NEW HEARINGS 2. CONDITIONAL
USE PERMIT 2295-99 - ACAPULCO RESTAURANTS, INC.A request
to allow the sale of beer, wine and distilled spirits at a new restaurant. The site is located at 1535 West Katella
Avenue.NOTE:This
project is categorically exempt from the provisions of the California Environmental Ouality Act per
State CEQA Guidelines Section 15301.Mr. Jones
reported the proposed restaurant is part of the Century Stadium Promenade that was approved and constructed
in 1996-97. There are several restaurants in and around the site that have ABC Iics,nses.The
applicant is proposing a full service restaurant including a patio and bar, and the project is consistent with
the approved development plan for the area. The applicant is proposing to operate the restaurant between
the hours ot 11 :00 a.m. and 12 midnight, Sunday through Thursday. with hours extending to 1 :
00 a.m. on Friday and Saturday evenings. This center is located in an area that is developed primarily for office
and industrial uses. and is somewhat isolated from residential uses and community facilities. The Police
Department has reviewed the proposal and has approved an Alcoholic Management and Educ:ation Program
submitted by the applicant. and indicated they have no problems with the request.Commissioner
Pruett noted in the staff report condition 3 refers to the closing hours and ties the consumption
of alcoholic beverages to those hours. In the past, there has been language that indicates that
alcoholic consumption will cease one hour prior to closing. And, in the past. a closing time has not been
established for the restaurants.Mr.
Jones acknowledged that condition 3 needs to be revised in order to remain consistent with the other applications
that have been approved.

The public hearing was opened.
Aoolicant. J. L. Jackson. 3750 Lowrv Road. Los Anqeles. represents the Acapulco Restaurant. They
have read the staff report and conditions of approval. He questioned condition 3 because he had not
heard about the cessation of alcoholic beverages one hour prior to closing; otherwise. he would! have
asked for later closing hours.
Commissioner Pruett wanted the applicant to understand that the action the Commission will be taking is
to establish the hour of service of alcoholic beverages, and taking out of the condition the hours of
operation.
Mr. Jones stated the Commission has been concerned as to the starting time. Conditions SpEICify a
starting time, but do not include a closing time. The condition states that alcoholic beverages must cease
one hour prior to closing.
The public hearing was closed.
Vice Chair Smith wanted to make sure condition 3 is revised.
Mr. Jones recommended condition 3 be revised to state: "Sales, service and consumption of alcoholic
beverages shall not commence prior to 11 :00 a.m.. and must cease one hour prior to closing."
It was noted the project is categorically exempt from CEQA review.
MOTION
Moved by Commissioner Pruett. seconded by Commissioner Carlton, to approve Conditional Use Permit
2295-99, with conditions 1 through 8. revising condition 3 per staff's recommendation, finding that
the conditional use permit is granted upon sound principles of land use and in response to services
required by the community. It will not cause deterioration of bordering land uses or create special problems for
the area in which it is located. It has been considered in relationship to its effect on the community
and neighborhood plan for the area. And. it is subject to those conditions necessary to preserve the
general welfare and not the individual welt are of the
applicant.

MISCELLANEOUS 3. DESIGN REVIEW BOARD APPEAL NO. 4-99 (RE: DRB NO. 3444) - AL & ED'S
AUTOSOUND The applicant is appealing the Design Review Board's denial of a proposal to replace wall signs on
an existing retail business. The site is located at 1171 North Tustin
Street.Mr. Jones reported that staff has received two letters requesting a continuance of this item. The first
letter requested a continuance to August 2; however, there is a scheduling conflict with the property
owner.The second letter requests a continuance to August 16,
1999.
MOTION Moved by Commissioner Carlton. seconded by Commissioner Pruett, to continue Design Review
Board Appeal No. 4-99 (RE: DRB No. 3444) - AI & Ed's Autosound to the meeting of August 16.

Moved by Commissioner Romero, seconded by Commissioner Carlton, to adjourn to a joint study se,ssion
with City Council on Tuesday. July 20. 1999 at 5:00 p.m. in the Weimer Room to discuss the centerline
project and the Master Plan 01 Parks. The meeting adjourned at 7:20 p.m.
