Planning Commission January 18, 1993

Minutes of December 21, 1992, as recorded.

IN RE: CONTINUED HEARING
90-DAY REVIEW OF CONDITIONAL USE PERMIT 1975-92 - KHAJENDURI
To review effect of extended hours granted for live entertainment and dancing in an
existing restaurant located in the CT-R zone. Subject property is addressed 1722 North
Tustin Street.
NOTE: This project is exempt per California Environmental Quality Act
CEQA) Guidelines Section 15301.
The City Attorney's office has reviewed the hold harmless agreement and liability
insurance. They are pending verification of recordation at the County Recorder's Office.
There was no opposition; therefore, the full reading of the staff report was waived. The
public hearing was opened.
Mr. Herrick reported the applicant verified the documents had been recorded.
The public hearing was closed.
Moved by Commissioner Bosch, seconded by Commissioner Murphy to find that the
conditions for review have been fulfilled regarding Conditional Use Permit 1975-92 in
that the project is being operated in conformance with those conditions of approval.

IN RE: NEW HEARING
CONDITIONAL USE PERMIT 2002-93 -MARY'S KITCHEN
A request for the installation of a temporary (six months) food service facility to serve
the homeless, and other needy persons. Subject property is a vacant portion at the
southeast corner of the City Corporate Yard, near the east end of Struck Avenue,
addressed 529 West Struck Avenue.
NOTE: This project is exempt per California Environmental Quality Act
CEQA) Guidelines Section 15303.
A staff report was not presented as there was no opposition. The public hearing was
opened.
Applicant
Scott Mather, Resource and Program Development Director for the local council of the
Society of St. Vincent de Pau1,180 South Cypress, represented the community and
Mary McAnena. He presented their idea of opening a trailer at the Corp Yard for a one
year period to serve meals between the hours of 10:00 a.m. and 3:00 p.m., seven days
a week.
Chairman Cathcart noted Condition 1 limited the temporary use of the property to a six
month period.
Mr. Mather had spoken to the Planning staff last week and they agreed to a 12 month
time period; he thought it had been changed in the staff report.
Those speaking in favor
Lorna Deshane, 205 River, is a member of the original committee appointed by the
Mayor. They have worked hard to provide this facility and feel their goal has been met.
She explained this project to many of her neighbors and as a result, presented a petition
of 40 signatures in favor of this facility.
Reverend Carl Lutz, 533 North Glenrose, reported many of the local churches were in
favor of this project. He would like to see a regular feeding program for the less
fortunate.
Pat Olsen, 161 South Orange, Coordinator for Outreach Ministries, fully supported the
short-term and long-range plans of feeding the homeless and other needy persons.
Ron Pughe, 740 Vista Del Gaviota, felt this program was long overdue. People should
show compassion for the homeless.
Commissioner Murphy expressed concern about the railroad tracks and wondered if
Santa Fe or Amtrak had been notified? Mr. Mather will notify them tomorrow. He
assured the Commission this was a temporary site until they could find a permanent
home for Mary's Kitchen.

Commissioner Smith referred to Item 8 in that the process of review has been
suspended at the applicant's request. Mr. Mather stated that was correct. They do not
wish to withdraw their application; they would like to keep that option open at this time.
The public hearing was closed.
Commissioner Bosch noted the project was exempt from CEQA guidelines.
Moved by Commissioner Bosch, seconded by Commissioner Smith, to approve
Conditional Use Permit 2002-93 with conditions 1-5, modifying condition 5 to allow a
one year extension.

Chairman Cathcart was concerned about this social issue; however, land use was also
a concern. He felt a six month time frame was adequate, with the opportunity for review
of the project at that time.
Commissioner Smith agreed with the 12 month time period because of the expense
involved in setting up this project. She was delighted to see the public and private
sectors join together to work on this problem and commended the community for their
hard work.

Public review schedule
Mr. Godlewski distributed the document to the Commissioners for their review and
comments. Chairman Cathcart explained the document would be available for the
public's review in the City Clerk's Office and public Library; and could be purchased
for $10.00 in Planning. At the February 1 meeting, the Commission will set a public
hearing and make comments on the Zoning Ordinance.
2. ELECTION OF CHAIRMAN AND VICE-CHAIRMAN FOR 1993
Moved by Commissioner Bosch, seconded by Commissioner Cathcart, to elect Mark
Murphy as Planning Commission Chairman.
AYES: Commissioners Bosch, Cathcart, Smith
NOES: None
ABSTAINED:Commissioner Murphy MOTION CARRIED
Moved by Commissioner Cathcart, seconded by Commissioner Murphy, to elect
Randy Bosch as Planning Commission Vice-Chairman.

NOES: None MOTION CARRIED
The Commissioners thanked Bill Cathcart for chairing the Commission in 1992.

next regularly scheduled meeting February 1, 1993 and the meeting was adjourned at
