OF ORANGE UPHOLDING THE RECOMMENDATION OF
THE PLANNING COMMISSION APPROVING THE
GENERAL PLAN RECLASSIFICATION OF HElM
AVENUE AS A COMMUTER STREET AND
REDESIGNATING 6.09 ACRES OF PROPERTY LOCATED
EAST OF CANAL STREET AND SOUTH OF HElM
AVENUE, ADJACENT TO THE MALL OF ORANGE,
FROM GENERAL COMMERCIAL TO LOW-
MEDIUM DENSITY RESIDENTIAL, DESIGNATING
RESIDENTIAL USE OF THE PROPERTY AT A DENSITY
RANGE BETWEEN 6 AND 15 DWELLING UNITS PER

Inc.RECITALS:After report thereon by the Planning Commission and after due public
hearing as required by law, the City Council of the City of Orange considered a recommendation
of the Planning Commission recommending by Resolution No. PC 68-99
that the Circulation Element of the General Plan be amended to reclassify Heim Avenue as a
commuter street and that the Land Use Element of the General Plan be amended to redesignate 6.
09 acres of property located east of Canal Street and south of Heim Avenue, adjacent to
the Mall of Orange, from General Commercial ("GC") to Low-
Medium Density Residential ("LMDR")with a density range between 6 and 15
dwelling units per acre.After finding and determining the hereinafter described
facts, the City Council determined that the project could not have a significant effect on
the environment, a Negative Declaration should be adopted, and General Plan Amendment 3-
98 should be approved, as recommended by the Planning Commission. The real property
which is the subject of General Plan Amendment 3-98 is generally depicted
on Exhibit "A", attached hereto and incorporated herein by this reference
and is more particularly described as:A portion of Lot 381 and a portion of Lot 387
of the R. B. Taylor Tract,including one parcel presently owned by Mr. Eddie
Rios, as shown on a map recorded in Book 36, pages 61 and 62,
of Miscellaneous Maps, Records in the office of the
During its public hearing, the City Council found the facts more particularly set forth
as follows:
1. The City's Master Plan of Streets and Highways, a diagram in the City's Circulation
Element of the General Plan, currently classifies Heim Avenue as a secondary arterial
highway.
2. Two reports prepared by traffic engineering consultants have been provided and
considered. Both of these documents conclude that the proposed reclassification of
Heim Avenue as a commuter street is appropriate based on the proposed changes to
land use of the subject property and changed circulation requirements at the adjacent
major shopping mall.
3. The subject property is currently designated for commercial uses but does not appear
to be viable for redevelopment as commercial retail or office use. Redesignation as
Low-Medium Residential would be more compatible with surrounding uses
and would provide an effective transition between major commercial and other
residential
uses.4. In order to reclassify Heim A venue as a commuter street, an amendment to
the Circulation Element of the General Plan is necessary to make the street
designation consistent with the General Plan
designation.5. In order to rezone the subject property from C-TR (Limited Business
District, Tustin Redevelopment Project Area) to R-2-6 (Duplex
Residential District), an amendment to the Land Use Element of the General Plan is necessary
to make the zoning consistent with
the General Plan designation.6. The proposed General Plan Amendment could not have a
significant effect on the environment and a Negative
Declaration should be adopted.NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City
of Orange as follows:1. The foregoing recitals
are true and correct.2. Negative
Declaration 1560-99 is adopted.3. The amendments to the Circulation and Land
Use Elements of the General Plan
are in the public interest.4. The amendments are consistent with the City's
General Plan Land Use Map,any applicable Specific Plan and the City's Master
Plan of Streets and
5. The amendments will permit the orderly development of the subject site
without adversely affecting surrounding land uses.
6. The recommendation of the Planning Commission is upheld and General Plan
Amendment 3-98 reclassifying Heim Avenue as a commuter street and redesignating
the subject property as Low-Density Residential ("LDR") is approved because the
amendment is in the public interest and the proposed classification and designation are
compatible with surrounding
land uses.7. The reclassification of Heim Avenue as a commuter street
and the redesignation of the subject property to Low-Density Residential
shall become effective thirty (30) days from and after the date of adoption
of this Resolution.8. The City Clerk is hereby authorized and directed to (a) make
copies of this Resolution available to the general public within one (1) working day following
the date of adoption, and (b) furnish to any person making a request for a copy of
the adopted documents amending the General Plan within two (2) working days after receipt of
a request therefor accompanied by payment for the reasonable
cost of copying.ADOPTED this 11th day
