A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE DENYING APPEAL NO. 472
AND UPHOLDING THE DECISION OF THE
PLANNING COMMISSION TO APPROVE
CONDITIONAL USE PERMIT 2320-00
GRANTING A REQUEST TO USE EXISTING
RESIDENTIAL DWELLINGS AS A GROUP HOME FOR
ADULT WOMEN UPON PROPERTY LOCATED AT
143 NORTH GRAND

RECITALS:WHEREAS, on February 23, 2000, the Planning Commission of the City of
Orange conducted a public hearing as required by law to consider Conditional Use Permit No.
2320-00 regarding use of existing residential dwellings as a group home for adult
women; and WHEREAS, the subject property is commonly known as 143 N. Grand Street
and is more particularly described
as follows:TIlE NORTIl 59.5 FEET OF LOT 2, BLOCK "A", OF THE
LffiRARY TRACT,COUNTY OF ORANGE, STATE OF CALIFORNIA, AS PER MAP
RECORDED IN BOOK 5, PAGE 21 OF MISCELLANEOUS MAPS, IN TIlE OFFICE
OF TIlE COUNTY RECORDER OF
SAID COUNTY WHEREAS, by Resolution No. 14-00, the Planning
Commission approved Conditional Use Permit No. 2320-00
with certain findings; and WHEREAS, Appeal No. 472 was timely filed by the
appellants, Thomas
and
Arlene Avdeef; and I""WHEREAS, the City Council heard the appeal of appellants
by conducting a public heating on
April 11, 2000; and WHEREAS, at said public hearing, the City Council heard
the testimony of appellants and ten members ofthe public, and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange
that, based upon the substantial evidence presented, Appeal No. 472 is denied and Conditional
Use Permit No. 2320-00 is approved based on the following
reasons:1. The foregoing recitals are true and
correct.2. The proposed use of the property as a group home for adult women will
provide important seIVices required by the
community.3. The proposed use of the property will not cause deterioration of bordering commercial
or residential land uses, nor will it create special problems for the area in which the site is
located.4. The proposed use was considered with regard to the City's General Plan, which is
the only community or neighborhood plan affecting land use for the site and surrounding area and
is fOWId consistent with the General
Plan.BE IT FURTHER RESOLVED that the following conditions are imposed
with
approval:1. As proposed by the applicant, at least one responsible adult will reside or otherwise
be present to supervise residents and manage the
property.2. Any change in ownership or management of the approved use will be reported to
the Community Development Department prior to transfer of ownership or
implementation of new programs. Substantial changes in use or operation of the facility may
require review and approval by the Planning
Commission.3. The operator is required to maintain existing on-site parking spaces for use
by employees,residents, and guests. Transportation services will be provided by the operator
on a continual basis, using a passenger van or shuttle that will be parked on site or
in the immediate vicinity (with property
owner consent).4. All plans shall conform in substance with those approved by the
Planning Commission.Accessory uses, such as laundry facilities, storage room and garages shall
not be converted to any other uses, unless such uses are consistent with zoning
standards and accessory to the approved
residential use.5. The applicant shall indemnify, hold harmless, and defend the City, its officers,
agents and ~employees from any and all liability or claims that may be brought against
the City arising out of its approval of this permit, save and except that caused by City'
s

6.The applicant shall comply with all federal, state and local laws, including all City
regulations. Violation of any of those laws in connection with the use will be cause for
revocation of this permit.r-
7. The applicant shall install smoke detectors and outdoor security lighting, improvements
that will be reviewed and approved by City staff.
The following code provisions are applicable to this project and are included for
information only. This is not a complete list of requirements, and other code provisions may
apply to the project.
Existing shade structures will be removed from required side and rear yards, prior to
applicant's use of the building.
