HomeMy WebLinkAboutORD 01-16 Zone Change Metrolink Parking StructureORDINANCE NO. 01-16 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE APPROVING ZONE CHANGE 1275 -14, A ZONE CHANGE FROM PUBLIC INSTITUTION (SPECIFIC PLAN) TO OLD TOWNE MIXED USE -15 (SPECIFIC PLAN). CITY OF ORANGE METROLINK PARKING STRUCTURE PROJECT 130 N. LEMON STREET WHEREAS, the Orange County Transportation Authority (OCTA) is working to expand Metrolink service in Orange County and at full roll out projects that the Orange station will need 900 parking spaces to accommodate demand; and WHEREAS, the Orange Transportation Center (OTC) currently has 375 spaces; and WHEREAS, the City desires to construct a parking structure in cooperation with OCTA and in early 2009 entered into a cooperative agreement with OCTA to plan for a new parking structure to serve the OTC and the Metrolink Service Expansion; and WHEREAS, the City retained a design firm to prepare project concepts and design plans and held a series of community workshops between 2010 and 2013; and WHEREAS, schematic design plans for the Metrolink Parking Structure Project were completed in 2014; and WHEREAS, the project site has an existing General Plan land use designation of Old Towne Mixed Use (OTMU), 6 to 15 dwelling units per acre; and WHEREAS, the project site is zoned both Public Institution (Specific Plan) denoted PI SP) and Old Towne Mixed Use -15 (Specific Plan) denoted OTMU -15 (SP); and WHEREAS, according to Table LU -3 in the General Plan Land Use Element, the portion of the project site zoned PI (SP) is inconsistent with the site's existing OTMU (6 to 15 dwelling units per acre) General Plan land use designation; and WHEREAS, California Government Code §65860 requires consistency between a city's General Plan and zoning; and WHEREAS, the City desires to change site zoning from PI (SP) to OTMU -15 (SP), which would bring the project site zoning into consistency with the General Plan; and WHEREAS, on May 27, 2015, City departments reviewed the Metrolink Parking Structure Project including the Zone Change and recommended the project proceed to hearings subject to certain requirements and conditions; and WHEREAS, on November 4, 2015, the City's Design Review Committee reviewed the Metrolink Parking Structure Project including the Zone Change and recommended approval subject to conditions by a vote of three ayes and none opposed; and WHEREAS, the Planning Commission conducted a duly advertised public hearing on December 7, 2015, at which time interested persons had an opportunity to testify either in support of or opposition to the Project; and WHEREAS, on December 7, 2015, the Planning Commission reviewed the Metrolink Parking Structure Project including the Zone Change and, having received public testimony on the item, recommended approval subject to conditions by a vote of four ayes and none opposed; and WHEREAS, Mitigated Negative Declaration (MND) No. 1832 -14 was prepared in accordance with the requirements of the California Environmental Quality Act (CEQA) and concluded that the environmental impacts of the Metrolink parking Structure Project would be less than significant with the incorporation of mitigation measures; and WHEREAS, MND No. 1832 -14 was circulated for public review for at least 30 days as required by CEQA, with the comment period beginning June 10, 2015 and ending on July 15, 2015; and WHEREAS, the City Council has reviewed and considered the information presented in Final MND No. 1832 -14 including written comments received; and WHEREAS, the City Council, having considered the proposed Ordinance and Zone Change at a duly advertised public hearing held on January 12, 2016 including review of the staff report and having received public testimony on the item, has determined the proposed Zone Change is justified and appropriate. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES ORDAIN AS FOLLOWS: SECTION I The existing zoning is depicted on the map attached hereto as Exhibit "A ". The City Zoning Map is hereby amended in order to change the zoning classification on the site as depicted on the map attached hereto as Exhibit `B ". SECTION II The proposed zone change described in Section I is related to the public welfare required by California Government Code Section 65860. Further, impacts of the Zone Change are adequately described and evaluated in MND No. 1832-14 in compliance with the CEQA. Ordinance No. 01 -16 2 SECTION III A summary of this ordinance shall be published and a certified copy of the full text of this ordinance shall be posted in the Office of the City Clerk at least 5 days prior to the City Council meeting at which this ordinance is adopted. A summary of this ordinance shall also be published once within 15 days after the ordinances passage in a newspaper of general circulation, published, and circulated in the City of Orange. The City Clerk shall post in the Office of the City Clerk a certified copy of the full text of such adopted ordinance along with the names of those City Councilmembers voting for and against the ordinance in accordance of Government Code Section 36933.
