Moved by Commissioner Bosch, seconded by Commissioner Murphy, to
approve the Minutes of February 10, 1992 as corrected: Page 15, #13,
delete the word "issues" and insert "all parties"; and #14, should read
That the acquisition of retail/commercial strip centers on Main Street
be encouraged to assist relocating within the immediate vicinity of
existing businesses through redevelopment of totally impacted parcels."

March 16, 1992
TENTATNE TRACT MAP 14577, CONDITIONAL USE PERMIT 1952-92,
NEGATIVE DECLARATION 1401-92 -THOMAS A. WILLIAMS
A request for a tentative tract map for condominium purposes and to
consolidate two parcels of land. The development project consists of 9
dwelling units in the R-3 (multi-family residential) zone. Subject
property is located on the north side of Lincoln Avenue, approximately
970 feet east of Glassell Street, and 400 feet west of Cottonwood Street,
addressed 341 East Lincoln Avenue.
NOTE: In compliance with the California Environmental Quality Act,
Negative Declaration 1401-91 has been prepared for this
project.
This item was continued from the March 2, 1992 meeting and the public
hearing was closed at that meeting.
Commissioner Scott stated the Commission had some concerns at the last
public hearing; and in reading the staff report, it was his opinion the
conditions have now been addressed.
Commissioner Bosch said it was interesting the application was before
the Commission solely because a condominium project was requested.
Apartments could be built by right on the property in conformance with
the development standards of the City. The Commission had an
opportunity, given the very difficult and tight site, to find an
improvement in the site planning over what would have occurred if
merely the permitting process would have been followed. He still had
some concerns about a few of the aspects, but felt the applicant had
done a remarkable job in turning the project around from where they
started. He appreciated the applicant's cooperation in this effort.
Moved by Commissioner Scott, seconded by Commissioner Bosch to
recommend to the City Council to approve Tentative Tract Map 14577,
Conditional Use Permit 1952-92, Administrative Adjustment 92-5 and
Negative Declaration 1401-92, with the new conditions 1-24.

CONDITIONAL USE PERMIT 1948-91, NEGATIVE DECLARATION 1402-91
CHOC REALTY AND CHILDREN'S HOSPITAL OF ORANGE COUNTY
A request to allow the expansion of CHOC Hospital including building
additions to the newly constructed hospital buildings, and existing office
building at the northeast corner of Main Street and LaVeta Avenue, and
the construction and operation of a temporary parking lot on the east
side of Main Street, south of LaVeta Avenue. Subject property is
located upon two sites: 1) the northeast corner of LaVeta and Main
Street, and 2) the east side of Main Street 230 feet south of La Veta
Avenue.
NOTE: In compliance with the California Environmental Quality Act,
Negative Declaration 1402-91 has been prepared for this
project.
This item was continued from the March 2, 1992 meeting.)
A staff report was not presented and the public hearing was opened.
Annlicant
Brian Mottishaw, V.P., General Services, Children's Hospital of Orange
County, 455 South Main Street, said they had just completed their first
phase of construction. They have been before the Commission and City
Council regarding the second phase of development (building a
basement and first floor). They are needing additional space for
showers and dressing areas for the mothers who stay at the hospital
with their children. They are also needing amulti-purpose room for the
doctors to meet and they propose to build this room in the old
Telephone Building. He realizes there is a parking problem and they
propose to use the newly acquired property of the Chez Cary as a
parking lot.
Commissioner Scott referred to one of the conditions regarding free
parking. How will that be monitored?
Mr. Mottishaw said there would be a card issued to employees to access
the parking lot.

Alice Clark, 205 North Pine, questioned if the project were in the street
widening area?
Mr. Johnson responded the proposed building is at the northeast corner
of Main and northwest corner of Pepper, which is proposed for
widening.
The public hearing was closed.
Moved by Commissioner Bosch, seconded by Commissioner Scott, to
accept the findings of the Environmental Review Board in that there is
no substantial evidence that the project will have a significant effect on
the environment and approve Negative Declaration 1402-91.

recommend to the City Council to approve Conditional Use Permit 1948-

IN RE: NEW HEARING
CONDITONAL USE PERMIT 1954-92, VARIANCE 1924-92,
ADMINISTRATNE ADJUSTMENT 92-1 - DR. ROBERT RUPER
A request for a conditional use permit to allow the expansion of a
medical office building to include a surgical facility. Also requested are
a variance to allow adead-end parking aisle, and an administrative
adjustment permit to allow a 10% reduction in drive-aisle widths.
Subject property is located on the west side of Glassell Street, between
Culver Avenue and LaVeta Avenue, addressed 406-454 South Glassell
Street.

Applicant
Dr. Robert Ruper, 436 South Glassell, talked about the cost of medical
care becoming a problem for everyone. Outpatient surgery should
decrease the cost of medical care, but it really hasn't. He explained the
charges involved for outpatient surgery at the hospital. His surgical
facility will charge one-half the rate of the hospitals and will be more
affordable to his patients. An alternative solution can be offered
through his facility while hospital costs continue to soar. He wants to
add an additional building onto his existing building. It has to be
separate in order to be a surgical center. His problem is with the
parking lot. Entrance is from the side. In order to change that so a
patient can find the front of the building from the parking lot, would be
to cut back on the existing office building and try to make a walkway to
the front. The configuration of buildings is not ideal, but he has seen a
lot worse. He's trying to keep the two old Victorian houses because of
their historical significance. Regarding the driveways, the cost of
moving that power pole is almost prohibitive -- it's over $50,000.
The Commission appreciated Dr. Ruper's presentation regarding the
accelerated cost of health insurance. It's refreshing to hear a different
viewpoint. They also appreciated the work that has been done to
continue the context of the neighborhood, while improving the health
care delivery to the residents of Orange.
Public Input
Alice Clark, 205 North Pine, spoke in favor of the project, stating it was
a good, thoughtful project developed with the help of the Preservation
Planner.

Moved by Commissioner Bosch, seconded by Commissioner Master, that
the Commission finds that there is no substantial evidence that the
project will have a significant effect on the environment and accept the
findings of the Environmental Review Board to file Negative Declaration
1403-92.

Moved by Commissioner Bosch, seconded by Commissioner Master, to
approve Conditional Use Permit 1954-92, Variance 1924-92 and
Administrative Adjustment 92-1 with conditions 1-23, excluding
condition 13 (requiring elimination of the split driveway); also, find that
the variance does not constitute a grant of special privilege inconsistent
with the limitations upon other properties in the vicinity and zone in
which the subject property is situated, and should be approved because
of special circumstances applicable to subject property, its location and
surroundings, due to the need to preserve the historic resources to the
City of Orange on a limited parcel of land.

Moved by Commissioner Scott, seconded by Commissioner Master, to
adjourn to March 23, 1992 at 5:30 p.m. for a study session on the
proposed down zoning of Old Towne. The study session will be held in
Conference Room "C" .

Commissioner Murphy stated there was a request for a study session on
April 13, 1992 to review a proposal concerning Sycamore Crossing and
some questions were raised.
Moved by Commissioner Murphy, seconded by Commissioner Master, to
adjourn to April 13, 1992 at 5:30 p.m. in the Weimer Room to discuss
Sycamore Crossing with the condition that all material is received by
Thursday, Apri19, 1992; otherwise, the study session will be cancelled.
