City Clerk COOPERATIVE AGREEMENT THIS COOPERATIVE AGREEMENT (the "Agreement") is made at Orange, California, on the _ day of , 1999, by and between the CITY OF ORANGE, a municipal corporation ("City") and ORANGE COUNTY CHAPTER OF THE AMERICAN RED CROSS, a nonprofit charitable corporation, ("Red Cross"), who agree as follows: RECITALS I. The City is responsible for public health, welfare and safety and for the preservation of life and property within its geographic boundaries in times of man-made or natural disasters and emergencies through specific preparedness activities and by conducting and coordinating actual disaster relief operations, including the maintenance or restoration of normal government services and facilities.2.. By Charter of the United States Congress, the Red Cross has the responsibility for undertaking relief activities for the purpose of mitigating suffering of "disaster victims" byman..made or natural disasters and emergencies.3. In order to effectively respond to such disasters and emergencies, the City may need the assistance of the Red Cross.4. In planning for an effective response to man-made or natural disasters and emergencies, the City and the Red Cross recognize a common responsibility to insure the highest level of mutual cooperation and coordination of their respective emergency services and resources.5. In order to ensure such cooperation and coordination, there is a need to set forth the parties' roles in disaster preparedness, training, planning, operations, and related training exerelses.6. The City conducts its preparedness activities and operations under the authority of the Federal Civil Defense Act of 1950, as amended and the Disaster Relief Act of 1974, as amended.7. The Red Cross conducts its preparedness activIties and operations under the authority of the Act of Congress of January 5, 1905, as amended; the Disaster Relief Act of 1974,as amended; and the American Red Cross Disaster Services Regulations and Procedures (ARC 3000 series.)NOW, THEREFORE, the parties agree AGREEMENT 1. General City Responsibilities Consistent with municipal ordinances and the City's Emergency Plan, during natural or man-made disasters or emergencies, the City shall be responsible for the following:A. Extension and augmentation of certain government services, including police and fire protection, warning and evacuation, search and rescue, emergency medical, public health and sanitation services.B. Provision of communications, transportation and manpower to extend or augment normal government services.C. Survey and damage assessment, designation of hazardous areas and structures,removal of debris from public property, and coordinating restoration of utilities and services.D. Coordination of the care for the general public including the aged and infirm and those persons injured, disabled or displaced as a result of disasters and emergencies.E. Coordination with responsible governmental agencies in the identification and disposition of deceased persons.F. Determination and coordination of priorities in the allocation and use of available local resources, and channeling requests for support through other public or private agencies.2. General Red Cross Responsibilities Consistent with its Congressional Charter, during natural or man-made disasters or emergencies, the Red Cross shall be responsible for the following:A. Providing emergency mass care including care and reception centers and shelters to any number of persons affected by disasters and emergencies or in response to threats.B. Handling welfare inquiries from relatives outside the disaster or emergency area.C. Providing emergency assistance to individuals and families on the basis of need,facilitating their ability to resume living in customary dwellings rather than in shelters.f""\ pr~vidin: licensed nurses to supplement the exist;ng commur.ity health care delivery system.E. Providing emergency and preventive health servlces, including psycho-social support to disaster F. Providing referrals to families regarding other available governmental and private assistance and, if necessary, assisting them in making application for such aid. G. Providing additional recovery assistance on an individual or family basis, when other resources are not available to meet disaster or emergency needs. This will be in accordance with Red Cross national standards for additional assistance. H. Providing blood and blood products for disaster victims. 1. Channeling assistance through normal commercial establishments in the City to aid in restoring disrupted local economies. J. Providing all disaster and emergency assistance to victims without charge or request for repayment from the victims or the City. 3. Disaster and Emergency Plans The City and the Red Cross mutually agree to cooperate In the development, implementation and coordination of the following plans: A. Disaster Preparedness. 1.) The City and the Red Cross shall exchange disaster plan information and revIsions through the Orange County Emergency Management Organization (OCEMO) to encourage uniformity. 2.) The Red Cross and the City shall share their respective written disaster plans. B. Operations Liaison. 1.) During an actual disaster, the City shall provide space within its Emergency Operations Center for a Red Cross liaison. 2.) The Red Cross shall assign a liaison to the City's Emergency Operations Center to assist in disaster relief operations during an actual disaster. C. Emergency Mass Care 1.) The City and thc Red Cross shall cooperate in conducting and maintaining an inventory of all buildings which could potentially serve as mass care facilities. As the need arise:s, the City and Red Cross shall cooperate in designating one or more of these facilities based on proj ected need. 2.) The City shall advise the Red Cross immediately when the possible need for a shelter is indicated.3.) The Red Cross shall retain administrative authority and financial responsibility for the mass care activities which it provides. A Red Cross shelter manager shall be assigned to each mass care facility and shall be responsible for managing the shelter,including assuming responsibility for the costs involved in providing Red Cross shelter and feeding operations.4.) The City shall admit properly identified Red Cross personnel into disaster areas to provide mass care services, such as the feeding of emergency workers and disaster victims.5.) The Red Cross shall train City staff and volunteers as Red Cross volunteers. Training shall consist of those courses outlined below. Upon completion of said training and approval of the Red Cross, individuals will be able to open a care and reception center or shelter in the name of the Red Cross. If the City and Red Cross mutually agree to open a car,c and reception center or shelter, the Red Cross shall assume administrative and financial authority of said center/shelter. City staff and volunteers opening these facilities shall complete at a minimum the following training which shall be provided at no cost by the Red Cross:Hours Volunteer Orientation Introduction to Disaster Services, ARC 3066 Mass Care: An Overview, ARC 3068 Shelter Operations, ARC 3068-11 Shelter Simulation, ARC 3068-12 3 3 ( Self Study)3 3 u 13.5 Advanced training and actual shelter experience are required to become a qualified shelter manager. Advanced training is available through Red Cross.D. Dama~e Assessment Operations 1.) The City and the Red Cross shall exchange and share darnage assessment information and cooperate in conducting assessments to the maximum extent possible.2.) The City shall admit Red Cross personnel into disaster areas to render assis1tan~e 2nd conduct disaster darnage assessments.E. Direct Assistance to Families.1.) The City shall assist the Red Cross in establishing facilities as disaster service centers by providing use of City-owned facilities as available and requested. 2.) The Red Cross shall provide emergency assistance to disaster victims. In carrying out any relief activities, the Red Cross shall exercise administrative and financial authority over its own operations. F. Disaster Health Services. 1.) The Red Cross shall recruit and train volunteer licensed nurses to supplement local health care delivery system. 2.) The Red Cross shall staff Red Cross shelters with at least one trained licensed nurse on a 24-hour basis.3.) The City and Red Cross shall collaborate and exchange information regarding health services issues and concerns.G. Recurrent Local Disasters. The City shall notify the Red Cross of recurrent disasters (such as house fires) when families or individuals require immediate assistance. The Red Cross shall use its best efforts to dispatch a Disaster Action Team to meet the emergency need.s of victims.H. Notification and Contact. The City shall promptly notify the Red Cross of actual or potential emergencies and disasters at the earliest possible time, using a predesignated Red Cross 24-hour emergency reporting number. 4. Indemnity A. The Red Cross shall indemnify, hold harmless and defend the City, its officers,employees, agents and volunteers from any legal liability with respect to bodily injury, death and property damage, reasonable costs and expenses arising out of the negligent acts or omissions of the Red Cross or its officers, employees, or agents (this includes City staff and volunteers when working under the supervision and control of Red Cross) in the performance of its responsibilities under this Agreement.B. The City shall indemnify, hold harmless and defend the Red Cross, and every officer and employee of the Red Cross, from any legal liability in respect to bodily injury, death and property damage, reasonable costs and expenses arising out of the negligent acts or omissions of the City or its officers, employees, agents or volunteers in the performance of its responsibilities under this Agreement.5. ConformitywitI' "t'ltaf.Fede,' lL ~."reements Nothing in this Agreement shall be considered to invalidate or change any eXlstmg,agreements currently entered into with federal or state agencies, by the City and/or the Red Cross and in the event of future understandings with federal or state agencies, the parties this Agreement to assure compliance thereto. This Agreement shall be reviewed annually and modified as appropriate by mutual agreement of the parties. 6. Termination The City and the Red Cross agree that either party may terminate this Agreement at any time, for any reason, by providing the other party a written notice thirty (30) calendar days prior to the termination date. 7. No Third Party Rights This Agreement is not intended to confer rights upon any individual or group not a party hereto and is entered into by the City and the Red Cross solely for the foregoing stated purposes.
