restrictions, and centerline and
right-of-way.These plans shall be approved prior to approval of a
final tract map.44. Serrano Avenue is to be redesigned to have parking bays a maximum 600
feet apart per City's "Standard Plans and Specifications: Standard Plan 105, note 3
and City Council Resolution #
7666, condition #35.45. Developer shall prepare and submit traffic striping and signing plans
in conjunction with the
street improvement plans.46. Developer shall provide and install all required traffic striping,
pavement markings, and signs on all public streets adjacent to or within the proposed Tentative
Tract Map 14359.Conditions 47 through 56 shall be completed to the satisfaction
of the
Community Services Department:47. Prior to the approval of the final tract map, the developer shall submit
the final alignment of the equestrian and hiking trails within the tract to the Parks Division
for final
review and approval.48. The equestrianlhiking trail located on the south side of Serrano Avenue shall
have a trail of width of not less than 10 feet and a landscaping buffer between the
equestrian trail and the sidewalk of not less
than 4 feet.49. The irrigation runoff from landscaping areas shall be designed to
flow away from equestrian trails and shall not flow onto
the equestrianlhiking trail.50. The on-site trail system shall be maintained by a special
maintenance district or other financial mechanism acceptable to and approved by the City prior to
the issuance of the first certificate of occupancy for development. The special
maintenance district or other financial mechanism shall be established at the expense
of the owner/developer.
51. Those slopes adjacent to or abutting arterial streets, highways and collector streets shall
receive the following tree size ratios whether the elevation is above or below a street, and
along or between continuous lots such as those of a planned unit development.
Shall be provided with a minimum forty percent of tree coverage with 40 percent
five gallons, 30 percent 24 inch box or larger, and a mix of deciduous and evergreen
trees. Tree spacing shall be less than one tree per 200 square feet.
Shrubs: Shall be a minimum of 50 percent shrub coverage with one gallon and five
gallon size shrubs. Shrub spacing shall be a maximum of four feet on center.
Ground Cover: May be hand planted with rooted cuttings from flats, spacing at twelve
inches on center to ensure adequate coverage within one year from time of planting, or by
hydro seed utilizing mixtures which will insure coverage within one year.
52. Transitional Slopes, including slopes immediately adjacent to natural (native) areas,
easements, and extremely difficult natural terrain shall receive the following:
A minimum thirty percent tree coverage, with 50 percent one gallon, 25 percent
five gallon, 25 percent 15 gallon or larger, and mix of deciduous and evergreen trees.
Tree spacing shall not exceed one tree per 200 square feet.
Shrubs: A minimum of twenty percent shrub coverage width one gallon
shrubs. Shrub spacing shall be a maximum of four feet on center.

53. All grading work for the park site shall be performed to City standards and Community
Services Department requirements with an approved grading plan. This grading shall be
under the supervision of an approved geotechnical firm in accordance with their
investigation and report. The side must be protected from erosion or run-off of water if
it is not developed immediately, with approved control measures including berms,
dikes,temporary storm drains, inlets,
etc.54. Park will be developed and dedicated to the City of Orange. A park development
plan will be prepared and submitted to the Community Services Department. Park will
be designed to provide active neighborhood athletic activities. Any and all costs
associated with the development and dedication of the park site shall be accepted in lieu of any
and all park development fees for the entire project, consistent with the terms of
the Development Agreement, Specific Plan, and Settlement Agreement between
the developer, city and Peralta Hills
Alliance.55. All fill soil used for the finish surface of the park site to 18 inches in depth shall be
Class A" top soil per the Standard Specifications. Soil from 18 inches to 36 inches in

shall be class "B". All other fill shall be approved by the City Engineer. The top 24
inches shall be compacted to 85 percent, the remainder in accordance with the soil report.
All soil shall be suitable for agricultural use, as verified and tested by an approved
laboratory.
56. The park site shall be free from any easements or development restrictions other than
those in the street frontage right-of-way. The presence of sewers, storm
drains, utility lines, pipelines, conduits and retarding basins have an adverse impact on the City'
s ability to develop
the site.Conditions 57 through 64 shall be completed to the satisfaction of the
Water Division Manager and
City Engineer:57. An on-site dedicated water system shall be installed by the developer
as designed and approved by
the Water Superintendent.58. The developer shall pay all Water Department fees and charges prior to
approval of the
final tract map.59. Each dwelling unit shall be metered separately unless otherwise approved
by
the Water Superintendent.60. The developer shall furnish and install individual pressure regulators
on all services where the incoming pressure exceeds 80
P.S.I.61. The developer shall provide a graded fifteen foot wide unencumbered
utility easement at the westerly end of Street F near lot 67 and lot C for connection to an
existing water main at the tract boundary and developer shall provide a graded
fifteen foot wide unencumbered utility easement at the westerly end of Street D near lot 31 and
lot 32 for connection to an existing watermain at
the tract boundary.62. Prior to the approval of the final tract map, the developer shall
furnish a Geotechnical Report addressing the suitability of all property to be used for
water utility purposes including water reservoir sites, pump station sites, and utility easements.
The report shall identifY all geologic conditions that could effect the installation of
water utility facilities including but not limited to identifying faults within the project area,
slope stability, soil bearing pressures, corrosive soil conditions, requirements if any
for underdrain systems and any other items judged significant by the
geotechnical consultant retained.63. All property to be used for water utility purposes and dedicated to the City shall
be free of soil contaminants and hazardous wastes. The geotechnical
report shall specifically
address this concern.64. The developer shall provide at no cost to the City a permanent, graded,
1100 zone water reservoir site of a size and at a location with appurtenances as approved
by the Water 9
Manager. The developer shall provide the site with electric utility service, telephone and
communication utility service, inlet-outlet water pipeline, overflow drain pipeline, and
a paved 20 foot wide access road to the building pad. All cleared and grubbed and
newly constructed cut and fill slope areas shall be replanted with native plant material
and maintained until such time that no further irrigation is required or as otherwise
directed by the City's Landscape Coordinator. Utility and pipeline connections shall
be constructed in the reservoir access road to the areas proposed to be served by the
1100 zone water reservoir which are generally located north and east of the
Edison transmission line easement and west of the intersection of Nohl Ranch Road and
Serrano
Avenue.Conditions 65 through 73 shall be completed to the satisfaction of the Fire
Department:65. Prior to the approval of a final tract map, a conceptual fuel modification plan shall
be approved by the Fire
Chief.66. The number and location of fire hydrants shall be determined by Fire and
Water
Departments.67. Every building shall be accessible to Fire Department apparatus by an access roadway
of not less than 20 feet of unobstructed width having a minimum of 13 feet 6 inches
of vertical clearance. The access roadway shall be extended to within 150 feet of
all portions of the exterior walls of the first story of any building. U.F.C. Section 901
and
902.68. All streets less than 36 feet wide shall be marked and signed as fire lane. The
marking and signage shall be provided and installed per the City of Orange Fire Departments
Fire Lane
Standards.69. Dead-end Fire Department access roads shall not exceed 600 feet. Fire sprinklers
shall be installed on lot numbers 141, 142, 143, 144, 145, 146, 147, and 148. The
fire sprinkler system shall be designed to NFPA 13 D. Fire sprinkler plans shall be submitted
prior to building
permit issuance.70. The Fire Department access roadway shall be provided with adequate turning
radius for Fire Department apparatus. (A 40 foot outside and 20 foot inside radius.) U.
F.C.Section 902.2.
2.3.71. All mechanical gates shall be provided with a key-operated override per
City of Orange Ordinance 9-84, with a manual release in
case of electrical failure.72. This project shall comply with the City of Orange's
Fuel Modification Program, which includes the requirement of a minimum twelve foot passage way from
a public street to the fuel modification zone to provide access for
emergency personnel and maintenance workers. Access ways are to be located no more than 500
feet apart with locations
approved by the Fire Department. The access areas are to be designated as a letter lot on
the approved tract map and a condition of construction shall be that the Homeowners
Association is responsible for the maintenance of the access. A statement shall be
included in the Homeowners Association C,C&Rs indicating the Homeowners
Association is responsible for maintenance of all fuel modification areas.
73. City of Orange Ordinance 3-94 requires all roof coverings to be fire retardant D.L,
listed Class A. the eaves shall be fire stopped and enclosed with approved material at the
eave ends to preclude entry of flame or embers under the roofing material. Openings
into attics, floors or other enclosed areas shall be covered with corrosion resistant wire
mesh less than one fourth inch, no more than one half inch in any dimension except where
such openings are equipped with sash or doors. In addition, a spark arrestor is required
on chimneys, maximum one half inch screen
required.74. Conditions related to approval of this map are not intended to supersede any of
the conditions attached to the approved Development Agreement, nor those related to
the Serrano Heights Specific Plan. The developer is also required to prepare plans or
conduct development activities according to mitigation measures contained in the project'
s Environmental Impact Reports and
Addendum.75. The applicant agrees to indemnify, hold harmless, and defend the City, its officers,
agents and employees from any and all liability or claims that may be brought against the
city arising out of its approval of this permit, save and except that caused by City's
active
negligence.76. The applicant shall comply with all federal, state and local laws. Violation of any
of those laws in connection with the use will be cause for revocation of this
