A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE APPROVING THE
APPLICATION FOR MATCHING GRANT FUNDS
UNDER THE MURRAY-HAYDEN URBAN
PARKS AND YOUTH SERVICE PROGRAM UNDER
THE SAFE NEIGHBORHOOD PARKS, CLEAN
WATER,CLEAN AIR, AND COASTAL PROTECTION
BOND ACT OF 2000 FOR THE EL CAMINO REAL
PARK RF,NOVATION
PROJECT.WHEREAS, by the enactment of the Safe Neighborhood Parks, Clean Water,
Clean Air, and Coastal Protection Bond Act of 2000 the people of the State of California
have established the Murray-Hayden Urban Parks and Youth Service Program (
the "Program"),whieh provides funds to the State of California for grants to local
agencies, nonprofit organizations, and federally-recognized California Indian tribes for
parks, park facilities,environmental enhaneement projects, and environmental youth service centers
that are within the immediate proximity of a neighborhood that has been identified by the
Department of Parks and Recreation of the State of California ("DPR") as having a critical lack of
park or open-space lands or deteriorated park facilities, that are in an area of
significant poverty and unemployment,and that have a shortage of park and recreational
services for youth; and WHEREAS, DPR has been delegated the responsibility for
the administration of the Program and has established procedures for its implementation,
which require, among other things, that the legislative body of a local agency desiring to submit
an application for funds undl:r the Program certify by resolution the approval of its application
and the availability of
local matching funds; and WHEREAS, this City Council has heretofore included in the
City of Orange Seven Year Capital Improvement Program for Fiscal Years 2001-02
through 2007-08, dated May 22,200 I ("CIP") the rehabilitation of the City-
owned EI Camino Park (the "Project"), and coneeptual design plans and an analysis of the
Project's impact on the environment in accordance with the California Environmental
Quality Act are underway. Once prepared and consensus reached within the community, the conceptual
design plans will be considered by the City Council for approval and,
thereafter, the preparation of construction plans and specifications and the authorization to obtain bids
for the construction of the Project; and WHEREAS, this City Council finds and determines that
the City of Orange is able to devote to the Project funds in an amount sufficient
to finance the total cost thereof, assuming that $250,000 will be
reimbursed to the City by DPR; and WHEREAS, the City Council
understands and acknowledges that, if awarded a matching grant under the Program, the City will
be required to enter into a contractual agreement with the State of California for disbursement
WHEREAS, this City Council believes that the Project is in the best interests of the City
and the health, safety, morals and welfare of its residents, and in accord with the public purposes
and provisions of applicable state and local law and requirements.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange,
on the basis of the facts set forth in the agenda report presented to it and any testimony received at
the meeting at which this matter was considered, as follows:
Section 1.The foregoing recitals are true .md correct.
Section 2. The City Council certilies that it has (or will have) sufficient funds
available and devoted to the construction of the Project prior to the commencement of
construction thereon, subject to reimbursement by the State of California of $250,000 of the
total cost of construction of the Project.
Section 3. The City Council hereby approves the application for funds in the amount
of $250,000 under the Program, in the form presented at this meeting, and authorizes and directs
the City Manager to execute the application and such other documentation as DPR requires to
consider and process the application and to submit smne to DPR.
Section 4. The City Council further certifies that the City has reviewed, understands,
and agrees to the General Provisions contained in the form of contract shown in the Program's
PrQ(:edural Guide.
Section S. The City Council hereby appoints the City Manager as agent of the City
to conduct all negotiations and execute and submit all documents, including, but not limited to,
applications, agreements, amendments, billing statements, and such other documentation as the
City Manager deems necessary and appropriate to consummate the transaction contemplated by
the adoption of this Resolution and to administer the City's obligations, responsibilities and
duties to be performed hereunder and under any agreement entered into with DPR in connection
with the Program, and all actions previously taken by such officers and employees in connection
with the application and contract are ratilied and approved.
