RES-9355 General Plan Amendment No. 2-00RESOLUTION NO. 9355 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE UPHOLDING THE RECOMMENDATION OF THE PLANNING COMMISSION AND APPROVING THE GENERAL PLAN CLASSIFICATION OF PROPERTY GENERALLY LOCATED BETWEEN JAMBOREE ROAD AND THE EASTERN TRANSPORTATION CORRIDOR, SOUTH OF IRVINE REGIONAL P~ ALSO INCLUDED IS A PARCEL LOCATED WEST OF JAMBOREE ROAD AND NORTH OF CHAPMAN AVENUE.GENERAL PLAN AMENDMENT NO. 2-00 APPLICANT: THE IRVINE COMPANY RECITALS: After report thereon by the Planning Commission and after due public hearing on October 10, 2000, as required by law, the City Council of the City of Orange considered a recommendation of the Planning Commission of the City of Orange recommending by Resolution No. PC 58-00 that the property situated between Jamboree Road and the Eastern Transportation Corridor, south of Irvine Regional Park, presently within the planning area of the East Orange General Plan, be changed from Mixed Use, Employment, Low-Medium Density Residential, Medium Density Residential, and Open Space to Low Density Residential, Low-Medium Density Residential, Medium Density Residential, and Open Space. Also, that the property situated west of Jamboree Road and north of Chapman Avenue be changed from Public Facility to Low-Medium Density Residential on the City' s General Plan.I""'"Further, amendment to the Circulation Element was considered as follows:Downgrade Chapman Avenue from eight lanes to six lanes between Fort Road and the Eastern Transportation Corridor (ETC)Delete Fort Road extension from Jamboree Road to Santiago Canyon Road Delete Canyon View extension from Jamboree Road to Santiago Canyon Road Show constructed ETC alignment with parallel Jamboree Road extending southerly to City of Tustin Realign Handy Creed Road to tee into Jamboree Road Also, amendment to the text of the East Orange General Plan was considered as it Amendments included in General Plan Amendment 2-00 are more fully presented in attached Exhibit "A" and incorporated herein by this reference as though fully set forth herein.The real property which is the subject of General Plan Amendment 2-00 is generally "depicted on the map attached hereto as Exhibit "8" and incorporated herein by this reference as though fully set forth herein and shall be referred to herein as the " subject property".During its public hearing, the City Council found the facts more particularly set forth as foHows:1. In 1989, the City adopted the East Orange General Plan (EOGP) which included the portion of the subject property located east of Jamboree Road.2. The EOGP designated that portion of the subject property: Mixed use, employment,low-medium density residential, medium density residential, and open space.Notably, the EOGP designated 185 acres ofthe subject property for development of a Town Center which would have contained up to 1.7 million square feet of mixed use development. In addition, up to 1,756 dwelling units were envisioned in the area of the subject property located outside of the Town Center.3. The applicant seeks to amend the EOGP in order to eliminate the urban center, high development intensity theme in order to develop a planned community similar in uses to Santiago Hills, which is located immediately west of the subject property. Such a planned community would be exclusively residential with substantial components of open space. Low Density Residential, Low- Medium Density Residential, Medium Density Residential, and Open Space designations are being sought.4. In addition to the above, a 25 acre portion of the subject property is located west of Jamboree Road and north of Chapman Avenue. This portion is currently designated Public Facilities on the City General Plan. The applicant seeks to redesignate this parcel to Low Medium Density Residential to be developed as part of the planned community.5.Other elements of the general plan amendment include modifications to the Circulation Element, as more particularly noted above, to administratively update the Circulation Element, as well as to make modifications as justified by the reduced development intensity. Also, text of the EOGP is proposed to be modified, as it applies to the subject property, where it is not consistent with the objective of developing a community similar to existing Santiago Hills.6. The applicant proposes to develop 1,746 dwelling units on the subject property. In addition, two-four acre neighborhood parks are proposed, as well as, a ten acre elementary school. The entire site consists of a total of 494 acres of land, 110 acres,or 20% of which will be open space. A recreations trail system the planning ofthe subject property. 7. A fiscal impact analysis projects that the planned community, at build out, will result in a fiscal deficit of $79,000 annually. 8. Supplemental Environmental Impact Report (SEIR) 1278 was prepared to supplement Final Environmental Impact Report (FEIR) 1278 and SEIR 1278 was determined to be adequate and complete and findings were made as documented in a separate resolution. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange as follows:1. That the foregoing recitals are true and correct.2. That the City and the applicant mutually agree that the applicant will coordinate with the City in the City's updating of the Master Plan of Trails.3. That the City Council desires to preserve the grove of Oak trees along the alignment of Santiago Canyon Road, near the entrance to Irvine Park and to minimize visual impacts to the ridge line along the northern edge of Santiago Canyon Road. Staff is instructed to work with the County and The Irvine Company to seek solutions to avoid, as much as possible, disturbance to these trees and ridgeline. Possible design measures may include: (a) eliminating the sidewalk on the north side of the arterial,b) eliminating the center median (to reduce the amount of grading), (c) designing a split level road, and (d) realigning the road slightly to the south. These measures are to be investigated with the understanding that traffic safety must not be compromised.4. That the City and the applicant mutually agree that the applicant will pay to the City a total of $400,000.00 to address the fiscal deficit. An Agreement shall be prepared and executed between the parties whereby payment will be made by the applicant, as building permits are issued for each residential unit constructed on the subject property. 5. That the City will accept payment of fees in the amount of $3 million, in addition to provision of two-4 acre neighborhood parks which are to be improved in a manner acceptable to the City, in satisfaction of the requirements of Chapter 5.18 of the Orange Municipal Code (Park Dedication and Fees). Said fees shall be due, in its entirety, upon annexation of the subject property into the City of Orange. The full $3 million shall be due irregardless of any reduction in the number of dwelling units ultimately developed on the subject property. 6. That the City and applicant mutually desire that a sports park be developed in a subsequent phase of development to take place east of the Eastern Transportation Corridor. 7. That Supplemental Environmental Impact Report 1278 was certified as documented in a separate resolution. 8.That the recommendation of the Planning Commission be upheld and that General Plan Amendment 2-00 redesignating the subject property generally depicted on Exhibit "B" attached hereto, be approved because the amendment is in the best interests of the City of Orange and its citizens. 9. The redesignation of the subject property shall become effective thirty (30) days from and after the date of adoption of this Resolution. 10. The City Clerk is hereby authorized and directed to (a) make copies of this Resolution available to the general public within one (1) working day following the date of adoption, and (b) furnish to any person making a request for a copy of the adopted documents amending the General Plan within two (2) working days after receipt of a request therefor accompanied by payment for the reasonable cost of copying. Cat art City Clerk ofthe City of Orange EXHIBIT A I"" AMENDMENT TO LAND USE ELEMENT This amendment is proposed to accomplish all graphic and statistical modifications to the Land Use Plan to accomplish the project. These modifications are summarized as follows: A. Reduction of Non-residential Acres and Intensity Currently the East Orange General Plan allocates 1.7 million square feet of Commercial and Employment intensity for the area so designated on the General Plan Land Use Map. This intensity assumed extensive grading throughout the project area connecting residential collector roads, filling all wetlands, and simultaneous grading of the project and SR241/ 261. 0,Given these circumstances, the residential character of adjoining development, and a desire to reduce traffic, commercial and employment uses have in a large mixed use center are not an appropriate use in this location. Accordingly, this application requests the elimination of non-residential use in the mixed use and employment categories to residential.This reallocation accommodates more compatible uses next to the existing Santiago Hills residential community and dramatically reduces maximum intensity and traffic in the area.Santiago Hills II General Plan Amendment 09/22/ The major components of the amendments are listed ;IS follows: Employment changed to Low-Medium Density Residential.Mixed Use changed to Low, Low-Medium and Medium Density Residential.Portions of Low-Medium DE'nsity Residential changed to Low Density Residential and Open Space. Community Park deleted.Institutional changed to Low-Medium Density Residential.Medium Density Residential changed to Low-Medium Density Residential.The City review process may result in modifications to specific sectors.)B. Policy Provisions The proposed project would amend the EOGP to darify that certain provisions within the EOGP do not apply to the Santiago Hills II portion of the EOGP. With the adoption of zoning for the site and specific development standards, the development standards outlined in the EOGP would not apply to Santiago Hills II project. Other provisions of the EOGP that would not apply to the Santiago Hills II include the following goals, policies, and implementing measures:Land Use Element Policv 1.1: .Provide a mix of jobs and housing, and encourage the types of activities that will provide employment for the City's existing and future residents, as well as revenue for the City."Land Use Policy 1.2: "Provide a complete community which includes commercial, industrial, residential, and park uses and which provides opportunities for churches, hospitals, cemeteries, and other public facilities. ..Land Use Element Goal 3: "The City will continue to encourage employment uses which provide jobs and revenue to the City without compromising environmental quality." -,Land UseImDlementation Measure 4.4. 1: "Comprehensive specific plan/zoning will be prepared as provided by the East Orange Annexation Agreement. The plan will contain standards of development for those categories of land use provided for in the EOGP. The development standards proposed as part of the Planned community zoning would apply to the Santiago Hills II project. Goal 11 , as stated in the EOGP, would still apply. The goal reads: "Use zoning regulations to ensure that low and low-medium density single-family residential neighborhoods are practical in function and attractive in appearance."Land Use Element Policv 2.7.3: This entire section is dedicateo to guidelines for employment use. With the elimination of the mixed use designation, this detail is not applicable to the Santiago Hills II project.ODen SDace & Conservation Element Imolementina Measure 3.5. 1:The specific character of land uses within 150 feet of Santiago Canyon Road may be refined through specific plans prepared for the E OGP. The specifIC plans shall include a scenic corridor component for Santiago Canyon Road which establishes detailed scenic corridor requirements, including building setbacks, parkway dimensions,landscape concepts, grading concepts, screening measures and a wall concept:Land Use Element Imolementing Measure 4.6.1: " In conjunction with each specific plan, develop a comprehensive Childcare Implementation Program. The measure then provides detail on the provisions to be includerl in the program."Santiago Hills II General Plan AMENDMENT TO CIRCULATION ELEMENT The planning and land use concept envisioned for Santiago Hills Phase II endeavors to be responsive to existing land forms where possible while at the --samel time yielding the land use intensity anticipated in the General Plan. To help achie! ve this desired result, and to best accommodate traffic flow within Santiago Hills, it is proposed that the following City of Orange General Plan Circulation Element Amendments be implemented:Downgrade Chapman Avenue from a lanes to 6 lanes between Fort Road and Eastern Transportation Corridor (SR241 )Delete Fort Road extension from Jamboree Road to Santiago Canyon Road. Delete Canyon View Avenue extension from Jamboree Road to Santiago Canyon Road.Show constructed ETC alignment with parallel Jamboree Road extending southerly to City of Tustin.Healign Handy Creek Road to tee into Jamboree Road.These technical modifications will continue to allow the roadways to meet level of service objectives as currently required by the General Plan. In addition, the proposed circulation system is compatible with the ultimate design for SR241 and SR261. It is anticipated that upon adoption by the City of the proposed Circulation Element, the Orange County Transportation Authority will be requested to amend the Orange County Master Plan of Arterial Highways to delete the Canyon View Extension.
