A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ORANGE DETERMINING THAT
THERE IS A NEED TO CONTINUE THE
INSTALLATION OF A METHANE GAS
CONTROL SYSTEM AT YORBA PARK IN
RESPONSE TO AN EMERGE~CY
WHEREAS, Chapter 3.08 of the Orange Municipal Code permits the City Council, in
cases ''where an essential governmental operation affecting the public health, safety or general
welfare could be greatly hampered or dismpted by following the standard purchasing procedures
for contracting for public projects", to comply with the provisions of Public Contract Code
Section 22050 and repair or replace a public facility, take any directly related and immediate
action required by the emergency, and procure the necessary equipment, services, and supplies
for those purposes, without giving notice for bids to let contracts; and
WHEREAS, on Febmary 22, 2000, this City Council found and determined that the
instal1ation of a methane gas control system at Y orba Park within the time frame ordered by the
County of Orange Health Care Agency, in its role as the Local Enforcement Agency ("LEA")
under the Integrated Waste Management Act, is essential to the public health, safety or welfare
and that the competitive bidding procedure be waived in accordance with Section 22050 of the
Public Contract Code and a contract awarded to IT Corporation for said work; and
WHEREAS, the City Council also found that the emergency nature of the installation of
the methane gas control system at Y orba Park would not permit a delay resulting from a
competitive solicitation for bids and that the award of the contract to IT Corporation and the
instal1ation of the methane gas control system is necessary to respond to the emergency; and
WHEREAS, this City Council has received and reviewed the report of the Director of
Public Works in the form presented at this meeting and finds that there is a need to continue with
the installation of the methane gas control system at Yorba Park under the contract awarded to IT
Corporation for the reason set forth in said report.
NOW, THEREFORE, it is hereby resolved by the City Council of the City of Orange
that the conditions under which the contract awarded to IT Corporation for the installation of the
meth,me gas control system at Yorba Park have not changed in that the order issued by the LEA
has not been modified or amended and the LEA has not granted the City's request for an
extension beyond the date of March 13,2000.
Accordingly, there is a need to continue the action and said emergency action shall be deemed to
continue to exist until its termination is proclaimed by the City Council of the City of Orange.
