December 19, 1994 to the next meeting because they were just received and the Commission needed
time to review them.

IN RE: ITEM TO BE WITHDRAWN
CONDITIONAL USE PERMIT 2094-94 -ORANGE COUNTY SUPERINTENDENT OF
SCHOOLS A proposal to establish an educational facility within an existing commercial office/retail complex in
the C-TR zone (Commercial Tustin Street Redevelopment District), located at 1140-1230
North Tustin Street.NOTE: This project is categorically exempt from environmental review pursuant
to Section 15301 of the State of California Environmental Quality
Act (CEQA) Guidelines.The Orange County Department of Education, following discussionswith the Mayor'
s office, has determined this use is inappropriate for the site and has voluntarily withdrawn their
application. A letter,dated December 22, was sent to the Commission stating their intent to withdraw
their CUP application.Barbara DeNiro, 1118 East Adams, submitted a handout to be entered
into the record.Moved by Commissioner Smith, seconded by Commissioner Pruett, to accept the
withdrawal of the application for Conditional Use Permit 2094-95, submitted by the
Orange

Appeal of Environmental Review Board Decision Modification to Conditional Use Permit 1930-
91 Applicant: Robert A.
Smith Site Location: Northeast comer of East Chapman Avenue and Wavfield
Street A full presentation of the staff report was waived and the public hearing was
opened.A~
oellant Jim Beam, 3745 West Chapman Avenue, referred to the maps on the wall. One displayed the
originally approved plan; the other shows where Cal Trans will take a slice of the property along the off
ramp.They attempted to design the project to conform as close as possible to the original plan with a
lesser amount of land. They believe they have accomplished that and desired a favorable
deasion.The public hearing was
Gosed.Commissioner Walters personally thought the project should still be encouraged. Hedidn't see a
major Change in the original intent or even the basic layout of the project. It was a difficult lot next to a
freeway.The first image people have of Orange is what they see at the intersection of Chapman and the
55 Freeway. He believed the project would be a real step forward as far as appearance and
beautification.Commissioner Cathcart thought the project would be valuable for the community, especially
after experiencing unsuccessful projects on the site. He was still concerned about the exiting of Wayfield,
but the applicant has not changed that. It's a right turn only -- an issue he felt was very important. After
reviewing the plans, he felt they were in substantial conformance with the original conditional use permit.
Chairman Bosch also concurred. The plan lessens the intensity back toward what the Commission
originally approved before the modification, and also gain some circulation improvements with regard to
the discharge from the carwash facility (in addition to decreasing the volume of use). He felt they have
reduced the impacts on the site and from the site to the surrounding streets and community and improved
circulation and safety on the site. He appreciated staff's concern about the major issues that were
discussed as the project came before the Commission previously; and thus their difficulty with clearly
going directly ahead with finding the project in substantial conformance. He finds the major elements are
in substantial conformance; the reductions are straightforward, proportional and correctly placed on the
site. They seem to fall in line with the original findings and affirm them with this project.
Commissioner Smith thought the project would be an asset to the City and a nice addition to the entrance
to the City at that point from the freeway.
Moved by Commissioner Cathcart, seconded by Commissioner Pruett, to uphold the applicant's appeal.

iN RE: PUBLIC COMMENT
Barbara DeNiro, 1118 East Adams, asked how many Planning Commission meetings there were a month
and when they were held?
Chairman Bosch explained the regularly scheduled meetings of the Planning Commission were held twice
a month -- the first and third Mondays, except when a holiday occurs. Then they move to a Wednesday meeting.
Administrative sessions are held at 6:30p.m. in the Weimer Room, followed by the public hearings
in the Council Chamber at 7:00p.m.Ms.
DeNiro spoke with the Police Chief earlier regarding 2165 Glassell Street, called Families First. She wondered
why they were moving and did they ever comply with the fire code regulations? Is that a reason
for them moving at this late date?Chairman
Bosch said they had no information in that regard. That issue would need to be addressed tc the
Fire Prevention Bureau and Building Department to see if there was follow through and completion.Typically
the conditions of approval and the ordinances require sign off by those Departments prior to occupancy
of the building. The Commission's concern is with the land use issue involved.Ms.
DeNiro understood those conditions were never met and she was disturbed. She asked what was proposed
for the Cask N' Cleaver at Tustin and Collins? She asked about the 300 foot notification requirement
ii a project affected an area of the City; were people notified?A
Sports Bar was proposed some time ago at that location -- a combination restaurant, big screen tv type of
operation.State law
requires every property owner within a 300 foot radius of the property lines under consideration be notified
by mail, in addition to public postings and publication in newspapers. Agendas were also shown on
the community bulletin board on cable tv. All notices were also put in the newspaper on a weekly basis.
Ms. DeNiro
wants to be notified of anything that is occurring in her area, regardless of the 300 foot requirement.It
was
suggested she speak with Planning staff during business hours or after the meeting so that her needs could
