RELATIVE TO THE DENIAL OF THE APPLICANT'S
REQUEST TO CONSTRUCT FIVE RESIDENTIAL
UNITS BEHIND AN EXISTING HISTORIC SINGLE
FAMILY HOME UPON PROPERTY LOCATED AT 630

RI~CITALS:A. Upon the appeal by the applicant, Ralph and Linda Zehner, of the decision
of the Planning Commission of the City of Orange issued on October 26,1998, which was
embodied in Planning Commission Resolution No. 84-98, and after due public hearing as required
by law, the City Council of the City of Orange considered Mitigated Negative
Declaration 1540-97, Minor Site Plan Review 58-98, the development project and all
other actions and proceedings and matters related thereto, the record of the proceedings
before the Planning Commission in connection therewith, and the staff report and all of the testimony
given at the public hearing held by the City Council on January 12, 1999, and determined that the
appeal by the applicant of the decision of the Planning Commission should be
upheld and Mitigated Negative Declaration 1540-97 and Minor
Site Plan Review 58-98 be denied.B. The subject
property is more particularly described as follows:THE
EAST HALF OF THE FOLLOWING DESCRmED LAND:COMMENCING 30 FEET
SOUTH 132 FEET WEST OF THE NORTHEAST CORNER OF RICHLAND FARM
LOT 38, IN THE CITY OF ORANGE,COUNTY OF ORANGE, STATE
OF CALIFORNIA, AS SHOWN ON A MAP RECORDED IN BOOK
5, PAGE 1123 OF MISCELLANEOUS RECORDS, OF LOS ANGELES
COUNTY, AND RUNNING THENCE SOUTH 301 FEET;THENCE WEST 132
FEET; THENCE NORTH 301 FEET AND THENCE EAST
132 FEET TO THE POINT OF BEGINNING.C. The City Council found that, at
the public hearing, the project proposal was opposed by several residents from
the adjacent residential community. Their concerns were primarily related to noncompliance of
S1llndards for Old Towne, as approved by the City Council on June 13, 1995 and revised on July
11, 1995 (herein referred to as the "Design Standards") in that, among other things:
a) The garage building (with the unit above) is too large in terms of its closeness and
physical relationship to the front dwelling and is not consistent in size, scale and
context with surrounding development and is not compatible with the character of
the surrounding area;
b) The overall height causes an imposition upon the historic relationship of the open
space of the streetscape and the contributing structures on the south side of Culver
Avenue;
c) Building materials are not in some respects compatible with the character of the
other historic residences on the block; and
d) The development project would be incompatible with the current historic
architectural context and bulk and mass of existing buildings on the block and
will, therefore, erode or adversely affect the character of the other historic
residences on the block.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange as
follows:
1. The foregoing recitals are true and correct.
2. Based upon the findings and determinations made by the Planning Commission at its
publk hearing held on October 26, 1998 and set forth in Planning Commission Resolution No.
84-98, the appeal by the applicant of the decision of the Planning Commission on
Mitigated Negative Declaration 1540-97 and Minor Site Plan Review 58-98
is hereby denied.Adopted the ~ th day
