CITY OF ORANGE UPHOLDING APPEAL NO. 483
AND APPROVING NEGATIVE DECLARATION NO.
1668-01 AND MAJOR SITE PLAN REVIEW
169-01 FOR THE CONSTRUCTION OF THE
ALL FAITHS CHAPEL, SUBJECT
TO CONDITIONS,DEMOLITION OF CHEVERTON
HALL AND CONSTRUCTION OF A
TEMPORARY PARKING LOT LOCATED WITHIN
THE CHAPMAN UNIVERSITY
SPECIFIC PLAN.Applicant:

University RECITALS:WHEREAS, Major Site Plan Review No. 169-01 was filed
by Chapman University in accordance with the provisions of the City of Orange
Municipal Code; and WHEREAS, Major Site Plan Review No. 169-01 was processed
in the time and manner prescribed by state
and local law; and WHEREAS, on April 14, 2001 the Staff Review Committee
reviewed the All Faiths Chapel and the Temporary Parking Lot projects and recommended
that both projects proceed subject to the conditions and adopted findings of the Site
Plan Review requirements as specified in Chapman University's
amended Specific Plan; and WHEREAS, on April 18, 2001 the Design Review
Committee found that proposed design :md design elements conform to the standards and design
criteria referenced in the Chapman University Specific Plan Site Plan Review Process
and recommended approval of the proj1ect to
the Planning Commission; and WHEREAS, the Planning Commission conducted one
duly advertised public hearing on May 21, 2001 for the purpose of considering Negative
Declaration No. 1668-01 and Major Site Plan Review No. 169-01 and denied Major Site
Plan Review 169-01 and took
no action on Negative Declaration 1668-01; and WHEREAS, the applicant filed an appeal on
Jlme 1,2001, and then in response to the conGerns raised by
the Planning Commission and community revised
WHEREAS, on December 11, 2001, the City Council conducted a public hearing
regarding Appeal No. 483, an appeal of the Planning Commission's denial of Major Site Plan
Review No. 169-
01.NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of Orange that Negative Declaration No. 1668-01, and Major Site Plan Review No.
169-01 for Chapman University to accommodate construction of the All Faiths
Chapel, demolition of Cheverton Hall and construction of a temporary parking lot is hereby approved
based on
the following findings:1. Negative Declaration No. 1668-01 was prepared
in conjunction with Major Site Plan Review No. 169-01. After
examining the Initial Study, Negative Declaration, and considering all infonnation
related thereto the City Council for the City of Orange approves and
adopts
Negative Declaration No. 1668-01.2. That the proposed All Faiths Chapel and
the Temporary Parking Lot are consistent with
the City's General Plan.3. That the proposed chapel and temporary parking
lot are permitted within the subject zoning district and comply with the
applicable provisions of the City of Orange Municipal Code,
including prescribed developrnent standards and applicable special design guidelines or
specific plan requirements, except as
otherwise identified in these findings.4. That the subject sites are physically suitable for the
type and intensity of
the land uses being proposed.5. That there is adequate public access and
adequate utilities to servIce the proposed chapel
and temporary parking lot development.6. That the project location, size and
design is compatible with
existing surrounding development and neighborhoods.7. That the project provides for safe
and adequate vehicular and pedestrian
circulation, both on and off-site.8. That the proposed chapel,
demolition of Cheverton Hall and temporary parking lot will not result in conditions
or circumstances contrary to the
public health, safety and general welfare.9. That the proposed project is
compatible with other projects within
the Chapman University Specific Plan
110. That based upon the revised conceptual design for the All Faiths Chapel, as
depicted in the design booklet dated November 19, 2001, Major Site Plan
Review MSP 169-01 is compatible with the regulations and design
guidelines of the Chapman University Specific Plan and conforms to the General
Plan and implementing
ordinances.Ill. That the data and analysis upon which these findings of fact are based are
set forth in the staffreport for Major Site Plan Review MSP 169-01,
staffs oral presentation and public testimony, which constituted the City
Council's review of
this application.HE IT FURTHER RESOLVED that the following conditions are
imposed subject to approval of Major Site Plan Review
No. 169-01:1. The site plan and renderings for All Faiths Chapel depicted
in the November 19,2001 design booklet shall be developed as approved by
the City Council and which is on file with the
Community Development Department.2. The Chapel building's final architecture and landscaping shall
be subject to review and approval by the City's Design
Review Committee (DRC).Specific attention shall be given to the design details, materials
and color to further ensure that the building fits within the historic context
of Old Towne.3. The temporary parking lot shall be constructed and
maintained in general conformance with the site plan submitted by the
applicant/developer and marked Exhibit "C"; and dated May 21, 2001
for identification purposes.Said plan is on file with the
Community Development Department.4. The Parking Management Recommendations (Plan)
for Chapman University dated January 23, 2001, the Addendum
to Parking Management Recommendations for Chapman University dated April 26,
2001, and the Implementation Manual for the Chapman
University Parking Management Plan dated April 26, 2001 are hereby incorporated into
this approval by reference. Further, the University shall maintain, at all
times, a sufficient amount of surplus parking to include the required 64
spaces to facilitate alternate assembly uses and/or special events held
at the Chapel.5. Prior to obtaining permits for the temporary parking lot which is
to be located at the Cheverton Hall site, the applicant shall submit a final
landscape plan for approval by the Design
Review Committee (DRC).6. The applicant shall obtain an approved grading permit
from Public Works Engineering prior to
start of construction.Resa No.
7. Prior to the issuance of a building permit, the applicant/developer shall
consolidate all existing parcels that comprise the site of the proposed All
Faiths Chapel (Campus Orange Street Parking Lot) into one parcel.
8. Prior to issuance of building permits the applicant/developer shall
resolve/relocate individual utilities within an existing public utility easement
running under the easterly 14 feet of the proposed chapel or relocate the
chapel off the easement.
9. The property owner shall provide a trash enclosure or trash compactor per
City standard 408 or standard 409.
10. The applicant/developer shall construct and provide a larger radius curb return
for improved sight distance at the northwest corner of the chapel.
Redesigning the parking lot circulation is an acceptable alternative.
11. The applicant/developer shall remove the sidewalk on the north side of
University Drive and sign for no pedestrian access at Glassell Street.
12. The planting of any trees within 10 feet (measured horizontally) from the
City's sanitary sewer or domestic water lines in abandoned Orange Street is
strictly prohibited.
13. An approved fire sprinkler system must be installed throughout the building
per O.M.C. 15.32.070 Section 1001.10. The system shall be designed per
N.F.P.A. 13, U.B.C. Chapter 9, U.B.C. Standards 9-1 and 9-2.
The sprinkler system requires
24-hour supervision.14. The fire department connection shall not be affixed to the
building. The fire department connection must be located at least 40 feet
away from the building, within 40 feet of a fire hydrant and on the address
side of the building, unless otherwise determined by the Fire
Department. The hydrant shall be located on the same side of the street as
the
fire department connection.15. The applicant/developer shall provide two on-site fire
hydrant(s) and mains capable of supplying the required fire flow. The
hydrant model and on-site location shall be approved by the Fire Department and
have a three (3) foot minimum clearance around the circumference of
the fire hydrant. The on-site hydrants shall not be controlled by the control valve (
P.I.V.) for the sprinkler system so that water flow to the hydrants
is not impaired should the sprinkler system be shut down for any reason. (U.F.C.
Sections 903 and 1001.7)
fire department connection shall not pressurize a hydrant. Plans must be
submitted to the Building Department.
16. Prior to issuance of a fire service (detector check) the required water supplies
for hydrants and fire sprinkler systems shall be determined and the water
supplies shall be approved by the Fire Department.
17. Every building shall be accessible to fire department apparatus by an access
roadway of not less than 20 feet of unobstructed width having a minimum of
13 feet 6 inches of vertical clearance. The access roadway shall be extended
to within 150 feet of all portions of the exterior walls of the first story of any
building. U.F.C. Sections 901 and 902.
18. All fire lanes less than 36 feet wide shall be marked and signed as a fire lane.
The marking and signs shall be provided and installed per the City of Orange
Fire Departments Fire Lane Standards.
19. The fire department access roadway shall be an all weather-driving
surface capable of supporting the imposed loads of fire apparatus, 60,000
pounds.20. The fire department access roadway shall be provided with adequate
tuming radius for fire department apparatus. (A 45 foot outside and 25 foot
inside radius.) U.F.C. Section 902.2.2.
3.21. A Fire Department approved key box for fire department access shall
be installed on the address side of the building near the main entrance or
fire control room at a height of 5 feet above finished grade. The Knox box
shall contain keys to gain access to each building. UF.C. Section 902.
4.22. Construction plans shall include a site plan and landscape plan
detailing exiting from outside the building to a public right of way. Details on the
type of ground covering, hardscape, gates and latching and locking hardware
shall be provided on the
plans.23. The applicant/developer shall provide a fire alarm system as required
per U.F.C. Article
10.24. The applicant/developer will be responsible for the payment of Fire
facility
fees.25. All roof coverings installed on any new or existing building or structure
shall be fire retardant U.L. listed Class A. (O.M.C. 15.36.
030).26. Each building shall be metered separately unless otherwise approved by
the Water

27. The applicant/developer shall satisfY all water main connection, plan check,
and inspection charges as determined by the Water Division.
28. The applicant/developer shall enter into a Decorative Improvement Agreement
with the City of Orange Public Works Department.
29. The existing water line running north off of University Drive be relocated to a
location as approved by the Water Manager.
30. A minimum fifteen-foot access and utility easement be dedicated to the
City of Orange as determined by the Water Manager for mains, meters, and
fire
hydrants.31. Both the Water Division and the Fire Department shall approve the location
of fire hydrants and fire
services.32. Within two (2) days of final approval of this project, the applicant
shall deliver to the Planning Division a cashiers check payable to the County
Clerk in an amount required to fulfill the fee requirements of Fish and Game
Code Section 7l1.4(d)(2) and the County administrative fee, to enable the City
to file the Notice of Determination required under Public Resources Code
21152 14 Cal. Code Regulations 15075. If it is determined that there will be
no impact upon wildlife resources, the fee shall be $43.
00.33. These conditions of project approval shall be reprinted on the cover sheet
or first page of all construction plans, including grading plans, if
applicable.34. The applicant agrees to indemnify, hold harmless, and defend the City,
its officers, agents and employees from any and all liability or claims that may
be brought against the city arising out of its approval of this site plan, save
and except that caused by City's active
negligence,35. The applicant shall comply with all federal, state and local
laws.36. The following code provisions are applicable to this project and are
included for information only. This is not a complete list and other code
provisions may apply to the
project.37. Prior to issuance of building permits, the applicant shall pay all
applicable development fees, including but not limited to: City sewer
connection,Orange County Sanitation District Connection Fee, Transportation
System Improvement Program, Fire Facility, Police Facility, Park
Acquisition,Sanitation District, School District, and Eastern Foothill
Transportation Corridor, as

38. Expiration - If not utilized, this project approval expires two years from the approval
date. An extension of time may be permitted upon a written request,if
received before the expiration deadline.ADOPTED
