RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ORANGE AUTHORIZING AN APPLICATION
FOR BLOCK GRANT FUNDS FOR THE
REHABILITATION OF CERTAIN IMPROVEMENTS
AT HART PARK FROM THE ROBERTI-
Z'BERG-HARRIS URBAN OPEN
SPACE AND RECREATION GRANT PROGRAM
UNDER THE SAFE NEIGHBORHOOD PARKS,
CLEAN WATER, CLEAN AIR, AND
COASTAL PROTECTION BOND ACT OF
2000.WHEREAS, the Legislature of the State of California has enacted the
Roberti-Z'Berg-Harris Open Space and Recreation Grant Program (the "Grant
Program"), which provides funds to certain political subdivisions of the State of California for
acquiring lands and for developing facilities to meet urban recreational
needs; and WHEREAS, the people of the State of California have enacted
the Safe Neighborhood Parks, Clean Water, Clean Air, and Coastal Protection Bond Act
of2000 (the Bond Aet), which provides funds to certain political subdivisions of the State
of California for the Grant
Program; and WHEREAS, the Department of Parks and Recreation of the State
of California DPR) has been delegated the responsibility for the administration of the Grant
Program and,accordingly, has established procedures
therefore; and WHEREAS, among its procedures, DPR requires that the legislative body of
a local agency desiring to submit an application for funds under the Grant Program
certify by resolution the approval of its application and the availability of local matching
funds; and WHEREAS, the City Council of the City of Orange has heretofore included
in the City of Orange Seven Year Capital Improvement Program for Fiscal Years
2001-02 through 2007-08, dated May 22, 2001 (CIP) the rehabilitation of the
bandshell, football field and bleachers, pool heater and filter system, and at the City-
owned Hart Park (collectively, the Projec), the cost of which is estimated
to be $489,796; and WHEREAS, the City Council finds that the rehabilitation
of the bandshell falls within that class of projects which will not cause a significarlt effect
on the environment and is exempt :from the California Environmental Quality Act (CEQA)
pursuant to Section 1533] of
the StateCEQA
Guidelines; andi-----------
WHEREAS, the City COW1cil finds that the rehabilitation of the field and bleachers
falls within that class of projects which will not cause a significant effect on the environment
and is exempt from the California Environmental Quality Act (CEQA) pursuant to Section
15301 of the State CEQA Guidelines; and -WHEREAS,
the City COW1cil finds that the rehabilitation of the pool heater and filter system
falls within that class of proj ects which will not cause a significant effect on the environment
and is exempt from the California Environmental Quality Act (CEQA) pursuant to
S'ection 15302 of the State CEQA Guidelines; and WHEREAS,
the City COW1cil finds that the rehabilitation of the pool restrooms falls within
that class of projects which will not cause a significant effect on the environment and is
exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 of
the State CEQA Guidelines; and WHEREAS,
this City COW1cil desires to submit an application to DPR for funds in the
amoW1t of $376,766 W1der the Grant Program and, to that end, finds and determines that the
City of Orange has, and is able to devote to the Project, the sum of at least $113,030 representing
the amoW1t of funds required by DPR to match the funds sought by the City from
DPR for the Project W1der the Grant Program) and such other funds as may be sufficient to
finance the total cost of the Project upon the basis that $376,766 of the total cost will be reimbursed
to the City by DPR upon completion ofthe improvements thereof; and WHEREAS,
the City COW1cil W1derstands and acknowledges that, if awarded grant funds
W1der the Grant Program, the City will be required to enter into a contractual agreement with
DPR specifying the payment of funds by DPR for the performance of the Project; and WHEREAS,
this City COW1cil has duly considered all of the terms and conditions of the
proposed application and the provisions of the form of a Grant Contract presented by DPR,
in the form submitted by the City Manager, and believes that the submittal of said application
to DPR and the execution of said Grant Contract and the use of any funds obtained from
DPR W1der the Grant Program for the Project (or any portion thereof) is in the best interests
of the City and the health, safety, morals and welfare of its residents, and in accord with
the public purposes and provisions of applicable State and local law and requirements.NOW,
THEREFORE, BE IT RESOLVED by the City Council of the City of Orange as
follows:Section
1.
The foregoing recitals are true and correct.Section 2.
The City COW1cil finds and determines that the component parts of the Proj1ect are
exempt from CEQA pursuant to Sections 15301, 15302 and 15331 of the State CEQA Guidelines.

Section 3. That the application for grant funds under the Grant Program in the
amount .of $376,766 and in the form as submitted by the City Manager is hereby approved,
and the City Manager is authorized to execute the application and such other documentation as
DPR requires to consider and process the application and to submit same to DPR on behalf of
r' the City.
Section 4. That the City has, or will have, sufficient funds to devote to the
Project, consisting of funds in an amount representing not less than 30% of the amount of
funds to be granted to the City by DPR under the Grant Program for the Project and including
such other funds as may be needed to finance the total cost of the Project.
Section 5. That the City Council has reviewed, understands and agrees with the
terms and conditions contained in the Grant Contract presented to the City by DPR, including
the Genl:ral Provisions attached thereto and in the form as submitted by the City Manager,
and that such Grant Contract is hereby approved and that the Mayor is authorized to execute,
and the City Clerk to attest, the Grant Contract on behalf of the City,
Section 6. Notwithstanding the foregoing, the City Council hereby appoints the
City Manager as the agent for and on behalf of the City to conduct all negotiations and
execute and submit all documents for the Project (or any portion thereof), including, but not
limited to, individual project applications, agreements, amendments, billing statements, and
such other documentation as the City Manager deems necessary and appropriate to
consummate the transaction contemplated by the adoption of this Resolution and to
administer the City's obligations, responsibilities and duties to be performed hereunder and
under the Grant Contract and any other agreement entered into with DPR in cormection with
the Grant Program, and all actions previously taken by such officers and employees in
cormecti.on with the application and Grant Contract are ratified and approved.
