RES-9107 Combined Transportation Program Funds Program No. 95-ORNG-1149RESOLUTION NO. 9107 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE REQUESTING THE ORANGE COUNTY TRANSPORTATION AUTHORITY TO ALLOCATE COMBINED TRANSPORTATION PROGRAM FUNDS FOR ACQUISITION OF RIGHT-OF-WAY FOR THE LA VETA AVENUE AND GLASSELL STREET INTERSECTION WIDENING, PROJECT NO. 95-0RNG-1l49.WHEREAS, the Orange County Transportation Authority approved a Combined Transportation Funding Program (CTFP) for fiscal year 1996/97; and WHEREAS, the CTFP includes $837,457.00 in fiscal year 1996/97 for the acquisition of right-of-way for an Intersection Improvement Project at La Veta Avenue and Glassell Street; and WHEREAS, the City's Master Plan of Arterial Highways (MP AH) designates the La Veta Avenue and Glassell Street intersection as Secondary Highways (4 lanes); and WHEREAS, the City of Orange has adopted a General Plan Circulation Element which does not preclude implementation of the MP AH within its jurisdiction; and WHEREAS, the City of Orange has ( I) prepared all right-of-way documents, and 2) designed the project improvements, and (3) completed required preparatory work in accordance with the standards required by the City and other affected jurisdictions involved with said project; and WHEREAS, the City of Orange, has acquired, or has order of immediate possession of the right-of- way required for completion for the La Veta Avenue and Glassell Street Intersection Widening Project.NOW THEREFORE, BE RESOLVED as follows:I. That the City of Orange hereby requests the Orange County Transportation Authority to allocate $ 535,026.00 of CTFP funds from the Intersection Improvement Program for right-of- way acquisition for said project to the City. This request is in conformance with the CTFP allocation process and does not exceed ninety percent (90%) of the programmed amount or ninety 2. That the City of Orange agrees to fund its share of the right-of- way costs of the above indicated Intersection Improvement Project and any additional costs over the identified programmed amount.3. The City of Orange agrees to submit a Final Report to the Orange County Transportation Authority within one hundred twenty (120) days after the City's finalization of right-of-way acquisition, at which time the Orange County Transportation Authority will transfer the remaining ten percent (10%) of the programmed funds, or approved expenditures as determined from the items of work eligible for reimbursement under the CTFP guidelines to the City of Orange.ADOPTED this 11th day of May, 1999.ATTEST: l~~.Mti(~r/1/~Cassandra J.
