Assistant City Engineer, and Sue Devlin, Recording Secretary IN RE: CONSENT CALENDAR The Minutes were removed from the Consent Calendar for discussion.1. APPROVAL OF MINUTES FOR THE MEETING OF 7/15/96 Moved by Commissioner Pruett, seconded by Commissioner Romero. to approve the Minutes of 7/ 15/96 with one correction to Page 1 - Joan WolII was present in lieu of Vern Jones; and one correction on Page 2, first paragraph, third line: add the word "use" alter sound land (sound land use principles).AYES:NOES: ABSTAINED: Commissioners Bosch. Carlton, Pruett, Romero None Commissioner Smith MOTION CARRIED IN RE: CONTINUED HEARING 2. VARIANCE 2019-96 - HARRY SAUBERMAN The applicant is requesting waiver of the City's parking requirements to allow the expansion of the Carnitas Los Reyes Restaurant, which is located at 251.273 South Tustin Street.NOTE:This project is categorically exempt from the provisions of the California Environmental Quality Act ( CEQA) per State CEQA Guidelines Section 15303.The applicant was not present for the hearing. Mr. Sauberman talked with Mr. Carnes and indicated he would not be attending the hearing as he was going on vacation, and he did not request a continuance or to withdraw the item.Mr. Carnes said it was his impression Mr. Sauberman wanted a decision by the Commission at this hearing.The public hearing was opened and then closed. There were no public comments.Chairman Bosch understood the Commission had "freedom of action", which may be to make a decision with regard to the application, or if they felt they had insullicient information, to set a date for a continued public hearing. Commissioner Pruett recommended to continue the item because he felt he could not take action without dialogue with the applicant. He preferred to continue rather than deny the application.Chairman Bosch shared that viewpoint. He wanted to be absolutely fair with the applicant in every regard. Carlton, Pruell, Romero, Smith None MOTION CARRIED Staff was asked to write a leller to the applicant, informing him of the Planning Commission's action.IN RE:NEW HEARING CONDITIONAL USE PERMIT 2154-96 - THE PLANNING CENTER FOR PACIFIC BELL MOBILE SERVICES The applicant is proposing installation of a 60' high monopole in the rear parking lot of the Orange County Medical Association property. Wireless communication antennas will be placed at the top of the pole. The property is located at 300 South Flower Street.This project is categorically exempt from the provisions of the Califomia Environmental Quality Act per State CEQA Guidelines Section 15303.There was no opposition; therefore, the full reading of the staff report was waived. NOTE:Mr. Jones explained the staff report oullined two options of locating the equipment necessary to support the monopole in one of the planter areas. He used the exhibit on the board to describe the options and the proposed planter modification.The public hearing was opened. Aoolicant Todd Chambers, The Planning Center, representing Pacific Bell Mobile Services, 1300 Dove Street,Suite 100, Newport Beach, explained their application was for a wireless communication facility to be located in the rear parking area of the Orange County Medical Association building. One the messages the Commission asked him to take back to Pacific Bell was to try and come up with beller designs for the antenna facilities. This project was originally designed to be a stand alone monopole. similar to what is existing on two adjacent parcels to the north and south of this location. Subsequently, they have gone back and redesigned it to co-locate with one of the light standards in the existing parking lot. In reference to the base transceiver stations (or the equipment for the antennas), they had originally looked at a planter adjacent to the monopole. The staff report indicates staff would like to see that planter oversized due to the fact there is a parking space adjacent to it that is also oversized. In discussing this with the representative of the property owner, they had indicated they would like to see them move to another planter that is similar in layout and also has an oversized parking space next to it that would utilize the expansion of the planter. It would add an extra foot. One of the justifications for that was that the Orange County Medical Association has another tenant. The Turnip Rose, and they do a lot of outdoor functions. They would like to see more continuity as it relates to the trash enclosures by offselling it at the other end with Pacific Bell's equipment. They would provide landscape screening to screen it from public view, rather than have it just sit out in the parking lot. It would also be more efficient in running their cables from the equipment to the antenna pole through the parking lot without having to tear up more of the existing asphalt. The project is in compliance with the zoning amendment currently going through the Cily Council in regards to wireless communications.Commissioner Carlton asked how long it took to install the equipment and pole?Mr. Chambers responded it depends on the facility and in this instance, they need about 10 working days.The public hearing was closed. Planning Commission Minutes August 5. 1996 Commissioner Pruett appreciated The Planning Center working with Pacific Bell in terms of trying to come up with something that would fit into the landscaping. He did not have a problem with the project, with the alternative site to the south. It was noted the project was categorically exempt from the provisions of CEQA. Moved by Commissioner Pruett, seconded by Commissioner Romero, to approve Conditional Use Permit 2154-96, with conditions 1-4, and also addin~ 4 new conditions of approval proposed by the City conditions 5-8), with the concurrence of the applicant, and revising the site plan to locate the BTS installation at the west end of the aisle with a row south of that shown in the application, finding that the CUP is granted upon sound principles of land use and in response to services required by the community. It will not cause deterioration of bordering land uses or create special problems for the area in which it is located. When considered in relationship to its effect on the community or neighborhood plan, it' s compatible.AYES:NOES:Commissioners Bosch, Carlton, Pruett, Romero, Smith None MOTION CARRIED IN RE:ORAL PRESENTATIONS Bob Bennyhoff, 10642 Morada Drive, Orange Park Acres, asked if the City had any regulations or requirements for the cabinets associated with the fiber optic cables? In Orange Park Acres there are some overhead and underground telephone lines. Time Warner was going to install a 6 ft. x 4 ft. cabinet in the middle of a horse trail, but after some discussion, they are redesigning it.Mr. VonSchimmelmann responded at this time there were no standards for the enclosures of this equipment. Some of it is above ground; some under ground. Staff would entertain anything the Commission would like to put forth.The Commission concurred it would be valuable to ask staff to look into the matter of PUC regulations and limitations, potential liability and the technology of the system.
