A LETTER OF UNDERSTANDING BETWEEN THE CITY
OF ORANGE AND THE FOLLOWING RECOGNIZED
BARGAINING UNITS: ORANGE CITY FIRE FIGHTERS,
INC.; ORANGE MAINTENANCE & CRAFfS
EMPLOYEES' ASSOCIATION; ORANGE MANAGEMENT
ASSOCIATION; ORANGE MUNICIPAL EMPLOYEES'
ASSOCIATION; CITY OF ORANGE POLICE
ASSOCIATION; CITY OF ORANGE POLICE
MANAGEMENT ASSOCIATION; AND WATER
DEPARTMENT EMPLOYEES' ASSOCIATION.
This Letter of Understanding (LOU) is entered into on May 23, 2000 by and between the
City of Orange herein after referred to as the "City" and the seven (7) recognized City of Orange
Bargaining Units noted above, herein after referred to as the "Associations".
The City and the Associations have completed the meet and confer process related to
chang(:s in wages, hours, benefits, and terms and conditions of employment pursuant to the
Meyers-Milias-Brown Act. A Memorandum of Understanding has been signed by
the parties documenting the conditions of their respective agreements. Included in the
agreement between the Ci1y and the Associations is the subject of the 2% @ Age 55 PERS
Formula. Specifically,each of the MOU's currently contains the following language, or a similar version
of
this language:Employees are required to pay four percent (4%) of their salary,
pre-taxes, through payroll deduction, to fund the enhanced PERS 2% @ age 55 retirement
formula. If the City agrees to pay for any or all of this 4% employee payment for
any other bargaining group, regardless of the effective date, the City agrees to pay the
same amount for employees without additional meeting and conferring or concessions
by the employees. "The representatives of all seven (7) bargaining units above have agreed to
sign this Letter of Understanding to document and confirm the following agreement on the 2% @
Age
55 PERS Formula:Effective July 2, 2000, the City agrees to pick up the employee s 4% cost to
fimd theenhanced PERS ]o/'G @ 55 retirement benefit. However, if at any time in the fUture, the City
is required to contribute as the Employer to the PERS system for miscellaneous employees, the
City will conduct an actuarial evaluation to determine what portion of that Employer contribution rate is
due to the cost for the 2%
@55 benefit.Ifany portion of the fUture Employer contribution rate for miscellaneous employees is
based on the cost for the 2% @ 55 benefit, all covered employees agree to paythat portion of
the Employer rate,through pre-tax payroll deduction, to cover the cost of the 2% @ 55 benefit at
that time, from a minimum of 0.5% not toexceed

RATIFICATION AND EXECUTION
The
City and the Associations acknowledge that this Letter of Understanding represents
part of the total agreement between the parties, and serves as an amendment
to the existing Memorandum of Understanding for each bargaining group as
indiGated below). The City and the Associations also acknowledge that this Letter of
Unde!rstanding shall not be in full force and effect until adopted by the City Council of the
City of Orange. Subject to the foregoing, this Letter of Understanding is hereby executed
by the authorized representatives of the City and the Association and entered into
this 23rd day of May, 2000.Summary
