Moved by Commissioner Scott, seconded by Commissioner Bosch,
that the Minutes of December 27, 1989 be approved as
recorded, and that the Minutes of January 3, 1990 be
approved as corrected: Page 2, last paragraph, 2nd sentence
to read: "One of the problems is trying to get a plan."
Page 7, last paragraph, 1st and 3rd sentences - change James
to William. Page 10, 3rd paragraph, 2nd sentence to read:
They agreed that the last condition could include some
form...."

IN RE: NEW HEARINGS
TENTATIVE TRACT MAP 13661 AND CONDITIONAL USE PERMIT
1701-88 - IRVINE COMPANY:
A proposed revision to conditions of project approval
concerning the water supply system. The 386 unit
condominium development received approval from the Orange
City Council on February 28, 1989. No additional changes to
the basic development plan are proposed. Subject property
is a parcel of land containing 19.6 acres, located within
Santiago Hills southeast of Chapman Avenue and Newport
Boulevard, on Lots 16 and 17 of Tract 12417.

Commissioner Bosch was excused from the meeting due to a
potential conflict of interest.
A staff report was not presented. The public hearing was
opened and then closed as the applicant was not present.
Moved by Commissioner Scott, seconded by Commissioner
Master, that the Planning Commission recommend the City
Council to amend Condition #6 of Planning Commission
Resolution 70-88 and Condition #9 of Planning Commission
Resolution 71-88 as follows: "The water supply system shall
be installed as designed by City of Orange Water Department
and each building be metered separately unless otherwise
approved by the Water Superintendent."

Commissioner Bosch returned to the meeting.
IN RE: NEW HEARINGS
CONDITIONAL USE PERMIT 1807-89 - JOHN BOLAND:
MOTION CARRIED
A proposed Conditional Use Permit to allow the construction
of an accessory second unit behind an existing single family
residence. Subject property is 6,650 square feet in size,
and located on the west side of Grand Street, 100 feet south
of Collins, addressed 870 North Grand Street.
NOTE: This project is categorically exempt from the
provisions of the California Environmental Quality
Act (CEQA) per CEQA Guidelines Section 15303.
The staff report was presented by Ms. Wolff and the public
hearing was opened.
Applicant
Mr. Boland's architect questioned the findings in the staff
report. The property contains several shrubs but not small
trees. Several two story homes and apartment structures are
located in the neighborhood. He has tried to keep the
paving to a minimum and is providing the required parking
spaces. The size of the structure is 1,500 square feet
because he had to provide a two car garage. His rear yard
access is not any different from other residences in the
neighborhood. He did not understand the criteria for review
of a Conditional Use Permit and if their proposed use is an
issue, he would like an explanation.

Chairman Hart explained the staff report gives direction to
the Planning Commission; it does not affect the applicant.
If approved by the Planning Commission and City Council and
prior to issuance of building permits, by City Ordinance,
the Design Review Board shall review and approve the
project's building materials and landscaping plan.
Commissioner Greek wanted to know why Mr. Boland wanted to
move into the unit?
The applicant responded it was a matter of economics. And
because he was moving from a larger home to a smaller home,
the storage unit was necessary.
The public hearing was closed.
Commissioner Bosch stated this was the third application
they have seen for secondary units. He wanted to be sure of
a careful review so as not to negatively affect the
surrounding neighborhood. The storage room was a concern as
was the paved driveway (too much paving on site). He wanted
to be careful not to set a precedent to cause undue traffic.
Chairman Hart shared the same concerns and did not want to
turn R-1 neighborhoods into R-2 neighborhoods. He felt this
project was a drastic change from the existing. There was
too much bulk.
Moved by Commissioner Greek, seconded by Commissioner
Master, that the Planning Commission recommend the City
Council deny Conditional Use Permit 1807-89. Commissioner
Greek stated the following reasons for his motion: (1) The
second story and building mass proposed would be detrimental
to the surrounding area. (2) The parking arrangement creates
an inability to turn around and exit the property in a
forward direction. (3) The amount of paving and the location
of parking imposes on the neighbor to the south. (4) The
inclusion of the storage building contributes to the over
building of the site.

Commissioner Bosch pointed out an alternate site plan would
allow for an accessory unit if paving and parking were
addressed. The storage building is the main culprit with
this project.
Ms. Wolff stated an appeal would not be necessary. This
item will automatically be heard by the City Council.

IN RE: NEW HEARINGS
CONDITIONAL USE PERMIT 1809-89 - MEL SHAPIRO:
A proposed Conditional Use Permit to allow the operation of
a hand wash car wash in the C-1 district. Subject property
is located on the northeast corner of Lincoln Avenue and
Glassell Street, addressed 105 East Lincoln Avenue.
NOTE: Negative Declaration 1327-89 has been prepared for
this project.
A staff report was not presented and the public hearing was
opened.
Applicant
Craig Richie, 1348 Littleton Circle, Costa Mesa, felt the
project me t the requirements and conditions of the
surrounding land use. They worked with staff on the design
and layou t of the car wash. They did not have a problem
with the conditions of approval.
Commissioner Bosch asked the applicant to explain the
driveway pattern and where the stacking would occur, to
which he responded.
Commissioner Bosch also noted in the staff report there was
a concern abou t the potential noise impacts to surrounding
properties and asked about it's mitigation.
Mr. Richie said they had a noise representative present to
answer questions. Their car wash was different from
ordinary car washes and the noise impacts are easy to
mitigate.
Guy Bailey, 395 Loretta Drive, explained how they were going
to mitigate the noise impacts. There was a storage area
where equipment would be stored. Blowers would be closest
to Lincoln. Sound tests were conducted and he shared those
findings with the Commission.
Dr. Henry Schmitz, 30240 Rancho Viejo #B, San Juan
Capistrano, submitted a report to the Commission consisting
of the noise level created by the equipment and the impact
it would cause to the surrounding neighborhood. There would
be an acoustic impact to the neighboring pre-school;
however, it could be mitigated by raising the wall to six
feet. The noise level of traffic will exceed the
equipment's noise level. A study was conducted at the

Beacon Car Wash in Mission Viejo and it was determined no
impacts were made to the apartments or businesses adjacent
to that use.
Commissioner Greek asked where the blower was going to be
located as it was not shown on the plot plan.
Dr. Schmitz said it was shown on Page 3 of his report, and
he outlined it for the Commissioners.
Commissioner Greek was concerned about the accumulative
effect of the noise impact.
Dr. Schmitz said the data he presented was very clear. It
is not going to be audible nor reach buildings 40 feet away.
The noise will not exceed the existing traffic levels nor be
any more disturbing than that of traffic.
Commissioner Master asked about the blower's elevation? He
wanted to know if a six foot wall would be high enough to
block out sound?
Dr. Schmitz responded the blower is suspended and comes down
and hugs the car like a large tent. He talked about the
necessary acoustics and sound walls.
Those speaking in opposition
The Director of June Bug Preschool, 2829 North Glassell, was
concerned about the workers and the type of people working
at a car wash as she was responsible for the children
attending the preschool.
It was suggested she talk with the developer and express her
concerns to him so that they could work out a solution.
The public hearing was closed.
Commissioner Greek had problems with the circulation on
site. It was an awkward layout and does not flow well. The
area is too congested. He wanted to see a sketch or picture
of the dryer facility. A different traffic pattern was
needed.
Commissioner Bosch shared the concern about circulation and
felt the blower's impact would cause additional problems.
He had a problem with the potential traffic crossover on
site, where cars entering and cars exiting would cross
paths. This could create an unsafe situation with
relationship to cars blocking traffic on the public street,
while waiting to enter the site. The driveways are very

close to the intersection, which could also create a
hazardous situation.
Chairman Hart asked if a continuance would be in order.
Mr. Richie studies several ways for a site layout; Traffic
also did different layout proposals for them and this is the
only way it would work; a reverse plan would not work.
Mel Shapiro, 1929 Woodward Lane, Huntington Beach, leases
the property. He knows from experience traffic flow will
work under the current layout.
Commissioner Bosch stated there could be terrible problems
and suggested this was not an appropriate site. Traffic
congestion will be a hazard.
It was determined that the plans before the Commission were
not the plans being discussed. Mr. Bailey demonstrated the
traffic circulation on the exhibit map to clarify the
confusion. Different alternatives were discussed. The
applicant was willing to accept a continuance.
Ms. Wolff said new plans needed to be submitted no later
than January 26, 1990 for a continued hearing on February
21.
Moved by Commissioner Master, seconded by Commissioner
Scott, that the Planning Commission continue Conditional Use
Permit 1809-99 to February 21, 1990.

IN RE: ADJOURNMENT
Moved by Commissioner Master, seconded by Commissioner
Bosch, that the Planning Commission adjourn to a joint City
Council/Planning Commission Meeting to discuss high rise
development on Wednesday, January 17, 1990, at 4:00 p.m. in
the Weimer Room; then to adjourn to the next regular meeting
of February 5, 1990.
