RES-9433 Emergency Rehabilitation of Water Wells 23 and 24RESOLUTION NO. 9433
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE DETERMINING THAT THERE
IS A NEED TO CONTINUE THE REHABILITATION
OF WATER WELLS 23 AND 24 IN RESPONSE TO
AN EMERGENCY.
WHEREAS, Chapter 3.08 of the Orange Municipal Code permits the City
Council, in cases "where an essential governmental operation affecting the public health,
safety or general welfare could be greatly hampered or disrupted by following the standard
purchasing procedures for contracting for public projects", to comply with the provisions
of Public Contract Code Section 22050 and repair or replace a public facility, take any
directly related and immediate action required by the emergency, and procure the
necessary equipment, services, and supplies for those purposes, without giving notice for
bids to let contracts; and
WHEREAS, by the adoption of Resolution No. 9425 on March 13, 2001 and on
the basis that: (I) Water Wells 23 and 24 had developed operational problems and had
been taken out of service, (2) the award of a contract for the rehabilitation of those water
wells would not permit a delay resulting from a competitive solicitation for bids, and (3)
rehabilitation of those water wells was necessary to respond to the emergency, this City
Council waived the competitive bidding procedure in accordance with Section 22050 of
the Public Contract Code and awarded a contract to General Pump Company for the
immediate rehabilitation of those wills so that they can be returned to service; and
WHEREAS, this City Council has received and reviewed the report of the
Director of Public Works in the form presented at this meeting and finds that there is a
need to continue with the rehabilitation of the water wells under the contract awarded to
General Pump Company for the reason set forth in said report.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Orange that the conditions under which the contract awarded to General Pump Company
for the rehabilitation of the water wells. Accordingly, there is a need to continue the
action and said emergency action shall be deemed to continue to exist until its termination
is proclaimed by the City Council ofthe City of Orange.
