RES-8880 Annexation No. CA 97-25RESOLUTION NO. 8880 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE APPROVING AND ORDERING TERRITORY DESIGNATED AS ANNEXATION NO. CA97-25 (MEADS/ SANFORD)ANNEXED TO THE CITY OF ORANGE WHEREAS, the Local Agency Formation Commission of Orange County adopted its Resolution No. 97-25, on December 3, 1997, making determinations and approving the proposed annexation to the city of Orange of territory described in Exhibits A and B attached hemto and by this reference incorporated herein; and WHEREAS, the terms and conditions of annexation approved by the Local Agency Formation Commission are as follows:1. Payment by the applicant of State Board of Equalization and County Clerk fees.2. The effective date shall be the date of recordation.3. The boundaries of the territory proposed to be annexed to the City of Orange are specifically described in the legal description attached hereto and by this reference made a part hereof.4. Said territory includes approximately 1.0 acres and is found to be uninhabited and is assigned the following distinctive short-form designation: " Meads/Sanford Annexation".5. The City of Orange is designated as the conducting authority and is hereby directed to conduct proceedings without notice and hearing.NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Orange hemby orders the annexation described in Exhibits A and B, annexed, and directs the City Clerk to transmit a certified copy of this resolution to the Executive Officer of the LAFCO of Orange County.ADOPTED this 10th day ATTEST: Cassandra J. No. 8880 2 CD/jpm n CA97- 25 ::: ::1 U c RESOLUTION OF THE LOCAL AGENCY FORMATION COMMISSmN OF ORANGE COUNTY, CALIFORNIA I MAKING DETERMINATIONS AND APPROVING THE MEADS/ SANDFORD ANNEXATION TO THE CITY OF ORANGE December 3, 1997 On motion of Commissioner Herzog, duly seconded and carried, the following resolution was adopted: WHEREAS, application for the proposed annexation to the City of Orallgc, designated as the Meads/ Sandford Annexation to the City of Orange (CA97-25), in the County of Orange was heretofore filed with and accepted by the Executive Officer of this Local Agency Formation Commission pursuant to Title 5, Division 3, commencing with Section 56000 et seq of the Government Code; and WHEREAS, the Executive Officer, pursuant to Government Code Section 56838 set December 3, 1997 as the hearing date of this proposal; and WHEREAS, the Executive Officer, pursuant to Government Code Section 56833 has reviewed this proposal and prepared a report including her recommendation thereon, and has furnished a copy of this [I~port to each person entitled to a copy; and WHEREAS, this Commission on December 3,1997 considered the proposal and the report of the Executive Officer, and considered the factors determined by the Commission to be relevant to this proposal, including, but not limited to, factors specified in Government Code Section 56841; and WHEREAS, this Commission called for and held a public hearing on the proposal on December 3,1997, and at the hearing, this Commission heard and received all oral and wrinen protests, objections and evidence which were made, presented or filed, and all persons present were given an opportunity to hear ,md be heard with respect to this proposal and the report of the Executive Officer; and WHEREAS, the Executive Officer determined this proposal is exempt from CEQA under section 15319 of the State CEQA guidelines. NOW, THEREFORE, the Local Agency Formation Commission of the County of Orange DOES HEREBY RESOLVE, DETERMINE and ORDER as follows: Section 1. AYES: NOES: Resolution No. 97- 25 c)The applicant agrees to defend, hold harmless and indemmify LAFCO and/or its agents, officers, and employees from any claim, action or proceeding against LAFCO and/or its agents, officers and employees to attack, set aside, void or annul the approval of LAFCO concerning this proposal or any action relating to or arising out of such approval when such action is brought within the applicable statute oflimitations.Prior to the issuance of the Certificate of Completion by the Executive Officer, the city shall agree to participate in theFoothill/Eastem Transportation Corridor Fee Program including: collecting fees as required by the fee programs and depositing said fees together with earned interest on a quarterly basis with the Transportation Corridor Agency (TCA) or county, as applicable.Upon annexation of the territory to the city, all right, title, and interest of the county, including the underlying fee where owned by the county in any and all storm drains, trails, landscaped areas, street lights, signals, open space, local parks and bridges shall vest in the city. The city shall assume ownership and maintenance responsibility upon the issuance of theCertific.lte of Completion by the Executive Officer.The effective date shall be the date of recordation.The annexing area is found to be uninhabited, is within the County of Orange, and is assigned the following distinctive short-form designation: " Meads/Sandford Annexation to the City of Orange" (CA97-25).The City Council of the City of Orange is designated as the conducting authority G.
