AYES: Commissioners Bosch, Cathcart, Master, Murphy, Scott NOES: None MOTION CARRIED IN RE: CONTINUED HEARING CONDITIONAL USE PERMIT 1939-91 - HANSHAW A request for a conditional use permit to allow for the construction and operation of an automatic car wash facility in the C-1 (Limited Business) District. Subject property is located at the southwest corner of Katella Avenue and Main Street. NOTE: Negative Declaration 1395-91 has been prepared to evaluate the environmental impacts of this project. This item was continued from the December 2, 1991 and January 6, 1992 meetings.) There was no opposition; therefore, the full reading of the staff report was waived and the public hearing was opened. Planning Commission Minutes Applicant February 3, 1992 Grady Hanshaw, 9711 Crestview Circle, Villa Park, submitted a letter on Friday, which the Commission received at the meeting. They attempted to resolve and iron out a minor issue with staff except for one item. His architect was also present to explain/answer questions. Commissioner Murphy noticed the January 31 letter indicated there would be plans to remain open past the car wash hours for service with gas and the mini-mart. What are those hours? Mr. Hanshaw expected to remain open whatever hours are reasonable. They don't anticipate a 24-hour operation because the traffic dies down later in the evening. They would like to experiment and see how long they can operate and stay open. Chairman Cathcart asked where the exhibit came from? Mr. Hanshaw responded the exhibit was part of their presentation. It showed the flow of the intersection and how their site relates to the corner. Chairman Cathcart said in the staff report it discusses there are 16 parking spaces on site for employees and customers. In the letter it was stated the applicant may have the opportunity to hire 25-30 employees. Where will those people park? Mr. Hanshaw said many of the employees car pool or use public transportation. There is a bus stop in front of the site. Commissioner Bosch said a key element for this project was understanding how the access easement works for the adjoining properties. He wanted the applicant to describe in some detail arrangements with the adjoining properties, what type of traffic flows through there, and how they anticipated keeping that easement open during business hours. Mr. Hanshaw believed the properties are owned by the same individual. In observing the traffic along that easement, it's very limited in nature, very light. They are now using that site for parking of used trucks and it is their hope to eliminate that. They don't expect a problem at all because it's limited to normal access. 2 Planning Commission Minutes February 3, 1992 Commissioner Master asked for the applicant's conception of how the driveway to the east is going to used and when? Mr. Hanshaw said they initially proposed that driveway being much closer to the intersection. Through two months of negotiations with staff the driveway has been pushed to the western portion of the property in order to mitigate any possibility of conflicts to that intersection. They would like to see egress from that driveway during the operation of the car wash hours. Once the car wash is closed and remain open for gas service, they would like to convert that to a normal driveway, asking for ingress and egress. Commissioner Master asked how they expected to control the driveway for those different hours of operation? Mr. Hanshaw responded they would implement that plan through use of signage, directing car wash traffic during the daytime hours to the northerly most Main Street entrance or drive approach. Once closed, they would turn the sign off and leave it as a normal driveway. He believed he could control his own environment; they would do an adequate job of policing that during the car wash hours. The public hearing was closed. Commissioner Scott noted three drying areas on the exhibit for a total of 25, which would block the proposed driveway off of Katella Avenue. There would be no ingress/egress off of Katella because of the drying area. There is conflicting movement there. Twenty-two drying spaces would be limited for a successful operation if three spaces were eliminated. Commissioner Bosch also spoke to the drying spaces issue; it's a very limited utility for the car wash. The majority of traffic will be crossing over at the northerly most driveway on Main Street; there's no avoiding it. He was concerned about the conflicts they represent. It appears the only way to avoid it is to limit car washes to one corner or two opposite corners of an intersection. They don't seem to work on the northeast or southwest in that regard. The big concern is the traffic onto Katella. Commissioner Murphy said you would see repeat business out of a car wash/mini market. Given that fact, if one is use to using the two 3 Planning Commission Minutes February 3, 1992 driveways on Main Street, they will also use them during the off hours. He was concerned about the ingress/egress on Katella. Commissioner Bosch said the plan and the exterior elevations of the building appear to show openings along the west property line from the car wash tunnel. If this is approved, the Fire Department might be concerned about the equipment in the car wash tunnel and the openings onto the adjacent property in terms of building separations, as well as concern for that neighboring property of the noise that could come from the car wash tunnel. He recommended if the project were approved, to add a condition which would require the west wall of the car wash to be without openings (Condition 2 8) . Moved by Commissioner Bosch, seconded by Commissioner Master, to accept the findings of the Environmental Review Board to file Negative Declaration 1395-91, including the initial study and any comments received during the public review process, in that the E.R.B. finds that with the implementation of recommended mitigation measures, the project will not have a significant impact on the environment or wildlife resources and it was prepared in conformance with C.E.Q,A. AYES: Commissioners Bosch, Cathcart, Master, Murphy, Scott NOES: None MOTION CARRIED Commissioner Bosch was concerned about the use and overall land use. This is a type of use with the approval of the car wash it can be appreciated in this zone. He would have hoped for a better and higher use in terms of the potential return, employment and commercial use, but it is within the rights of the property owner and zoning to make the petition for a car wash. Moved by Commissioner Bosch, seconded by Commissioner Murphy to approve Conditional Use Permit 1939-91 deleting conditions 23, 24 and 25, but add a condition to deny the right to access to Katella Avenue from the site (no driveway) because of a policing problem; and add condition 28, indicating there would be no openings in the west wall of the car wash tunnel adjacent to the property line. AYES: Commissioners Bosch, Cathcart, Master, Murphy, Scott NOES: None MOTION CARRIED 4 Planning Commission Minutes February 3, 1992 The Commission discussed conditions 24 and 25 and the issues of ingress/egress traffic prior to voting on the motion. Ms. Wolff explained the appeal process to the applicant. IN RE: NEW HEARING PRE-ZONE CHANGE 1148-92 -KEITH W. NAYLOR A request for a zone change of a County unincorporated property from County zoning of E4-1 (Single Family Residential, Small Estates -one acre minimum lot size), to City zoning of R-1-40 (Residential, Single Family District -one acre minimum lot size). Subject property is located on the south side of Meads Avenue between Orange Park Boulevard and the Ridgeline Golf Course, addressed 10706 Meads Avenue. NOTE: This project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) per Section 15319 of the State CEQA Guidelines. A staff report was not presented and the public hearing was opened. Applicant Keith Naylor, 10706 Meads Avenue, would like to come into the City and has a hearing with LAFCO on Wednesday. There was a necessity to have the same City zoning as the County zoning. Those speaking in favor Bob Bennyhoff, 10642 Morada Drive, Orange Park Acres, said Mr. Nayor has been very cooperative with the community. He had no problems with this application. The public hearing was closed. 5 Planning Commission Minutes February 3, 1992 Moved by Commissioner Murphy, seconded by Commissioner Bosch to recommend to the City Council to approve Pre-Zone Change 1148-92, noting the project is exempt from environmental review.
