PRESENT: Commissioners Alvarez, Bosch, Cathcart, Murphy, Smith ABSENT: None STAFF PRESENT: John Godlewski, Administrator of Current Planning; Bob Herrick, Assistant City Attorney; Gary Johnson, City Engineer; and Sue Devlin, Recording Secretary PLEDGE OF ALLEGIANCE IN RE: MINUTES OF NOVEMBER 16, 1992 Moved by Commissioner Bosch, seconded by Commissioner Alvarez, to approve the Minutes of November 16, 1992, as recorded. AYES: Commissioners Alvarez, NOES: None ABSTAINED: Commissioner Smith Bosch, Cathcart, Murphy MOTION CARRIED IN RE: NEW HEARING TENTATIVE TRACT MAP 14756, CONDITIONAL USE PERMIT 1984-92 - JOHN AND GRACE AOU A request to allow an 8-unit condominium development located in the R-2-6 (Residential Duplex - Minimum Lot Size 6,000 square feet) district. Subject property is located on the northeast corner of McPherson and Pearl Streets. NOTE: In conformance with the provisions of the California Environmental Quality Act (CEQA), Negative Declaration 1415-92 has been prepared for this project. 1 Planning Commission Minutes December 7, 1992 There was no opposition; therefore, the full reading of the staff report was waived and the public hearing was opened. Applicant Cal Garo, 525 Hamilton Drive, Corona, is the designer of the project and represented the applicants. The project consists of four duplexes on the corner of Pearl and McPherson, which comprises a total of 8 units. He has read the staff report and accepts the conditions of approval. Chairman Cathcart concurred with the Design Review Board's recommendation that the plant material be changed. He also commented about the layout of the buildings and asked if there was some kind of constraint of the site? He noted a consistent line of buildings rather than some sort of movement. Mr. Garo responded in order to allow the maximum square footage of the eight units and to make it work on paper -- to make it a feasible project -- he tried to stagger the units, but because of the tight constraints in the setbacks, it only allowed 1600 square feet per unit. He tried different configurations, but this one was the best in terms of yard space, privacy, and accessibility. The public hearing was closed. Moved by Commissioner Bosch, seconded by Commissioner Murphy, to find that Negative Declaration 1415-92 has been prepared in conformance with requirements of CEQA and that the project will not have a significant impact on the environment or wildlife resources. AYES: Commissioners Alvarez, Bosch, Cathcart, Murphy, Smith NOES: None MOTION CARRIED Moved by Commissioner Bosch, seconded by Commissioner Murphy, to recommend to the City Council to approve Tentative Tract Map 14756 and Conditional Use Permit 1984-92, with the conditions as listed in the staff report. AYES: Commissioners Alvarez, Bosch, Cathcart, Murphy, Smith NOES: None MOTION CARRIED 2 Planning Commission Minutes December 7, 1992 Commissioner Bosch was also concerned about the block-like layout of the site. Fortunately, the project has helped a little bit on the driveway side by the setback of the second floor. He believed the patio fences as they relate to the public streets will help in that regard as well. Zoning and shape of site doesn't necessarily correlate in all cases to the most innovative solution a designer might wish to undertake, but he appreciated that the designer had articulated the buildings very nicely with regard to the block-like masses. He thought the project would be an asset to the neighborhood. IN RE: NEW HEARING ZONE CHANGE 1156, GENERAL PLAN AMENDMENT 4-92 -DR.'S JUAN AND DORIS ARAUJO A request for a zone change from R-1-10 to R-1-40; and an amendment to the General Plan Land Use Map from LDR (2-6 dwelling units per acre) to ESTR (0-2 dwelling units per acre). The proposal is intended to reconcile an approved residential subdivision with the Orange Park Acres Plan. No further subdivision of property is proposed. Subject property is five residential parcels in Tract 14293 located on the south side of Lewis Drive along Kimbark Lane, a private street. NOTE: In conformance with the provisions of the California Environmental Quality Act (CEQA), Negative Declaration 1419-92 has been prepared for this project. Mr. Godlewski reported the Planning Commission and City Council previously approved a Tentative Tract Map; this is a bookkeeping item for staff. The lots are over an acre in size and at that time the zoning should have been changed as well. A staff report was not presented as there was no opposition. The public hearing was opened. Those speaking in favor Sylvia Lary of Anaheim Hills, requested the zone change because she is the realtor. Whenever the property is marketed, there is some conflict. 3 Planning Commission Minutes December 7, 1992 She would appreciate if it could be consistent with the Orange Park Acres Plan. The public hearing was closed. Moved by Commissioner Bosch, seconded by Commissioner Murphy, to find that Negative Declaration 1419-92, including the initial study, is in conformance with the provisions of CEQA, and the project will not have a significant adverse impact on the environment or wildlife resources. AYES: Commissioners Alvarez, Bosch, Cathcart, Murphy, Smith NOES: None MOTION CARRIED Moved by Commissioner Bosch, seconded by Commissioner Smith, to recommend to the City Council to approve Zone Change 1156 and General Plan Amendment 4-92. AYES: Commissioners Alvarez, Bosch, Cathcart, Murphy, Smith NOES: None MOTION CARRIED IN RE: MISCELLANEOUS 1. Adjourn to an adjourned regular meeting/study session December 14 at 5:00 p. m. in Conference Room "C" to review a Draft Revised Housing Element and Commission comments on the Recreational Trails Master Plan. Mr. Godlewski relayed that Jere Murphy, Advanced Planning Manager, asked if the Commission had questions or comments relating to this, to forward them to staff prior to the meeting. 2. Review of text regarding Ordinance Amendment 6-92 (Leafblowers) to be forwarded to City Council. Commissioner Alvarez didn't recall seconding the motion. Commissioner Murphy seconded the motion, as noted in the Minutes. Commissioner Alvarez was the "no" vote on Page 3. He asked that the letter dated December 3, 1992, written by Ms. Judy Patton, be made part of the official record. Mr. Godlewski said staff would 4 Planning Commission Minutes December 7, 1992 forward the letter on to the City Council. Commissioner Murphy noted for the record all Commissioners received that letter. He also said there was one other correction under 8.26.030 - Use Limitations -- the hours specified as part of the motion were 8:00 a.m. to 7:00 p.m., Monday through Saturday; and 9:00 a.m. to 5:00 p.m. on Sunday and Federal holidays. The Commission directed staff to forward Ordinance Amendment 6-92 to the City Council. IN RE: PUBLIC INPUT Alice Clark, 205 North Pine, asked what happened to the item before the leaf blowers? Mr. Godlewski explained staff was requesting the Commission adjourn to a study session next Monday, December 14, at 5:00 p. m. in Conference Room "C". Lisa Blanc, 368 South Orange, presented the Planning Commission with 93 Old Towne calendars on behalf of the Board of Directors of the Old Towne Preservation Association; and also wished the Commission happy holidays. Judy Patton, 170 City Blvd. West, #215, wrote the December 3 letter to the Commission regarding leaf blowers. She felt it was important to make her feelings known and hopefully the Commission would reconsider adding an Ordinance that is basically unenforceable. Chairman Cathcart explained the item has been forwarded to the City Council. She would be better served to attend the City Council meeting and make her presentation at that time. IN RE: ADJOURNMENT Moved by Commissioner Murphy, seconded by Commissioner Bosch, to cancel the January 4, 1993 Planning Commission Meeting, and continue the one item (staff report of a 6-month review process regarding Conditional Use Permit 1975) to January 18, 1993.
