A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ORANGE APPROVING LOT LINE
ADJUSTMENT LL 2002-03 ADJUSTING
LOT LINES OF CERTAIN REAL
PROPERTY SITUATED AT 1638 AND 1650 NORTH
FERN STREET IN THE CITY OF ORANGE,
COUNTY OF ORANGE, STATE OF
CALIFORNIA.OWNERS: 1. Robert A. Manning and Betty
F.Manning, husband and wife as joint
tenants 2. Mickey
Bednar WHEREAS, Section 66412 (d) of the Subdivision Map Act malces provisions
for the Council to approve lot line adjustments by resolution where the land taken from
one parcel is added to an adjacent parcel and where a greater number of parcels
than originally existed is not thereby created;
and WHEREAS, the City COlmcil has enacted Orange Municipal Code
Sections 16.32.0 I 0 et seq., which provide the procedure to be followed for the approval of said
lot line adjustment;
and WHEREAS, the Subdivision Section of the Public Works Department and
the Staff Review Committee have reviewed and recommended approval of Lot
Line Adjustment No. LL 2002-03 and have made a finding that the real property
situated at 1650 and 1638 North Fern Street in the City of Orange, described as Parcels A and
B in Exhibit A attached hereto and graphically depicted on the map attached hereto
as Exhibit 8, complies with the provisions of the California Subdivision Map Act and
all applicable City of Orange ordinances and regulations, including the requirements for
building
sites;and WHEREAS, the Subdivision Section of the Public Works Department
and the Staff Review Committee have made the
following findings:I. That the proposal is eligible for processing as a
lot line adjustment pursuant to Section 66412 of the
Subdivision
Map Act;2. That the requirements of the California
Environmental Quality Act have
been met;3. That the proposal is consistent with the General
Plan; and 4. That the resultant parcels will meet the requirements
of the
Zoning Code.NOW, THEREFORE, BE IT RESOLVED that the City
Council hereby concurs in the above
findings; and PAGE 7
BE IT FURTHER RESOLVED that the proposed Lot Line Adjustment No. LL
2002..03, as shown on Exhibits A and B to this Resolution, be approved, and a deed
establishing title in conformity with said parcel be executed; and
BE IT FURTHER RESOLVED that the City Clerk is hereby authorized and
directed to cause this Resolution to be recorded in. the Office of the Orange County
RecOTder.
