RES-9356 Letter of Understanding Police Association effective March 2001 through February 2004RESOLUTION NO. 9356 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE ESTABLISHING A LETTER OF UNDERSTANDING BETWEEN THE CITY OF ORANGE AND THE CITY OF ORANGE POLICE ASSOCIATION EFFECTIVE MARCH 1, 2001 THROUGH FEBRUARY 29, 2004 This Letter of Understanding ("LOU") is entered into by and between the City of Orange (the "City") and the City of Orange Police Association (the Association)." In October 2000, the City and the Association met and engaged in the Meet and Confer process to establish its next contract. These discussions resLlited in this LOU between the City and the Association, who have agreed to the following: Term of Aqreement March 1, 2001 through February 29, 2004 Salclrv Increases first Year 3.5% Salary Increase for all Sworn personnel effective 7/1/2001 3.0% Salary Increase for all Civilian personnel effective 7/1/2001 (except Police Dispatchers) 4.0% Salary Increase for all Police Dispatchers effective 7/1/2001 Second Year 3.5% Salary Increase for all Sworn personnel effective 6/30/2002 3.0% Salary Increase for all Civilian personnel effective 6/30/2002 Jhird Year 3.5% Salary Increase for all Sworn personnel effective 6/29/2003 3.0% Salary Increase for all Civilian personnel effective 6/29/2003 PEHS 3% lal 50 Retirement Benefit The City agrees to pay the increased cost for the 3% @ 50 benefit program with a cap of 7.0% for all Sworn employees effective by June 1, 2001. Any"Employer Contribution" due to PERS greater than 7.0% shall be equally borne by the City and the covered employees. The Association agrees to have its employees pay 50% of any cost for this benefit over 7.0% when such cost exceeds 7.0%. 1 Medical Insurance Contribution first Year The City shall increase the medical insurance premium for all full time employees from $496 per month to $546 per month effective 3/1/2001. econd Year The City shall increase the medical insurance premium for all full time employees from $546 per month to $586 per month effective 3/1/2002. Jhird Year The City shall increase the medical insurance premium for all full time employees from $586 per month to $595 per month effective 3/1/2003. Salarv Median LanQuaQe The Association agrees to suspend the salary median language that exists in the current MOU from July 2000 until July 2002. COPA and the City will conduct a salary survey by or before July 30, 2002 of the eleven (11) pre-selected cities to determine the maximum (top step)salary for each classification covered by this MOU. The contractual July 2002 salary data from the survey agencies as well as the City of Orange will be utilized for any necessary adjustments. In the event that any classification is below the median of the eleven (11) surveyed cities, the City shall increase the entire salary range of that classification to a maximum of 2.0%. The effective date for any applicable salary increases will be June 30, 2002. The eleven (11) pre-selected cities are Anaheim, Brea, Costa Mesa, Fountain Valley, Fullerton, Garden Grove, Huntington Beach, Irvine, Newport Beach,Santa Ana, and Westminster. The City will not increase the salary for any c:lassification if said classification is less than 1.0% behind median.COPA and the City will again conduct a salary survey by or before July 30,003 of the eleven (11) pre-selected cities to determine the maximum (top step) salary for each classification covered by this MOU. The contractual July 003 salary data from the survey agencies, as well as the City of Orange, will be utilized for any necessary adjustments. In the event any classification is below the median of the eleven (11) surveyed cities, the City shall increase the entire salary range of that classification to a level at the survey median.The effective date for any applicable salary increases will be June 29, 2003.The City will not increase the salary for any classification if said classification is less than 1. 0% HearinQ Officer The Association agrees to remove the following language contained in Section 6, Artic:le XXV of the current MOU: In grievances filed to challenge the imposition of discipline, the final step in the formal administrative process shall be a decision rendered by a Hearing Officer following a full and fair evidentiary hearing conducted by a Hearing Officer. If the parties cannot agree on the identity of the Hearing Officer, the parties shall procure from the State Conciliation Se/Vicea list of seven (7) qualified Hearing Officers. Each party shall altematively strike one name from the list until only one person remains, who shall be the Hearing Officer. The determination as to which party strikes first shall be made on a random basis.The Hearing Officer shall determine whether good cause exists for the imposition of discipline and, if so, the appropriate degree of discipline, provided that the Hearing Officer may not impose more severe discipline than that assessed by the Police Department. The decision of the hearing officer is subject to the right of either party to seek judicial review pursuant to Section 1094.5 of the California Code of Civil Procedure. The cost of the Hearing Officer shall be split equally between the City and the Police Association."Educational Incentive Pay Effective July 1, 2001, the Association agrees to reduce the monthly education pay levels for all qualified employees hired after September 1, 1984, as follows:Post Intermediate (A) from $100 to $50 per month Post Intermediate (B) from $200 to $150 per month Post Advanced (C) from $300 to $250 per month Bachelor' s Degree (D) from $400 to $350 per month Master' s Degree (E) from $500 to $450 per month The Association further agrees to reduce the monthly educational pay levels for all eligible employees hired prior to September 1, 1984 as follows:Post Intermediate (A) from $113 to $63 per month Post Intermediate (B) from $226 to $176 per month Post Advanced (C) from $338 to $288 per month Bachelor' s Degree (D) from $451 to $401 per month Master' s Degree (E) from $564 to $514 per month 3 Special AssiQnment and Special Pay The Association agrees to remove the existing MOU language under Article IX, Section 2A, 2E, and 2F of the current MOU and replace the existing language with the following new language: A. Motor Officers and InvestiQators. Police Officers assigned by the Chief of Police in a special assignment as a Motor Officer shall receive an additional six percent (6%) compensation above the employee's regular compensation during the period of such special assignment, provided the employee is performing all the significant duties of the special assignment. Effective July 1, 2001, employees assigned as Motor Officers shall receive six and one-half (6Y:.%) compensation above their regular compensation in lieu of the 6% listed above. Motor Officers shall clean and maintain their City issued vehicles during their regular duties. If any cleaning or maintenance is required to be done outside the regular work day and will trigger overtime pay, approval for such work must be obtained from the immediate supervisor prior to performing such work."Police Officers assigned by the Chief of Police in a special assignment as an InvestiQator, shall receive an additional seven and one- half percent 7Y:.%) compensation above the employee's regular compensation during the period of such special assignment provided the employee is performing all the significant duties of the special assignment.E. Canine Officers. Police Officers may be assigned from time to time by the Police Chief as Canine Handlers and shall be responsible for maintaining, training and utilizing a police service dog during their regular duties. The parties recognize that not all care for a police service dog can be accomplished during the regular work schedule. The parties agree that in the past, Canine Officers were compensated for all off-duty canine activities through the special assignment pay and other overtime policies of the City. The parties further agree that eight (8) hours per month constitutes the number of hours that Canine Officers reasonably spend outside the regular work schedule for all time spent in relation to the care,maintenance, and training of a police service dog and related equipment.The parties agree that effective March 1, 2001, such activities shall be paid at the hourly rate of $13.00 an hour ($19.50, when factoring in FLSA overtime). In addition to the eight (8) hours per month compensation,Canine Officers shall continue to receive six percent (6%) per month of their base salaries as special assignment pay. With appropriate documentation, the City agrees to separately compensate Canine Officers for visits to the veterinarian or unusual occurrences that accomplished during regular work hours at 1 Y:. times the Canine Officer's base salary hourly rate. Effective July 1, 2001, employees assigned as Canine Officers shall receive six and one-half (6Y:.%) compensation above their regular compensation in lieu of the six percent (6%) listed above.F. Corporals. Police Officers may be assigned from time to time by the Police Chief as Corporals within the Patrol, Motors, or Canine units.Police Officers appointed to these special assignments shall receive as compensation an additional eight percent (8%) per month in addition to their regular salary, which is in lieu of and not in addition to the special assignment pay received by other Police Officers in these assignments."New Memorandum of Understandinq The City and the Association agree to incorporate the provisions contained in this Letter of Understanding into a new Memorandum of Understanding once both partlles have had an opportunity to review and concur on any and all language changes included in the new MOU.Ratification and Execution The City and the Association acknowledge that this Letter of Understanding shall not be in full force and effect until ratified by the Association and adopted by the City Council of the City of Orange.
