A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE AUTHORIZING THE REPAIR
OF THE ROOFS OF THE CITY'S
ADMINISTRATION AND PUBLIC WORKS
BUILDINGS AT 300 EAST CHAPMAN AVENUE,
WAIVER OF COMPETITIVE BIDDING
REQUIREMENTS, AND AWARD OF CONTRACT
TO SCHOLTEN ROOFING SERVICE COMPANY
FOR THE IMMEDIATE RESURFACING OF THOSE
ROOFS.
WHEREAS, Chapter 3.08 of the Orange Municipal Code permits the City Council, in
cases "where an essential governmental operation affecting the public health, safety or general
welfare could be greatly hampered or di srupted by following the standard purchasing procedures
for contracting for public projects", to comply with the provisions of Public Contract Code
Section 22050 and repair or replace a public facility, take any directly related and immediate
action re:quired by the emergency, and procure the necessary equipment, services, and supplies
for those purposes, without competitive bidding; and
WHEREAS, this City Council finds and determines that the roofs of the City's
Administration and Public Works buildings at 300 E. Chapman Avenue have developed leaks
and, accordingly, it is essential to the public health, safety or welfare that the competitive bidding
procedure be waived in accordance with Section 3.08.590 of the Orange Municipal Code and
Section 22050 of the Public Contract Code and a contract be awarded to Scholten Roofing
Service Company for the immediate resurfacing of the roofs of those buildings so that no further
damage will occur to the buildings and the personal property and operations within; and
WHEREAS, informal price quotations were requested from several qualified vendors
and three of said vendors responded; and
WHEREAS, the City Council further finds and determines that the emergency nature of
the resurfacing work would not permit a delay resulting from a competitive solicitation for bids
and that the award of the contract to Scholten Roofing Service Company and the repair work is
necessary to respond to the emergency.
NOW, THEREFORE, the City Council of the City of Orange does resolve as follows:
I. The City Council finds and determines that the foregoing recitals are true and correct.
2. That the condition of the roofs on the Administration and Public Works buildings at 300 E.
Chapman Avenue constitutes an emergency under the terms and provisions of Chapter 3.08
of the Orange Municipal Code.
3. The City Council hereby authorizes the retention oftbe services of Scholten Roofing Service
Company, without adopting plans and specifications or giving notice for bids to let contracts,
to make the requisite resurfacing repairs to the Administration and Public Works buildings at
300 E. Chapman Avenue and to correct the emergency condition for an amount not to exceed
35,578 and in accordance with the terms of a contract in the form presented at this meeting.
4. The Mayor is hereby authorized and directed to execute, and the City Clerk to attest, the
contract with Scholten Roofing Service Company in the form presented at this meeting.
5. The officers and employees of the City are authorized and directed, jointly and severally, to
do any and all things necessary or advisable in order to effectuate the purposes of this
resolution and to administer the City's obligations, responsibilities aJld duties to be
performed hereunder and under the contract with Scholten Roofing Service Company, and all
actions previously taken by such officers and employees in connection with the retention of
the services of Scholten Roofing Service Company are ratified and approved.
