RES-9291 Approving Tentative Tract Map No. 14550RESOLUTION NO. 9291 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE UPHOLDING THE RECOMMENDATION OF THE PLANNING COMMISSION AND APPROVING A TENTATIVE TRACT MAP TO ALLOW THE SUBDMSION OF 18.9 ACRES OF PROPERTY INTO 126 LOTS IN THE PERALTA HILLS, EAST OF THE INTERSECTION OF SERRANO AVENUE AND ORANGE PARK BOULEVARD AND NORTH OF SANTIAGO CREEK AND SANTIAGO OAKS REGIONAL PARK, BETWEEN SIERRA VISTA DRIVE AND APACHE CREEK ROAD, IN AN AREA GOVERNED BY THE SERRANO HEIGHTS SPECIFIC PLAN. Tentative Tract Map 14550 Applicant: SunCal Companies RECITALS: After report thereon by the Planning Commission and after due public hearing as required by law, the City Council of the City of Orange considered a recommendation of the Planning Commission recommending by Resolution No. PC 4-00 that Tentative Tract Map 14550 be approved to allow the subdivision of 18.9 acres of property into 126 lots, in the Peralta Hills, east of the intersection of Serrano Avenue and Orange Park Boulevard and north of Santiago Creek and Santiago Oaks Regional Park, between Sierra Vista Drive and Apache Creek Road, in an area governed by the Serrano Heights Specific Plan.After finding and determining the hereinafter described facts, the City Council deternlined that the environmental impacts of the proposed project were adequately addressed by Environmental Impact Report 954 and Supplemental Environmental Impact Report 1305, as certifiled by the City in 1986 and 1990, and as amended in February of 1997 by addendum; that the project is consistent with the City's General Plan, the Serrano Heights Development Agreement and the Serrano Heights Specific Plan, and that Tentative Tract Map 14550 should be approved, as recommended by the Planning Commission. I""The real property which is the subject of Tentative Tract Map 14550 is generally described as Development Area 2 in the Serrano Heights Specific Plan and Lot 85 of Tract 15695.During its public hearing, the City Council found the facts more particularly set forth as 1.The applicant, SunCal Companies, is proposing this project, in compliance with proposed rc;:visions to the development standards in the approved Specific Plan, as a less- intensive alternative to the maximum number of units allowed in the Specific Plan. 2. The project will consist of 126 single-family residential parcels.3. The environmental impacts of the proposal have been previously examined and said impacts are adequately addressed.NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange that Tentative Tract Map 14550 be approved for the following reasons:1. The foregoing recitals are true and correct.2. The design of the subdivision and proposed improvements will not cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat, c:ause serious public health problems, or conflict with any easements for public access through or use of property within the proposed subdivision.3. The project environmental impacts were adequately addressed in Environmental Impact Report 954 and Supplemental Environmental Impact Report 1305 and as amended in February of 1997 by addendum.4. The proposed subdivision, including its provisions for design and improvement, is consistent with the City's General Plan, the Serrano Heights Development Agreement, and the Serrano Heights Specific Plan.5. The site is physically suitable for the proposed type and density of residential development.BE IT FURTHER RESOLVED that Tentative Tract Map 14550 be approved subject to the following conditions:1. Prior to the City Council hearing on this matter, regulations for Development Area No. 2 will be revised to include a provision that the maximum permitted building height is two and one-half stories or 32 feet, whichever is less. Refer to O.M.C. ~ 17.04.038 for a dc~finition of "half story". Regulations will prohibit future additions or expansion of habitable space above the second story unless new construction is entirely contained within roof of originally- permitted structure.Reso No. r- 2. The tentative tract map will be revised so that one ofthe individually-numbered parcels is eliminated as a housing site and developed with a children's playground or swimming pool as a recreational amenity for use by residents of the respective tract. The recreation facility shall be located upon lot 95.3. Prior to the City Council hearing on this matter, references to the "RMM" zoning classification will be changed to "R-4" in regulations for Development Area 2.4. A sound attenuation study will be conducted by a certified noise analyst and submitted for review by the city. The study will identify parcels that are vulnerable to noise levels exceeding the city standard and include recommendations to reduce noise within buildings, such as upgraded window glazing, sound wall construction, installation of a mechanical ventilation system constructed of sound attenuating materials, etc.5. "No Parking Anytime" restrictions will be placed on both sides of Apache Creek Road,extending north from Serrano Avenue, to a minimum distance of200 feet beyond A Street.6. A traffic signal shall be designed and constructed by the developer (and to the satisfaction of the City Traffic Engineer) at the intersection of Serrano Avenue and Apache Creek Road.Conditions 7 through 19 will be completed to thesatisfaction of the City Engineer:7. Subject to conditions of addendum sheet no. 1.8. A final tract map shall be recorded within 24 months after tentative approval and prior to the sale or lease of any parcel.9. Monuments shall be set based on a field survey.10. A street lighting system will be provided for private residential streets, with an average minimum lighting output of one-third foot-candle.11. Dedicate to the city the right to enter private streets for maintenance of public utilities,emergency access, trash collection, etc.r-12. Cable television facilities shall be installed as required by the franchise cable TV company,including easement rights to buildings being served.13. CC&R's shall be prepared by the developer, and submitted for review and approval by the city. CC&R's will provide for maintenance and repair of private streets, common recreation facilities and landscape areas not covered by the master Serrano Heights community association.14. Construct A, B, C, D, E and F streets according to city standards for private streets. To satisfy ADA requirements, the 4Y2-foot sidewalks must be widened where obstructed by fire hydrants and other utilities. F Street should have a sidewalk on both 15. Provide for adequate sight distance at the intersection of A and C streets and Apache Creek Road. Deed restrictions will have to be recorded on lots 87, 103 and 126. Sight distance rc;:quirements will be determined upon consultation with the City Traffic Engineer, and may include locations other than those identified in this condition. 16. Dedicate and construct storm drain and sanitary sewer systems to city standards, including easements. The storm drain system must be designed to accommodate a I OO-year storm event at cul-de-sacs of A, B and C Streets.17. Prior to issuance of a grading permit, notice of intent must be filed with the State Water Resources Control Board and a copy provided to the city, along with a copy of the Storm Vater Pollution Prevention Plan.18. Tract entry gates will not be constructed, nor permitted, for any street intersecting with Apache Creek Road.19. Sight.distance lines will be shown upon grading plans (and landscaping plans) for Lot 126.Plans will be reviewed and approved by the City Traffic Engineer.Conditions 20 through 25 will be completed tothe satisfaction of the Water Division Manager and City Engineer:20. An on-site dedicated water system shall be installed by the developer, as designed and approved by the Water Manager.21. The developer shall satisfy all water main plan check and inspection charges determined by the Water Division, prior to the approval of the final tract map.22. Each dwelling unit shall be metered separately unless otherwise approved by the Water Manager.23. The developer shall furnish and install individual pressure regulators on all services where the incoming pressure exceeds 80 psi.24. The developer shall dedicate to the city a minimum 15- foot water utility easement to include water main, meters, detector checks and fire hydrants.25. If any streets are improved with decorative pavement, a construction access agreement will be submitted to the city.Other conditions shall be completed to the satisfaction of City staff.26. Sltructures shall comply with the requirements of Municipal Code chapter 15.52 (Building S'~curity Standards), which relates to use of security hardware, doors, windows and 27. All structures shall display the required address devices to satisfy Ordinance 7-79. All structures that fail to meet visibility and legibility requirements (such as those built on flag lots) shall display an additional similar address device at a location approved by the Crime Prevention Bureau. 28. The applicant agrees to indemnify, hold harmless, and defend the City, its officers, agents and employees from any and all liability or claims that may be brought against the Csity arising out of its approval of this permit, save and except that caused by City's active negligence. 29. The applicant shall comply with all federal, state and local laws. Violation of any of those laws in connection with the use will be cause for revocation of this permit. 301. Prior to the City Council hearing on this matter, regulations for Development Areas 2 will be revised to include a requirement that a common recreation facility, such as a recreation building or swimming pool, will be integrated within the design of any residential project which utilizes the standards contained therein. The facility will not be located at the perimeter of the tract, and must be situated near the center of the community. Pedestrian access will be provided between the facility and residential units, via sidewalks on all public or private streets. 31. Conditions related to approval of this map are not intended to supersede any of the conditions attached to the approved Development Agreement, nor those related to the Serrano Heights Specific Plan, nor Tentative Tract Map 14359. The developer is also required to prepare plans or conduct development activities according to mitigation measures contained in the project's Environmental Impact Reports and Addendum.
