A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ORANGE ESTABLISHING
OUTDOOR DINING PERMIT CHARGES FOR
THE IMPLEMENTATION OF CHAPTER 12.18 OF
THE ORANGE MUNICIPAL CODE AND
AMENDING THE CITY'S MASTER SCHEDULE
OF FEES AND CHARGES.
WHEREAS, the City Council has adopted an ordinance establishing a permit process
and standards for outdoor dining in the public right-of-way within the historic
downtown; and WHEREAS, the City is undertaking a Plaza Preservation Project with the
intent of providing a clean and attractive historic downtown business environment that attracts
and retains patrons, thus enhancing the social and economic vitality of the historic downtown area
and City as a
whole; and WHEREAS, the City is entitled to compensation from private enterprises
within the historic downtown that provide seating and sell food and beverages for consumption
in the public right-of-way, thus receiving economic benefit from the use
of public space; and WHEREAS, the serving and consumption of food at tables
in the public right-of-way produces food and beverage spills, which generate a need
for frequent
cleaning of the affected area; and WHEREAS, the aforementioned ordinance calls for
the City Council to adopt by
resolution Outdoor Dining Permit charges; and WHEREAS, the aforementioned Outdoor Dining
Permit charges are intended to recover the actual cost to the City of cleaning the sidewalks an additional
twenty (20) times each year in portions of the historic downtown that experience outdoor
dining in the public right-of-way; and NOW, THEREFORE, BE IT RESOLVED by
the City
Council of the City of Orange as follows:Section
1.The foregoing recitals are true and correct.Section 2. That the Outdoor Dining Permit
fee to be paid in conjunction with the issuance of an Outdoor Dining Permit shall be
applied to the outdoor dining area, from the business storefront to the face of curb, in an
annual amount of $0,80 per square foot.Section 3. The fee for Outdoor Dining
Permits shall be added to the Master Fee Schedule and adjusted annually to
Section 4. Be it further resolved that this Resolution shall become operative upon the
effective date of Ordinance 8-
