RES-8906 Approving Zone Change No. 1191-97RESOLUTION NO. 8906 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE UPHOLDING THE RECOMMENDATION OF THE PLANNING COMMISSION OF THE CITY OF ORANGE AND APPROVING THE REALIGNMENT OF THE BOUNDARY LINE BETWEEN PROPERTY ZONED R-O ( RECREATIONAL-OPEN SPACE) AND M-H (MOBILE HOME) ON PROPERTY SITUATED WEST OF PROSPECT STREET BETWEEN SPRING STREET AND WALNUT A VENUE AND THE RECLASSIFICATION OF PROPERTY SITUATED ON BOTH SIDES OF PROSPECT STREET BETWEEN WALNUT AVENUE AND SPRING STREET FROM M-H (MOBILE HOME) TO R-3 (RESIDENTIAL, MULTI-FAMILY).Zone Change 1191- 97 Applicant: Beazer Homes California, Inc.RECITALS:After report thereon by the Planning Commission and after due public hearing as required by law, and after receiving a recommendation from the Planning Commission, recommending,by Resolution No. PC 52-97, that (1) the boundary line between certain property situated west of Prospect Street between Walnut Avenue and Spring Street zoned R-O (Recreational-Open Space)and M-H (Mobile Home) be realigned, and (2) certain property situated on both sides of Prospect Street between Walnut Avenue and Spring Street be reclassified from the M-H (Mobile Home)District to the R-3 (Residential, Multi-Family) District, be granted, the City Council considered said recommendation and the testimony received at said public hearing and determined that the recommendation of the Planning Commission should be upheld and Zone Change 1191-97 be granted. Upon the public hearing before the City Council, the following facts were established: 1. The applicant, Beazer Homes California, Inc., is proposing to develop a vacant parcel of land (herein referred to as the "East Parcel") located east of Prospect Street between Walnut Avenue and Spring Street with 131 dwelling units (the "Project"). The East Parcel is approximately 11 acres in size. In order to develop the Project, the applicant is proposing to reelassify the East Parcel from M-H (Mobile Home) to R-3 ( Residential, Multi-Family).2. The applicant is also proposing to realign the existing boundary line between the M-H (Mobile Home) classification and the R-O (Recreational - Open Space) classification on a vacant parcel ofland located west of Prospect Street between Walnut Avenue and Spring Street herein referred to as the "West Parcel") and to reclassify the realigned land area having the M-H Mobile Home) designation to R-3 (Residential, Multi- Family). That portion of the West Parcel which is currently zoned M-H (Mobile Home) is approximately 21 acres in size. That portion of th,: West Parcel which is currently zoned R-O (Recreational - Open Space) is approximately 12 acres in size. Development of the that portion of the West Parcel proposed for realignment and reelassification as R-3 (Residential, Multi-Family) will require the approval of a tentative tract map, which is not among the requests ofthe applicant at this time.3. The Planning Commission recommended approval of the applicant's requests because the proposal would allow the orderly development ofthe East Parcel and the West Parcel in a manner compatible with surrounding residential uses and the development would include a precise street alignment for the eventual construction of the Walnut Avenue/Spring Street connection, which street alignment was also approved as outlined in Planning Commission R,: solution No. PC-53-97. The Planning Commission further recommended approval of Tentative Tract NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange that Zone Change 1191-97 be granted for the following reasons:1. The proposed zone change is consistent with the City's General Plan.2. The proposed zone change would allow residential development that will be compatible with existing land uses in the vicinity of the West and East Parcels.Adopted the 14th day of April, 1998.
