A RESOLUTION OF THE CITY COUNCIL OF THE
CiTY OF ORA:\TGE AUTHORIZING SUBMISSION
OF AN APPLICATION TO THE STATE OF
CALIFORNIA DEPARTMENT OF PARKS AND
RECREATION FOR GRANT FUNDS UNDER THE
STATE URBAN PARKS AND HEALTHY
COMMUNITIES PROGRAM FOR A
GYMNASIUM/SPORTS CENTER AT GRIJALAVA
PARK.
WHEREAS, the people of the State of California have enacted the California Clean
Water, Clean Air, Safe Neighborhood Parks, and Coastal Protection Act of 2002 (the Act),
which makes funds available to eligible applicants in the form of grants through the State
Urban Parks and Healthy Communities Program (the Program) for the acquisition and
development of properties for active recreational purposes; and
WHEREAS, the California Department of Parks and Recreation (the Department) has
been delegated the responsibility for the administration of the Program and, to that end, has
developed a procedural guide to assist with the application and administration process for the
Program; and
WHEREAS, in order for the City to apply for the award of grant funds under the
Program, it is required to submit an authorizing resolution of this City Council to the
Department; and
WHEREAS, if a grant is awarded to it under the Program, the City will be required to
enter into a Contract with the State of California for the Project (defined below) to be funded
with the proceeds of the grant; and
WHEREAS, while the Department encourages California Environmental Quality Act
CEQA) compliance at the time of application, the Program permits the City to postpone final
CEQA compliance until one year from the grant award announcement by submitting at the time
of application an Initial Study and a description of how the City will complete the CEQA
process within one year from the grant award announcement; and
WHEREAS, an Initial Study has been prepared by the City and a subsequent mitigated
negative declaration is currently being prepared to address changes in the project not previously
identified and analyzed in that certain Initial Study and Mitigated Negative Declaration (ENV
1601 -99), dated October 1999 and prepared in conjunction with the City Council's approval (Of
a conceptual site plan for Grijalva Park on November 23, 1999; and
WHEREAS, the City Council desires to apply to the Department for a grant of funds
from the Program to help the City pay for a portion of the cost of construction and development
of a gymnasium/sports center at Grijalva Park (the Project),
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange
as follows:
I, The foregoing recitals are true and correct; and
2, The City Council hereby approves the filing of an application for local
assistance funds from the State Urban Parks and Healthy Communities Program under
the California Clean Water, Clean Air, Safe Neighborhood Parks and Coastal Protection
Act of 2002; and
3, The City Council certifies that the City has or will have sufficient funds to
operate and maintain the Project; and
4, The City Council certifies that the Applicant has reviewed, understands, and
agrees to the General Provisions contained in the Contract shown in the Procedural Guide; and
5, The City Council certifies that the City has or will have available, prior to
commencement of any work on the Project, the proportional Match; and
6, The City Council certifies that the Project conforms to the Open Space and
Conservation Element of the City of Orange General Plan and the City of Orange Master Plan
for Park Facilities, Recreation and Community Services,
7, The City Council hereby appoints the City Manager (or his desigl1ee) as agent to
conduct all negotiations, execute and submit all documents including, but not limited to,
applications, agreements, payment requests and so on, which he may deem necessary or
advisable for the completion of the Project in accordance with this Resolution,
