RES-9205 General Plan Amendment No. 1-00RESOLUTION NO. 9205 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE UPHOLDING THE RECOMMENDATION OF THE PLANNING COMMISSION AND APPROVING THE GENERAL PLAN RECLASSIFICATION OF PROPERTY GENERALLY LOCATED ON THE SOUTH SIDE OF EAST CULVER AVENUE BETWEEN SHAFFER STREET AND CAMBRIDGE STREET FROM LOW-MEDIUM DENSITY RESIDENTIAL TO LOW- DENSITY RESIDENTIAL.General Plan Amendment No. 1-00 Applicant: City of Orange RECITALS:After report thereon by the Planning Commission and after due public hearing by the Planning Commission on December 20, 1999, as required by law, the City Council of the City of Orange considered a recommendation of the Planning Commission of the City of Orange recommending by Resolution No. PC 79-99 that the property situated on the south side of East Culver Avenue, between Shaffer Street and Cambridge Street, be reclassified in the Land Use Element of the General Plan from the Low-Medium Density Residential LMDR") to the Low-Density Residential (nLDR") designation. After finding and determining the hereinafter described facts, the City Council determined that the project couid not have a significant effect on the environment, a Negative Declaration should be adopted, and that General Plan Amendment 1- 00 should be approved, as recommended by the Planning Commission. The real property which is the subject of General Plan Amendment 1-00 is generally depicted on the map attached hereto as Exhibit "A" and incorporated herein by this reference as though fully set forth herein and shall be referred to hen:in as the "subject property".During its public hearing, the City Council found the facts more particularly set forth as follows:I. In 1993, the City rezoned the subject property from R-I-6 to R-2-6 and amended the Land Use Element of the General Plan from Low-Density Residential to Low-Medium Density Residential.2. The development potential of the subject property under the current zoning designation ofR-2-6 3. The Historic Preservation Element of the General Plan for the City of Orange provides, among its objectives and policies, for the protection of the integrity of the neighborhoods, including their pedestrian scale and historic image. The proposed Low-Density Residential classification for the Land Use Element of the General Plan will provide a balance between the City's interests under its Historic Preservation Element and its obligation to provide adequate housing opportunities.4. In light of the mitigation measures adopted by the City Council at the time of its adoption of the General Plan amendment and zone change in 1993, the Planning Commission has recommended, and the City Council concurs, that the subject property is more properly classified as R-I-6 due in large part to the unusually large lots with numerous historic homes located on the street and the potential of duplex development to destroy the historical significance ofthe area.5. In order to rezone the subject property from R-2-6 to R-I-6, a General Plan Amendment is first necessary to make the zoning consistent with the Low-Density Residential General Plan designation.6. The land uses and zoning surrounding the subject property are as follows: to the northwest -- Duplex Residential, R-2-6; to the northeast -- Single-Family Residential,R-I-6; to the east -- Single-Family Residential, R-I-6; to the south -- Duplex Residential, R-2-6; to the west -- Duplex Residential, R-2- 6.7. The proposed General Plan Amendment could not have a significant effect on the environment and a Negative Declaration should be adopted.NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange as follows:I. That the foregoing recitals are true and correct.2. That Negative Declaration 1614- 99 be adopted.3. That the recommendation of the Planning Commission be upheld and that General Plan Amendment 1-00 redesignating the subject property generally depicted on Exhibit "A" attached hereto as Low- Density Residential ("LDR") be approved because the amendment is in the public interest and the proposed designation is compatible with surrounding land uses.4. The redesignation of the subject property to Low-Density Residential shall become effective thirty (30) days from and after the date of adoption of this Resolution.5. The City Clerk is hereby authorized and directed to (a) make copies of this adoption, and (b) furnish to any person making a request for a copy of the adopted documents amending the General Plan within two (2) working days after receipt of a request therefor accompanied by payment for the reasonable cost of copying.
