HomeMy WebLinkAboutORD 08-12 Adopting Santa Fe Depot Specific Plan UpdateORDINANCE NO. 08 -12 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE ADOPTING THE SANTA FE DEPOT SPECIFIC PLAN UPDATE. WHEREAS, on March 9, 2010 the City adopted its 2010 General Plan, which modified land use designations in the Old Towne Historic District, including, but not limited to, a variety of changes in the environs of the historic Santa Fe Depot and Orange Transportation Center as presented on the Land Use Element's Land Use Policy Map; and WHEREAS, California Government Code §65860 requires a city's zoning ordinances to be consistent with its general plan; and WHEREAS, the Implementation Plan of the City of Orange 2010 General Plan includes Implementation Program 1 -3, which calls for the implementation and updating of various specific plans in Orange including the Santa Fe Depot Specific Plan; and WHEREAS, the City of Orange 1993 Santa Fe Depot Specific Plan warranted updated content and planning area given the significant changes that have occurred in the area over the past for nearly two decades including establishment of the Old Towne National Register of Historic Places District and associated property reinvestment; establishment of successful Metrolink service in Orange County; expansion of Chapman University into the Depot area; and the transition of industrially designated land out of industrial uses; and WHEREAS, the Santa Fe Depot Specific Plan has been updated to increase the size of the original 1993 planning area from 47 acres to approximately 101 acres, with boundaries of Walnut Avenue to the north, Palmyra Avenue to the south, Olive Street to the east, and a combination of Parker and Pixley Streets to the west to enable the updated Specific Plan to plan for the area as a transit- and pedestrian- oriented district that links the Depot and Orange Transportation Center with surrounding neighborhoods, employment, institutional uses, and the historic downtown business district; and WHEREAS, the Santa Fe Depot Specific Plan Update provides City decision makers with updated policies, standards, and guidelines to more effectively guide future change and growth in the Depot area in a manner that strives to maintain the integrity of the historicindustrialandresidentialcharacteroftheareawhilepursuingimprovementstothepublic right -of -way and infrastructure, encouraging adaptive re -use of historic buildings, strategically managing parking and traffic, and accommodating context sensitive infill development; and WHEREAS, the environmental impacts of the Specific Plan Update have been analyzed through Final Program Environmental impact Report (PEIR) No. 1820 -09, which is comprised of Draft PEIR No. 1820 -09, changes and revisions to Draft PEIR No. 1820 -09, the Response to Comments, technical appendices, and the Mitigation Monitoring Program, pursuant to the provisions of the California Environmental Quality Act (CEQA), local CEQA Guidelines, and the State CEQA Guidelines, a full, true and correct copy of which is on file with the City Clerk of the City of Orange; and WHEREAS, the Planning Commission, having considered the proposed update to the Santa Fe Depot Specific Plan contained herein at a public hearing held on May 7, 2012, including review of the staff report and having received public testimony on the item, has determined the proposed Specific Plan Update is justified and recommends approval thereof, and WHEREAS, the City Council conducted duly advertised public hearings on June 26, 2012 taking public testimony in support and opposition to the Santa Fe Depot Specific Plan Update, concluding with the adoption of the Plan via Ordinance No. 8 -12 on September 11, 2012; and WHEREAS, the City Council believes the proposed Specific Plan Update will serve the public health, safety and welfare. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS: SECTION I: The 1993 Santa Fe Depot Specific Plan is deleted in its entirety and replaced with the updated 2012 Santa Fe Depot Specific Plan as presented in Attachment A. SECTION II The proposed Specific Plan update document described in Section I is related to the public welfare, required by California Government Code Section 65860 and consistent with Final Program Environmental Impact Report (PEIR) No. 1820 -09 for the Santa Fe Depot Specific Plan Update, prepared in accordance with the California Environmental Quality Act. SECTION III A summary of this ordinance shall be published and a certified copy of the full text of this ordinance shall be posted in the Office of the City Clerk at least 5 days prior to the City Council meeting at which this ordinance is adopted. A summary of this ordinance shall also be published once within 15 days after the ordinances passage in a newspaper of general circulation, published, and circulated in the City of Orange. The City Clerk shall post in the Office of the City Clerk a certified copy of the full text of such adopted ordinance along with the names of those City Councilmembers voting for and against the ordinance in accordance of Government Code Section 36933. This ordinance shall take effect 30 days from and after the date of its final passage. 2 ADOPTED this 11 day of September, 2012.
