PERMIT TO ALLOW THE OPERATION OF A SWAP
MEET AS A COMMERCIAL-RECREATION USE IN
AN INDUSTRIAL DISTRICT, UPON A 12.3 ACRE

Meets & Marketplace RECITALS:WHEREAS, on June 7, 1999, the Planning Commission held a
duly advertised and noticed hearing for the purpose of considering Conditional Use Permit
2290-99, requesting a commercial-recreation use in the
M-l (Light Manufacturing) District; and WHEREAS, the subject property consists of approximately 12.
3 acres of a 19.05-acre site located in both the cities of Orange and
Anaheim, addressed as 291 N. State College Boulevard, and is
more particularly described in Exhibit "Au; and WHEREAS, by Resolution
No. 35-99, the Planning Commission unanimously approved Conditional Use Permit
No. 2290-99 with certain findings and conditions; and WHEREAS, Appeal No. 463
was
timely filed by the appellant, Mayor Joanne Coontz;and WHEREAS, the City Council
heard the appeal of appellant by conducting a
duly advertised public hearing on July 27,1999; and WHEREAS, at said public hearing,
the City Council heard the testimony of members of the public and the applicant, reviewed the
evidence presented by all parties, and
1. The subject property is the location of the former Orange Drive-in Theater.
The prop'erty owner operated a weekend swap meet as an accessory use between approximately
1970 and April of
1998.2. Operation of a swap meet is a use which is needed by the
community.3. Conditions have been imposed which will prevent deterioration of
neighboring
uses,4. There is no substantial evidence that, with the implementation of
recommended mitigation measures contained in Negative Declaration 1597-99, the project will
have a significant impact on the environment or
wildlife resources.NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Orange that Appeal No. 456 is denied for the
following reasons:1. The foregoing recitals are true
and correct.2. The Conditional Use Permit is granted upon sound principles of land use
and in response to services required by
the community.3. The project will not cause deterioration of bordering land uses nor will
it create special problems for the area in which it
is located.4. The project has been considered in relationship to its effect on the
community and neighborhood in which it is located and no negative effects have
been found.BE IT FURTHER RESOLVED that the following conditions are imposed
upon the
projel~t:1. Within two (2) days of final approval of this project, the applicant shall deliver to
the Planning Division a cashiers check payable to the Orange County Clerk, in an amount required to
fulfill the fee requirements of Fish and Game CodeSection 711.4( d)(2) and the County
administrative fee,thus enabling the City to file the Notice of Determination required under Public
Resources Code 21152 14 Cal. Code Regulations 15075. If it is determined that there will be no
impact upon wildlife resources, the fee shall be $38.00. If the applicant has not delivered the
required fees within such two day period, approval for the project granted herein shall
be void.2. Property frontage along State College Boulevard will be landscaped, as proposed on the
applicant's site plan. The required landscaped area shall have a minimum width of 10 feet.
A detailed landscape and irrigation plan will be prepared by the applicant according to existing
city landscape design guidelines and submitted for review and approval
by staff.3. The applicant will consult with city and county staff to eliminate pollutants from storm
water runoff and prepare a proposal that incorporates recommendations of the Orange County
Drainage Area Master Plan (DAMP). A Water Quality Management Plan (WQMP) will be required.
The plan Reso No.
should address how pollutants will be eliminated from storm water runoff, specifically
hydrocarbons and related contaminants in the parking area, fertilizers and related pollutants from
landscaped areas, litter and trash control.
4. Parallel parking is not permitted along the edges of on-site access roads. The inbound
driveway will be posted "No Stopping Anytime". In order to prevent congestion or excessive queuing at
the entry to the site, no fee will be charged for parking unless a collection area with adequate storage
is designed by the applicant and approved by the City Traffic
Engineer.5. The left-turn lane that provides access to the site from southbound State College Boulevard
will be modified to provide dual left-turn lanes with 200 feet of storage capacity.
Street improvement plans will be prepared on the applicant's behalf and submitted for review and approval
by the Anaheim city engineer and California Department of Transportation. A copy of the approved
plan will be submitted to the City of
Orange Planning Division.6. The proposed gate at State College Boulevard will remain open at all times that
the property is occupied, and will be closed only when the
premises are vacated.7. A two-way drive aisle will be provided along the south edge of the paved
area adjacent to the unimproved parking area at the south end of the site, so that automobiles
may remain on the pavement so long as
parking spaces are available.8. The project, with the use of existing surface improvements proposed, does
not require dedication of land for the future construction of the adopted General PlanlMaster
Plan of Streets & Highways 100-foot-wide roadway across the site at this
time (tentatively known as "Walnut Avenue").However, the city will impose a condition to dedicate
and construct this roadway if surface development is proposed in the future. The property owner
and developer may be required to prepare an irrevocable offer to dedicate land and construct
the roadway from an existing signalized driveway entrance at State College Boulevard to the eastern border
of the property. The form and content of such a document is subject to review and
acceptance
by the City EngineerlPublic Works Director.9. A municipal water well site of a size, dimension, and
location satisfactory to the Water Manager shall be identified for future dedication to the City of Orange. The
site shall be level and have dimensions with a length to width ratio of approximately 1.3: 1.
Minimum size shall be 6,000 square feet. The site shall preferably have a common boundary with
access to a public street or adjacent to an on-site easement with access granted to city
vehicles. The site shall be located such that a well can be constructed a minimum of fifty feet
from the nearest sanitary sewer. A storm drain pipeline connection witha minimum capacity of
8 cu. ft./second, underground conduits, of suitable size and location for future provision
of 3-phase, 480-volt electric utility service, and telephone utility service shall be made available to the well
site. A water line of a size and location approved by the Water Manager shall be constructed
from the well
site to the existing City of Orange distribution system.10. A fifteen-foot easement shall be
dedicated to include all public water system facilities located on private property, such as water
mains, meters, valves, and hydrants, if such facilities are required,extended or
constructed to serve the approved use or any new development.11. An on-site manager will be
present during all business hours, and one hour before and after opening, and will prevent
the use of amplified
music or other noises of excessive volume which might undermine the quality of life in the adjacent
residential neighborhood, No amplified music will be allowed on site before 9:00
a..m.
12, The applicant's striping plan will include pavement markings to delineate the precise location of the
city boundary between Anaheim and Orange, which lies north of the existing concessions stand.
The purpose of marking this boundary is to help establish jurisdictional authority for law
enforcement officials.
13. In order to protect the existing structure on the site, which would remain abandoned 5 days each
week, the proposed fence around the seller field shall be increased to 8 feet in height, and
constructed of a non-climbable
material.14. The seller field is subject to Fire Code requirements that pertain to access lane widths and
minimum spacing between canopies. Approval of this conditional use permit does not guarantee a
minimum number of vendors. Fire Code requirements may reduce the number below that shown on
the proposed site plan. A detailed plan of the vendor area shall be prepared by the applicant
and submitted for Fire Department review and
approval.15, 'The swap meet operator will contact the Business Services Coordinator and obtain a Business
Tax Certificate (or "Business License") that is required for the facility, or make whatever
arrangements are required for individual
vendors.16. Approval of this conditional use permit is dependent upon approval of the same proposal by
the City of Anaheim, which has jurisdiction over a large portion of the site. Approval of this
request shall be null and void unless a CUP is also approved by
Anaheim.17. All plans shall conform in substance with those approved by the Planning
Commission.18, The applicant agrees to indemnify, hold harmless, and defend the City, its officers, agents
and employees from any and all liability or claims that may be brought against the city arising out of
its approval of this permit, save and except that caused by City's active
negligence.19. '[be applicant shall comply with all federal, state and local laws. Violation of any of those laws
in connection with the use will be cause for revocation of this
permit.20. ~!bese conditions will be reprinted (with this Resolution) on the cover sheet or first page
of construction plans, if
applicable.21. An agreement between Pacific Theatres and the Orange Police Department will be prepared
to address extraordinary security needs, policing and monitoring responsibilities and
responsibilities for service costs, and will be executed by both parties prior to
opening.22. The applicant will repair any damaged or unstable property line fences, in addition to
the requirement to install a vendor area enclosure that is two feet higher than the existing fence. (
See Condition No.
13).23. Audio vendor stalls shall be limited to that portion of the seller field that lies west of the
existing snack bar/refreshment building, or between that building and State College
Boulevard.24. Noise and dust management adjacent to the easterly and southeasterly property lines shall
include maintenance of oil-gravel surfaces off the pavement (or other surfactants acceptable to
water quality officials), and maintenance of existing asphalt or concrete paved surfaces, prohibition
of vendor Reso No,
vehicle parking within the first two parking aisles south of the seller field, and delineation for
visitors to encourage circulation to available parking on a paved surface north of the seller field,
thereby preventing unnecessary use of the gravel parking area until improved on-site parking
areas have been
filled,25. No live bands, instruments, or live music performance is proposed by the applicant or permitted
on the
site.26. Drive aisles along the eastern property line, adjacent to the mobile home park, shall be posted "
No Parking, Tow Away," a prohibition that will be enforced by the swap meet management. Text,
size and spacing of signs are subject to review and approval by the city Traffic Engineering Division
and City EngineerlPublic Works
Director.27, Should remnant parcels of the former State College right of way be quit-claimed to
or otherwise obtained by the applicant, the applicant shall landscape the area subject to the approval
of a landscape plan submitted for review and approval by the Community Development
Department and
Landscape Coordinator.28.. The applicant shall provide trash clean up, beginning in the easterly area of the parking lot
and the vendor sales area immediately upon vacation or closure of that area. Said trash pick up
will be accomplished on each business day within one hour of closure at the eastern edge of
the site,progressing through the balance of
the site.29. Because of the need to protect the general welfare of citizens and adjacent properties,
this approval shall be subject to review by the Community Development Department and other
staff. Should excessive use of police services or resources occur, or other unforeseen negative
impacts occur,additional conditions may be approved upon re-hearing by
the Planning Commission.30. Hours of operation shall be limited to Saturdays, Sundays, and seven holidays per
year, as requested by the applicant, with operating hours not to commence before 6:00 a.m., and
sales concluding by
4:00p,m.The following provisions are applicable to this project and are included for information only.
This is not a complete list of requirements, and other Orange Municipal Code provisions may apply
to the project.Refer to an inter-office memorandum prepared by Wendy
Saunders, dated May 26,1999, for a project-specific
list of Fire Department requirements.Prior to issuance of building permits, the applicant
shall pay all statutory development fees, including but not limited to:
Transportation System Improvement Program, Fire Facility, Police Facility, Park Acquisition,
Sanitation District, School District, and Eastern
Foothill Transportation Corridor, as
