Repon on the Policy Statement regarding the minimum number of units required for a condominium project. (

of Current Planning reponed Staff was directed by Council to research what policy other cities
had with regard to minimum number of units for condominiums. Costa Mesa is the only city
which addresses this issue. Costa Mesa says two or more units could be considered for a condominium.
The Subdivision Map Act treats a Tentative Tract Map staning at five or more units. The
Depanment of Real Estate gets involved in condominiums with five or more units.The League
of California Cities had no comment on this issue. Staff raised the concern with small numbers
of units in a condominium related to the ability of an association to have an appropriate financial
base, and the fact that it would take at least three units to resolve disputes.Staff is

The public
hearing on petition by Yolanda and Luis Castillo to appeal the decision by the Zoning Administrator
on November 26,1991 denying Conditional Use Permit 1941-91 to allow an
up upgrade of an existing off-sale beer and wine license to an off-sale full alcoholic
beverage license at propeny located at 1095 N. Glassell Street, was heard before the City Council
on January 21, 1992, and resulted in a tie vote. The City Council directed the appeal to be

parcel approximately 2.66 acres in size from C-l (Limited Business District) to C-
2 (General Business District) has been continued from January 28, 1992 to this time.
Consideration of Conditional Use Permit 1930-91 to allow the establishment of automotive
related businesses in the C-2 Zone, adjacent to a residential district; and Variance No. 1916-91

NOTE: Letter received from Fred MacMurdo, agent for the applicant,on 3/10192, withdrawing
the request for the Left Turn Restriction from Wayfield at Chapman.
The Applicant is proposing five multi-tenant buildings located on the larger parcel, as well as
the existing Mobil Service Station to be located on the southern ponion of the propeny.
A substantial ponion of Chapman Avenue dedication will be required along the Chapman
frontage of the propeny, which is the reason for the variance request that is also included in
this application. In order for them to stay in business with the dedication, the variance is
requesting relief from providing an additional 1 0 feet of landscaping. The variance asks for relief from
the 10 foot landscape setback, relief from the12-1/2 foot wide minimum isle width to a
9-foot isle width on the fIrth isle of the service station, as well as reducing the driveway
depth from the required 30 feet to 28 feet, which could be accommodated on the site. An additional
pan of the variance is to reduce the overall parking requirement on the site from 120 to 93.
The nature of the business requires parking for drying off of cars, as well as parking for
every service bay.The Planning Commission felt the stacking area for the lube and tune would
satisfy
the parking requirement.Another aspect of the project that went to the Planning Commission was the request
to have left turns out of Wayfield onto Chapman, which the Commission did not feel
was under their purview and referred to the Traffic Commission. The Traffic Commission
denied the request,and the Applicant subsequently withdrew the request. Therefore,
the Planning Commission recommended approval, with resolution of that ponion of the project, which
is detailed in condition #28. If Council approves the project, it is recommended condition #
28 be deleted,since it
no longer applies.MAYOR BEYER OPENED

HEARING IS OPEN.The Manager of Current Planning reponed Council continued this matter to
a Study Session.Council recommended the Applicant come back with a revised Tentative Map for
that ponion of the project with an average lot size of 6,000 square feet. There was a
concern over the appropriateness of 5,000 square foot lots
in this location.The Applicant has now returned with a proposal containing lots of 6,000 square feet,
with a 50 foot minimum width. They would like to transfer some or all of the lots being dropped
in the R-1 tract over into
the condominium project.Bob Mickelson, 328 N. Glassell, representing Southridge Development
and Tracy Building Corporation, addressed the Council on behalf of the Applicant. He mentioned they
will have a small park in this project. Council asked if there would be a soccer
field. Mr. Mickelson indicated they are planning two soccer fields in the next project. Council asked
the location of the nearest fire station in the area. The Fire Chief reponed Fire Station 2 at
Wanda and Collins would service this area. Station 8 on Lama will be built on
the next project.Bob Bennyhoff, 10642 Morada Drive, recommended adoption of this
plan. He also recommended Staff put in the planned community text the requirement that
Planning Staff and the Planning Commission do a site plan review of the single family homes in the
6,000 square foot area. With the 50 and 60 foot lot widths, this would assure the
developers will produce what

The project site is a rectangular shaped parcel containing approximately 6,100 sq. ft.

follow the policies it has approved,regardless of how an individual member voted on the
matter. The City Attorney indicated the policy was acted upon after the public hearing was closed
in this matter. The evidence had already been taken. He opined the policy decision is
prospective only, and the decision should be made just on the evidence
presented
at
the
prior public

AREA OF THE CITY:Dorothy
Hudecek, 3196 N. Hearthside, expressed concern about the nonhwest area of the City,which
includes some unincorporated County islands. This area is surrounded by Anaheim on three
sides, with a lack of enforcement on all areas, inappropriate development plans, increased traffic,
etc. Lincoln Avenue is becoming a patchwork of development, which is not aesthetically pleasing.
Their area is rich in early California history, with evidence of this now being unearthed
at the Packing House. They are bordered by the Santa Ana River, which has a bird habitat.
She feels there are many dangerous situations occurring in the area, and which she has brought
to the County's attention numerous times. Adams International, which is in Anaheim, is a
total outrage to every citizen in the area. The residents in the area feel like they have no respect.
Mayor Beyer indicated he will continue his meeting with the Mayor of Anaheim regarding
problems in this area. There are so many depanments to deal with on each particular problem,
it becomes very complicated. Councilwoman Coontz thought a study had been initiated
for the Lincoln Avenue area. The Manager of Current Planning will check into whether a
study was ever initiated for this area.PACKING
HOUSE PROPERTY:Dorothy
Gibson, 3032 Oceanview Street, addressed the Council regarding the area around Fletcher
Elementary School. The County is proposing building affordable/low-income housing
on the packing house propeny, and she is opposed to this and feels it will have a negative impact
on the area. The school is already overcrowded, and there are no other schools in the area to
house additional students. Council asked Staff to take a proactive approach and investigate what
action the County is proposing for this propeny. Mayor Beyer asked the Assistant City Manager
to have the City Manager schedule a meeting with Mayor Hunter and City Manager Ruth of
Anaheim to discuss these issues.
Bob Bennyhoff, 10642 Morada Drive, informed the Council that Rancho Santiago College is
involved in serious discussions with the Orange Unified School District to use the Orange-
Olive School as the site of their new Sheriffs Academy. Ms. Gibson felt this was a separate issue
and did not enter into this wning and housing situation. Mayor Beyer asked the Assistant
City Manager to have the City Manager contact Don Roth of the County Board of Supervisors
to arrange a meeting regarding the Packing House
propeny.Wayne Gibson, 3032 Qceanview Street, a historian, addressed the Council regarding
the historical significance of the packing house propeny. There are historical anifacts buried in
this
