RES-9098 Upholding Appeal No. 450RESOLUTION NO. 9098 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE OVERRULING THE DECISION OF THE PLANNING COMMISSION OF THE CITY OF ORANGE AND UPHOLDING APPEAL NO. 450, GRANTING A CONDITIONAL USE PERMIT TO ALLOW THE ON- SITE SALE AND CONSUMPTION OF BEER AND WINE UPON PROPERTY LOCATED AT 1948 NORTH TUSTIN STREET. Appeal No, 450 Conditional Use Permit No. 2238- 98 Applicant and Appellant: Aroma Italiano Coffee House RECITALS:WHEREAS, on September 21, 1998, the Planning Commission of the City of Orange conducted a public hearing as required by law to consider Conditional Use Permit No. 2238- 98;and WHEREAS, the proposed Conditional Use Permit was to allow the on-site consumption of beer and wine for an existing restaurant upon property located at 1948 North Tustin Street;and WHEREAS, the subject property is commonly known as 1948 North Tustin Street and is more particularly described in Attachment "A", which is attached hereto and incorporated herein by this reference; and WHEREAS, by Resolution No. 69-98, the Planning Commission denied Conditional Use Permit No. 2238- 98 with certain findings; and WHEREAS, Appeal No. 4S0 was timely filed by the appellant, Riccardo Bosco,representing Aroma Italiano Coffee House; and WHEREAS, the City Council heard the appeal of appellant by conducting a public hearing on November 10,1998; and WHEREAS, at said public hearing, the City Council heard the testimony of members of the) public, considered documentary evidence presented and found the facts more particularly set forth as follows:1. The proposal is granted upon sound principles of land use and in response to 2. The proposal will not cause deterioration of bordering land uses or create special problems for the area in which it is located. Approval of this CUP will not cause an increase in the clrime rate for that police reporting district, nor will there be any adverse effect from over conclmtration of liquor licenses in that police reporting district. 3. The proposal has been considered in relationship to its effect on the cornmunity or neighborhood plan for which the area in which it is located and will fit in well with the shopping center. 4. The proposal is made subject to the following conditions necessary to preserve the general welfare and not the individual welfare ofthe applicant: 1) Development shall be in substantial compliance with plans as approved by the Plarming Commission, and which are on file with the Department of Community Development. 2) There shall be no coin-operated games or video machines maintained upon the premise at any time.3) There shall be no exterior advertising of any type, including advertising directed to the exterior from within, promoting or indicating the availability of alcoholic beverages. Interior displays of alcoholic beverages or signs which are clearly visible to the exterior shall constitute a violation ofthis condition.4) The quarterly gross sales of alcoholic beverages shall not exceed the gross sales of food or other commodities during the same period. Licensee shall at all times maintain records that re:flect separately the gross sales of food and gross sale of alcoholic beverages of the licensed business. The records shall be kept no less frequently than on a quarterly basis and shall be made available upon request.S) Sales and service of alcoholic beverages shall cease at least one (1) hour prior to the close of business each day.6) One year after the cornmencement of the sales of alcoholic beverages begin, this conditional use permit shall be reviewed to evaluate if excessive calls for police services and/or any other re:lated problems have occurred that are associated with the sale of alcoholic beverages.7) The applicant agrees to indemnify, hold harmless, and defend the City, its officers, agents and employees from any and all liability or claims that may be brought against the City rnising out of its approval of this permit, save and except that cause by City's active nl~ gligence.8) The applicant shall comply with all federal, state, and local laws. Violation of any of those laws in connection with the use will be cause for revocation of this permit.Reso No. 9098 9)1 If not utilized within two (2) years of the date of approval, this conditional use permit shall expire. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange that Appeal No. 4S0 is upheld and Conditional Use Permit No. 2238-98 is approved for the following reasons:1. The foregoing recitals are true and correct.2. The findings required by Orange Municipal Code Section 17.1 0.030.F are met.Adopted the27'" day of April, 1999.
