RECITALS:After report thereon by the Planning Commission and after due public hearings
as required by law, and after receiving a recommendation from the Planning
Commission,recommending, by Resolution No. PC 96-98, that a tentative tract map and
minor site plan tosubdivide 6.2 acres into five residential lots and to create lots
without direct ac(;ess to public streets upon property located 500 feet south of Santiago Canyon
and east of Jamestown Way, be approved, the City Council considered said
recommendation and the: testimony received at said public hearings and determined that the
recommendation of the: Planning Commission should be upheld and Tentative Tract Map No.
15710 and Minor Site Plan Review No. 57-98 be granted. Subject property
is more particularly
described as follows:A PORTiON OF LOTS 71 AND 76 OF TRACT NO.
918, AS SHOWN ON A MAP RECORDED IN BOOK 28, PAGES 41
TO 43 INCLUSIVE OF MISCELLANEOUS MAPS, RECORDS
OF ORANGE COUNTY,AND A PORTION OF LOT 2 IN BLOCK A OF THE
LAND OF OGE AND BOND, AS PER MAP RECORDED IN BOOK 3,
PAGES 430 AND 431 OF MISCELLANEOUS RECORDS IN THE
OFFICE OF THE COUNTY RECORDER OF LOS
Upon the public hearings before the City Council on March 23, 1999, and April
13, 1999, the following facts were established:
1. The applicant, George Klimek, is proposing to subdivide the property,
zoned in part R-I-15 and in part R-I-40, into five parcels, each of which
will be one acre or larger in size. Saidproperty consists of 6.2 acres. The
applicant intends to develop the five parcels for his person use with a main house, two guest
houses a caretaker house and a cabin. A lake will be
created on the property.2. Access to the proposed parcels is via a road
easement that will connect Santiago Canyon Road to the northeast corner of the site.
The proposed road would circulate through the site. The proposal
includes a gated entrance.3. The proposal includes recordation of CC&Rs
to assign responsibility for maintenance of the private road, the
perimeter walls and utilities.4. The proposal includes dedication of a
recreational train easement located along thewesterly and northerly boundllI)'
lines of the site.5. The environmental impacts of the proposal have been
examined and it is determined that no
negative effects will result.NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Orange that Tentative Tract Map No. 15710 be approved
for the following reasons:1. The foregoing recitals
are true and correct.2, There appears no substantial evidence that the proposed project
will have a significant effect on the environment or that it will have any potential
for adverse effect on wildlife resources, as that term is defined in Section 711.2 of
the California
Fish and Game Code.3. The proposed project, including its provisions for
design and improvement, 1S consistent with the
City's General Plan.4. The site is physically suitable for the proposed type
and density of development.5. The design of the subdivision and proposed improvements
will not conflict with any easements for public access through or use of
property
within the proposed subdivision.
BE IT FURTHER RESOLVED by the City Council of the City of Orange that
Minor Site Plan No, 57-98 be granted for the following
reasons:1. The foregoing recitals are true and
correct.2. The project will not cause a deterioration of neighboring land
uses.3. The project conforms to the City of Orange development standards and
applicable special design gUidelines and specific plan
requirements.4. The project will not cause significant negative environmental
impacts.5. On and off-site circulation is adequate to support
the project.6. City and other public services are available and adequate to serve
the project 7. The project is compatible with
community aesthetics.BE IT FURTHER RESOLVED that Tentative Tract Map No. 15710
and Minor Sitt: Plan No. 57-98 be approved subject to
the following conditions:1. Development shall be in substantial compliance with plans approved
by the Planning Commission and City Council, and on file with the
Department
of Community Development.2. All residential construction must complywith the State..
Energy Insulation Standards title 24) and City of Orange Building Codes in effect at the time>
of applicatioll for building permits. . The building permits have to be noted that the plans
conform to the State standards at
time of issuance.3. Glare from any private street lighting shall be shielded, screened, and/
or oriented so c as to not be seen from'any point beyond the exterior boundaries of
the property and the source shall n\)t be 'a nuisance to any point beyond the exterior
boundaries of the property; nor 'causeilhl1ninationin the surrounding residential areas exceeding
of
0,5 foot-candles.4. The applicant agrees to indemnify, hold harmless, and defend
the City, its'officers,agents and employees from any and all liability to claims that
may be brought against the City arising out of its approval of this permit, save and except
that caused by the
City's active negligence.'5. The applicant shall comply with, all feder~,. state and local laws.
Violation of any of those laws in connection with the use will be cause for
revocation of this permit.

6. The applicant shall dedicate and improve a 12' wide recreational trail along the
westerly and northerly property lines. The trail improvement shall be per the City's
Recreational Trail Plan. ~ "

8. A fmal tract map shall be recorded within 24 months after tentative approval and

9. Monuments shall be set based on a field survey.
10. Install private driveway lighting to City requirements per layout approved by the City
Traffic Engineer.
11. Install cable television facilities as required by City's Franchised Cable TV
companies. This shall include easement rights to buildings being served.
12. CC&R's shall be reviewed and approved by the City Attorney's Office. The CC&R's
shall include a provision for maintenance and repair of the private drive and
p1erimeter fencing, sanitary sewers, and storm drains.
13. Dedicate to the city the right to enter the private driveway for maintenance of public
utilities, emergency access, trash collection, etc.
14. Pay all applicable fees prior to City approval of Final Map, such as: water charges,
slewer frontage fee, etc.
15. Design of the private driveway gated entry shall be to the satisfaction of the City's
Traffic Division, Fire Department, and Police Department.
16. The private driveway shall be designed to Public Works Engineering and Fire
Department standards including, but not limited to: width, thickness of pavement,
radius of curves and turnarounds.
17. Each parcel shall be provided with recorded utility easements and complete utility
hookups.
18. Each parcel shall be provided a recorded easement over the private driveway for
ingress/egress to Santiago Canyon Road.

19. Water service shall be installed on the Jamestown Street frontage as designed by the
Water Department.
20. The developer shall satisfy all Orange Park Acres Mutual Water Company's
requirements.
21. The developer shall satisfy all East Orange County Water District's requirements.
22. The developer shall satisfy all water main connection, plan check, and inspection
charges as determined by the City of Orange Water Department.
23. The developer shall maintain the flow and drainage from adjacent properties subject
to the approval of the City Engineer, with improvements proposed for this
development.
The following code provisions are applicable to this project and are included for
injiJrmation only. This is not a complete list of requirements, and other code provisions
may apply to the project.
Prior to issuance of building permits, the applicant shall pay all applicable
development fees, including but not limited to: City sewer connection fee, Orange County
Sanitation District connection, Transportation System Improvement Program, Fire
Facility, Police Facility, Park Acquisition, Sanitation District, School District (pursuant to
the provisions of the Leroy F. Greene School Facilities Act of 1998), and Eastern Foothill
Tnmsportation Corridor, as required.
An approved fIre sprinkler system must be installed throughout the building per
O.M.C. 15.32.070 Section 100LlO. The system shall be designed per N.F.P.A. 13 and
13 D, U.B.C. Chapter 9, D.B.C. Standards 9-1 and
9-2.The Fire Department connection shall not be affixed to the building.
The Fire D(:partment connection must be located at least 40 feet away from the building,
within 40 fel:t of a fIre hydrant and on the address side of the building, unless
otherwise determined by the Fire Department. The hydrant shall be located on the same side of the street
as the Fire
Department connection.Provide 8 on-site fIre hydrant(s) and mains capable of supplying
the required fIre flow. The required fIre flow shall be provided for a minimum duration of
4 hours. The hydrant model and on-site location shall be approved by the Fire
Department and have a three foot minimum clearance around the circumference of the
fIre hydrant. The on-site hydrants shall not be controlledby the control valve (P.I.v.)
for the sprinkler system so that water flow to the hydrants is not impaired should the
sprinkler system be shut
for amy reason. (UF.e. Sections 90~ and 1001.7) The fire department connection shall
not pressurize a hydrant. Plans must be submitted to the Building Department.
The number and location hydrants shall 'be determined by Fire and Water
Departments.
Prior to issuance of a fire service (detector check) the required water supplies for
hydrants and fire sprinkler systems shall be determined and the water supplies shall be
approved by the Fire Department.
Every building shall be accessible to Fire Department apparatus by an access roadwayofnotlessthan20feetofunobstructedwidthhavingaminimumof13feet6inchesof
vertil;al clearance. Thi:r access roadway shall be extended to within 150, feet of all

than 36 feet wide shall be marked and signed as a fire lane. The marking and signage
shall be provided and installed per the-City of Orange Fire Departments Fire
Lane Standards.On-site
Fire Department access roadways shall be an all weather driving surface capable
of supporting the imposed loads of fire apparatus, 40,000 pounds and shall not exceed

All mechanical gates shall be provided with a key-operated ovenideper City
of Orange Ordinance 9-84, and a manual release in case of
electrical
failure.I , .A Fire Department approved key box for Fire Department access shall be
installed on the address side of the building near the main entrance or fire control room at a
height of 7 feet above finished grade. The Knox box shall contain keys to gain access

fire retardant VL listed or ICBO "Class A," indicating the approved number on the plan.

be fire stopped and enclosed with approved material at the eave ends to preclude entry of
flame or embers under the roofmg material. Openings into attics, floors or other enclosed
areas shall be covered with corrosion resistant wire mesh less than one fourth inch, no
more than one half inch in any dimension except where such openings are equipped with
sash or doors. In addition, a spark arrestor is required on chimneys, maximum one half-
inch screen required.
All structures shall comply with the requirements of Municipal Code - Chapter 15.52 Building
Security Standards), which relates to hardware, doors, windows, lighting, etc.Ord.
7-79). Approved structural drawings shall include sections of the security code that
apply. Specifications, details, or security notes may be used to convey the compliance.
An illuminated address of 4 inches in height is required upon each structure (Ord. 7-
79). A second address number will be required for lots that do not permit visibility of the
primary number. Secondary numbers shall meet the requirements of primary residential
address numbers per Ordinance (7-79). Address location to be approved by
Crime Prevention
Bureau.All landscaping shall be maintained so that it does not interfere with the
required addressing or areas that are required to be
illuminated.Comply with the requirements for rural and private street
lighting.Police and Fire Departments shall approve gate and driveway design for
emergency acc:ess ways prior to plan approval and
construction.Project approval expires automatically if it is abandoned or inactive for a period of
24 months from the date of approval. An extension of time may be permitted upon a
written rec[uest, if received before the expiration
