AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF ORANGE APPROVING A ZONE CHANGE
TO EXPAND AN EXISTING HISTORIC DISTRICT
OVERLAY ZONE TO ADD 12 PROPERTIES ON
SOUTH BATAVIA STREET TO THE LOCAL OLD
TOWNE HISTORIC DISTRICT AND UPDATE THE
CITY OF ORANGE HISTORIC RESOURCES
INVENTORY
ZONE CHANGE NO. 1289-18
APPLICANT: CITY OF ORANGE
WHEREAS,the boundaries of the local Old Towne Historic District were established by
the City Council in Ordinance No. 38-88 as "Batavia Street on the west, Cambridge Street on the
east,Walnut Avenue on the north, and La Veta Avenue on the south, including the Nutwood Tract
on the south side of La Veta Avenue. The boundaries of the Old Towne Area shall run along the
centerline of the designated streets and the borders of the Nutwood Tract"; and
WHEREAS, Ordinance No. 15-98 amended the local Old Towne Historic District
boundaries at Walnut Avenue and Waverly Street to match the National Register of Historic Places
Old Towne Historic District,designated in 1998.As established in Orange Municipal Code(OMC)
17.17.030,the boundaries of the local Old Towne Historic District are delineated on a map on file
in the Planning Division of the City of Orange entitled"Old Towne Boundaries"as adopted under
Ordinance No. 15-98; and
WHEREAS, OMC Chapter 17.17 establishes that"application for a historic district shall
comply with the zoning amendment procedure for a change in the zoning district classification
upon designation approval by City Council as prescribed under OMC Section 17.10.020"; and
WHEREAS, a historic district overlay zone includes additional regulations over the base
zoning of a particular area to encourage historic preservation and complementary new
development. The Historic Preservation Design Standards for Old Towne, incorporating the
Secretary of the Interior's Standards for the Treatment of Historic P operties, apply to all
properties within the boundaries of the local Old Towne Historic District; and
WHEREAS, the City Council directed the Community Development Department
Planning Division to proceed with expansion of the local Old Towne Historic District to include
properties on the west side of South Batavia Street in March 2018; and
WHEREAS, eight properties on the west side of South Batavia Street were identified as
historic resources in the City's Historic Resources Survey completed in 1991; and
WHEREAS, the City Council adopted the City of Orange 2010 Historic Resources
Inventory Update,including the survey results from 1991,through Resolution No. 10426 in March
2010; and
WHEREAS, in April 2018, Historic Preservation staff, meeting the Secretary of the
Interior's Professional Qualifications Standards for architectural history, surveyed the area and
determined that the 100 and 200 blocks of South Batavia Street contain a concentration of intact
historic properties constructed prior to 1940 that are eligible for inclusion in the local Old Towne
Historic District; and
WHEREAS, Historic Preservation staff conducted community information sessions for
potentially affected property owners on June 27, 2018 and July 12, 2018; and
WHEREAS, the Planning Commission, having considered Zone Change No. 1289-18 at
a public hearing held on August 20, 2018, including review of the staff report and having invited
public testimony on the item, has determined the proposed amendment is justified and
recommends approval thereof; and
WHEREAS, the City Council held a duly advertised public hearing on October 9, 2018
for the purpose of considering Zone Change No. 1289-18 as it pertains to the expansion of the
local Old Towne Historic District as shown in the attached Exhibits"A", "B", and"C."
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE DOES
ORDAIN AS FOLLOWS:
SECTION I:
The existing local Old Towne Historic District is depicted on the map attached hereto as Exhibit
A" and incorporated herein by reference. The boundaries of the Old Towne Historic District are
amended to include the 12 properties on South Batavia Street depicted on the map attached hereto
as Exhibit"B" and incorporated herein by reference. The "Old Towne Boundaries" map adopted
in OMC 17.17.030 is hereby amended to depict the change in the local Old Towne Historic District
established by Zone Change No. 1289-18.
The contributing and non-contributing properties within the expansion area are depicted on the
map in Exhibit"B"and described in the historic resources survey forms attached hereto as Exhibit
C" and incorporated herein by reference. The City of Orange Historic Resources Inventory is
hereby updated to include the historic resources survey forms attached hereto as E ibit"C."
SECTION II:
The historic district overlay zone described in Section I is related to the public welfare and is
categorically exempt from the provisions of the California Environmental Quality Act (CEQA)
per State CEQA Guidelines 15308 (Class 8 —Actions by Regulatory Agencies for Protection of
the Environment) and 15331 (Class 31 —Historical Resource Restoration/Rehabilitation).

The overlay zone is established for the protection of historic resources and makes no changes to
the land uses permitted by the base zoning. The regulatory process for projects within the historic
district overlay zone involves review to ensure conformance with the Secretary of the Interior's
Standards for the Treatment of Historic Properties (SOI Standards). The Historic Preservation
Design Standards for Old Towne, required for projects within the Historic District, are consistent
with and incorporate the SOI Standards. Expansion of the overlay zone ensures that additional
historic resources and the Old Towne Historic District as a whole will be preserved and protected
from changes that may affect the integrity of its historic character, design, materials, and features.
SECTION III:
General Plan Consistencv
The project achieves goals of the General Plan Cultural Resources and Historic Preservation
Element and the Implementation Program. The expansion of the Historic District's boundaries
provides long-term assurance that additional historic properties will be used, maintained, and
rehabilitated in conformance with the Secretary of the Interior's Standards for the Treatment of
Historic P operties (SOI Standards). Projects in the local Historic District are reviewed for
conformance with the Historic Preservation Design Standards for Old Towne,which are consistent
with and reference the SOI Standa ds. Inclusion in the local Historic District also provides access
to incentives for preservation including the Mills Act Program and California Historical Building
Code.
Consistent with the General Plan Implementation Program for Historic, Cultural, and
Archaeological Resources Surveys,the expansion of the Historic District's boundaries recognizes
a small concentration of historic resources that reflects a unique sense of time and place and
establishes a design review process for its protection.
Historic District Criteria (OMC 17.17.050)
An historic district may be established to preserve landmarks and areas exempla y of
architectural, archaeological, cultural, economic, social, or historical value if the landmark or
area meets the following criteria:
A. The resource exemplifies or reflects special elements of the City's cultural, social,
economic,political, aesthetic, engineering, architectural or natural history and possesses
an integrity of location, design, setting, materials, workmanship,feeling and association;
and
1. It embodies distinctive characteristics of a style, type, period or method of
construction, or is a valuable example of the use of indigenous mate ials or
craftsmanship; or
2. It contributes to the significance of an historic area, being a geographically
definable area possessing a concentration of historic oN scenic properties or
thematically related grouping ofproperties which contribute to each other and are
unified aesthetically, by plan or physical development; or

3. It reflects significant geographical patterns, including those associated with
different eras of settlement and growth, particular transportation modes, or
distinctive examples ofpark or community planning; or
4. It embodies elements of architectural design, detail, materials, or craftsmanship
that Nepresent a significant str uctural or architectural achievement or innovation;

5. It has a unique location or singular physical characteristic or is a view or vista
rep esenting an established and familiar visual feature of a neighborhood,
community or the City of Orange.
The local Old Towne Historic District embodies the cultural and architectural history of
late 19th and early 20th century Orange County.The Historic District represents the original
residential community,central business district, and industrial area of Orange with historic
buildings dating from the 1880s through 1940. The houses throughout the Historic District
represent the popular residential architectural styles of the period,including Folk Victorian,
Craftsman, Tudor Revival, and Spanish Colonial Revival.
The 100 and 200 blocks of the west side of South Batavia Street contain a concentration of
residences representing the themes of early development and growth of the City of Orange,
consistent with the existing Historic District. The houses are distinctive examples of the
architectural styles prevalent in the Old Towne Historic District. These blocks, combined
with the east side of South Batavia Street within the Old Towne Historic District, have a
high degree of integrity of design,setting,materials,workmanship,feeling and association.
Of the 12 properties proposed for inclusion in the Historic District, 11 are contributing
historic properties. The one non-contributing property was constructed after 1940, outside
of the period of significance for the Historic District. Including these properties within the
boundaries of the Old Towne Historic District will protect these historic resources and the
Historic District as a whole from incompatible changes that alter the character of the
historic neighborhood.
B. It is one of the few remaining examples in the City, region, state, or nation possessing
distinguishing characteristics of an architectural or historical type, or specimen; or
The 100 and 200 blocks of the west side of South Batavia Street are characteristic of the
historical development and architectural styles of the City of Orange from the late 19th and
early 20th centuries. This area is contiguous with and represents the same distinguishing
characteristics and themes as the Old Towne Historic District, which is one of the few
remaining intact historic downtowns from this period in Orange County.
C. It is identified with persons or events significant in local, state o national history; or
The Old Towne Historic District was originally designated as a representation of the broad
patterns of development in the history of Orange, rather than for its association with a
specific event or person. This criterion does not apply.

D. It is representative of the work of a notable builder, designer or architect.
The buildings throughout the Historic District are vernacular examples of late 19th and
early 20th century architectural styles and are rarely identifiable as the work of a specific
builder, designer, or architect. This criterion does not apply.
SECTION IV:
A summary of this ordinance shall be published and a certified copy of the full text of this
ordinance shall be posted in the Office of the City Clerk at least 5 days prior to the City Council
meeting at which this ordinance is adopted. A summary of this ordinance shall also be published
once within 15 days after the ordinance's passage in a newspaper of general circulation,published,
and circulated in the City of Orange. The City Clerk shall post in the Office of the City Clerk a
certified copy of the full text of such adopted ordinance along with the names of those City
Councilmembers voting for and against the ordinance in accordance of Government Code Section
36933. This ordinance shall take effect 30 days from and after the date of its final passage.

Opportu111tles The house is an excellent example of ita architectural style. Appeara individually eligible
fo= National Regiater of Historic Places.
History oE Ownership: James M. and Emily D. Marsh, citrus ranchers, lived at the propezty from 1919 to
1922. Neil H. and Viva Edgar lived here in 1923. Mr. Edgar was part owner in Edgar and Hays Company in
Santa Ana. In early 1924, they sold the house to Frank E. and Nellie Miles, and moved to 2302 Spurgeon in
Santa Ana. Mr. Miles was a pioneer in the grocery business, and had operated qrocery stores in Goldfield,
Nevada and Pomona, California before coming to Santa Ana in 1913. He opened a new store thexe and soon had
outlets in Orange, Anaheim, Fullerton and Garden Grove. He sold that firm after a few yeazs, then started
a new chain with stores in Orange, Anaheim and Fullerton and a bakery in Tustin. Around 1919, he sold out
to Acme chain. Mr. and Mrs. Miles had a son, Frank E. Jr., listed as a student, clerk and later, in 1930,
as an operator in

the Community Service Station, 224 E. Chapman. In 1932, another Miles, Glenn R. was also listed as a
resident. He was an operator with Standard Stations, Inc. The Miles family lived here until 1933 when the
financial pains of the Great Depression cost them the home. Mr. Miles retained his ranch in Lemon Heights,
where he died in 1950 at the age of 73. In September of 1937, the house was purchased by Edwin Gould for
5,500. Gould had moved from Wisconsin and become the manager of the Anaconda Wire & Cable Company,
Orange's first successful large-scale industrial plant. He was active in many social and fraternal
organizations and also served on the Orange High School Board of Tzustees. He lived in the house until he
died at 67 in January 1963. His widow, Alma, continued to live here after that. His son, Richard, was the
proprietor of Orange Camera and Photo in the Plaza.

The house was constructed in 1940 by Roy R. Russell a prominent contractor and real estate entrepreneur,
who built and sold houses throughout the Santa Ana and Orange areas. Yn 1941, Vera Wettlin purchased the
house as her sole and separate property, where she lived with her husband David Wettlin and their children
until 1954. From 1935 to 1954, Vera Wettlin served as the City of orange Postmaster, a federally appointed
position, and was the primary income earner for her family. She served as Postmaster during the dedication
of the new Post Office at 308 W. Chapman Avenue in 1935. She was Postmaster when the Orange Post Office
zeceived first class office status, the highest class rating in the Postal Service, and was present at the
first airmail drop in the City in the summer of 1996. Her tenure ended in 1959, having completed 20 years

Wettlin's position as PostmasCez, her professional and civic life, and her homeownership reflect the
slowly increasing number of women in the workforce during the mid-twentieth century and the reality of
women s roles as income earners and heads of households from the Great Depression through the 1950s.
Wettlin was a membez o£ a number of important Orange comnunity organizations, including the Toastmasters
and the Woman's Club, where she held the presidency for several terms. She was also an active member of
the Orange Business and Professional Women's Clvb, where she served as Public Relations Chair in 1941. As
a prominent member of the community, her home served as an important meeting place for these community
institutions.
The house retains the majority of its features from its construction in 1990 and through Vera Wettlin's
ownership of the house, which ended when she sold the house the same year as her retirement in 1954.

In October 1918, John W. and Gail C. Ybung purchased £our acres of land at 224 S. Batavia. At that time,
Batavia Street marked the western edge of the City limits, putting this property just over into county
territory. South Hatavia was then con5ldered an upscale neighborhood, populated by.gentlemen citrue
farmers. In 1919, he built this house on his property and lived and ranched here fos the next ten years.
In 1929, the house and land was aquired by John J. and Ida M. Callins, another I.ocal citrus rancher. Born
in Missouri, Mr. Collins had settled in Northern California in 1867 and in 1916 moved here. Collins
continued to live in this house until he retired from ranching in the late 1940s. His son, Ray Collins,
took over the groves at that time and moved into the house. John Collzns'died in April of 1950 at the age'

Original owners appear'to have been John and Oza Lee Porter. Mr. Porter was a cashier with the National
Bank of Orange. About 1940, the home was acquired by Judge French. David French became a resident of
Orange in 1937 and served as City Attorney from 1946 until he was appointed to the Santa Ana/Orange
Municipal Court bench in 1957 by Gov. Goodwin Knight. He was named to the Superior Court bench in August
of 1966 and retired in November of that same year but seemed to serve an occasional assignment on the
state judicial council. Among his other accomplishmenta was a term serving as trustee of the Orange
Unified School District, secretary of the Orange County Municipal Water,District and chairman of the
Orange Red Cross. Full history is contained in property's National Register designation fozm.
