A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE APPROVING NEGATIVE
DECLARATION NO. 1679-01 AND PLANS
AND SPECIFICATIONS FOR THE INSTALLATION
OF SOCCER FIELD AND PARKING LOT
LIGHTING AT RANCHO SANTIAGO CANYON
COLLEGE 8045 E. CHAPMAN AVENUE) AND
MAKING CERTAIN FINDINGS WITH RESPECT
THERETO.WHEREAS, the City of Orange (the "City") is a municipal corporation which
exercises governmental functions and powers and is organized and existing under the laws of the State
of California;
and WHEREAS, pursuant to the terms of a joint llse agreement entered into by
and between the City and Rancho Santiago Community College District ("District"), the
City proposes to install (a) ten (10) 70-foot sports field light poles on two soccer fields
on the Rancho Santiago Canyon College campus that would allow evening youth soccer
use; (b)security lighting on the aforementioned ten (10) light poles; and (c)
approximately seventeen 17) 30-foot light poles used to provide security lighting on an existing
parking lot and internal campus road (
the "Project"); and WHEREAS, this City Council proposes to approve the plans
and specifications for the Project and to authorize the competitive solicitation for bids to let a
contract under the terms and provisions of Chapter 3.08 of the Orange
Municipal Code; and WHEREAS, the plans and specifications for the Project specify the
exclusive use of lighting products manufactured by Musco Sports, Inc., which constitutes an
exception to the general requirement of Section 3400 of the California Public
Contract Code that specifications calling for a designated material or product must also include
at least two brands or trade names of comparable quality or utility ar.d followed by the
words "
or equal";and WHEREAS, Section 3400 of the California Public Contract Code
also provides an exception to the general rule permitting the City to designate a material,
product, thing, or service to match others in use on a particular public improvement either completed
or in the course
of completion; and WHEREAS, the City Council finds, and the specifications so
provide, that lighting equipment and products from Musco Sports, Inc. have previously been installed
and used by the City for field lighting on other parks within the City and that, because of
the high quality in controlling spill-over lighting and the technical advances involving the on/
park lighting through the use of a control link system installed by Musco Sports, Inc., such
equipment and products should be designated for inclusion in the Project; and
WHEREAS, the City Council has previously authorized the purchase of equipment
and products from Musco Sports, Inc. for the Project, which the City intends to do once the
competitive solicitation process for their installation has been completed and a contract
awarded; and
WHEREAS, in accordance with the California Environmental Quality Act
California Public Resources Code Section 21000 et seq.: "CEQA"), Negative Declaration
No. 1679-01 was prepared for the Project, noticed, and posted for public review
in accordance with Section 15105 of the Guidelines for Implementation of CEQA (
14 California Code of Regulations Section 15000 et seq.: "State CEQA Guidelines");
and WHEREAS, Negative Declaration No. 1679-01 was presented to this
City Council and this City Council has reviewed and considered the information
contained therein,including the initial study and comments received during the public review process,
and, as the "lead agency" under CEQA, finds and determines that (a) there appears
no substantial evidence that the Project will have a significant effect on the environment or any
potential for adverse effect on "wildlife" resources (as that term is defined in Section 711.2
of the California Fish and Game Code; and (b) the Negative Declaration reflects the City
Council's independent judgment and
analysis; and NOW, THEREFORE, the City Council of the City of Orange resolves, on
the basis of the facts set forth in the agenda report presented to it and any comments
and testimony both oral and written) received at the meeting at which this matter was
considered,
as follows:1. The foregoing recitals are true
and
correct.
2.approved.Accordingly, Negative Declaration No. 1679-01 IS
hereby adopted and 3. The City Council hereby authorizes and directs the City
Clerk to keep Negative Declaration No. 1679-01, including the initial study, any
and all comments received during the public review process, any documents or records relating to
this proceeding, and a record of this proceeding, on file in her offices
as a public record.4. The City Council hereby further authorizes and directs
the City Clerk on behallf of the City Council to complete and sign a "Certificate of Fee
Exemption" (in a form acceptable to the California Department of Fish and Game) and to file
the original and a duplicate copy thereof with the Clerk of Orange County concurrently
with a Notice of Detelmination in accordance with Section 21152 of the
California Public Resources Code.Reso
5. The plans and specifications for the Project are hereby approved and adopted and
the Direcltor of Community and Library Services is hereby authorized on behalf of the City to
commence the competitive solicitation for bids to let a contract under the terms and
provisions of Chapter 3.08 of the Orange Municipal Code.
