HomeMy WebLinkAboutORD 15-10 Amending Title 12 Acceptance of roads and streetsORDINANCE NO. 15 -10 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING CHAPTER 12.52 OF TITLE 12 OF THE ORANGE MUNICIPAL CODE RELATING TO THE ACCEPTANCE OF ROADS AND STREETS INTO THE CITY'S STREET SYSTEM. WHEREAS, Section 1806 of the California Streets and Highways Code provides that, except upon the annexation of territory to the City, no public or private street or road shall become a City street or road until the City Council, by resolution, has caused the street or road to be accepted into the City street system; and WHEREAS, said Section 1806 further provides that, in lieu of the procedure set forth in the first recital, above, the City Council may, by ordinance, designate a City officer to accept, on behalf of the City Council, streets and roads (or portions thereof) into the City street system and to record conveyances to the City of real property interests for street and road uses and purposes; and WHEREAS, the City Council of the City of Orange desires to designate the Director of Public Works of the City to accept, on behalf of the City Council, streets and roads (or portions thereof) into the City street system and to record conveyances to the City of real property interests for street and road uses and purposes. NOW THEREFORE, the City Council of the City of Orange does ordain as follows: SECTION I Chapter 12.52 of Title 12 of the Orange Municipal Code is hereby amended by the addition of a new Section 12.52.090 to read in full as follows: 12.52.090 Acceptance of Road or Street into City Street System. The Director of Public Works of the City is authorized to accept, on behalf of the City Council, streets and roads (or portions thereof) into the City street system and to record conveyances to the City of real property interests for street and road uses and purposes. The Director of Public Works shall, prior to recording any conveyance under this section, affix a certificate to the instrument stating the acceptance into the City street system and designating the name or number, or both, of the City street or road." SECTION II: Should any section, subsection, clause, or provision of this Ordinance for any reason be held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity or constitutionality of the remaining portions of this Ordinance; it being hereby expressly declared that this Ordinance, and each section, subsection, sentence, clause and phrase hereof would have been prepared, proposed, approved and ratified irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional. SECTION III: A summary of this Ordinance shall be published and a certified copy of the full text of this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the City Council meeting at which this Ordinance is to be adopted. A summary of this Ordinance shall also be published once within fifteen (15) days after this Ordinance's passage in a newspaper of general circulation, published, and circulated in the City of Orange. The City Clerk shall post in the Office of the City Clerk a certified copy of the full text of such adopted Ordinance along with the names of those City Council members voting for and against the Ordinance in accordance with Government Code Section 36933. This Ordinance shall take effect thirty (30) days from and after the date of its final passage.
