A RESOLUTION OF THE CITY COUNCIL OF TIm CITY
OF ORANGE MAKING CERTAIN FINDINGS UNDER
THE CALIFORNIA ENVIRONMENTAL QUALITY ACT;
ADOPTING AN ADDENDUM TO THE FINAL INITIAL
STUDY AND MITIGATED NEGATIVE DECLARATION
FOR THE ORANGE MAIN LIBRARY EXPANSION; AND
APPROVING PLANS, SPECIFICATIONS AND
CONTRACT DOCUMENTS AND AUTHORIZING
NOTICE INVITING BIDS FOR CONSTRUCTION OF THE
ORANGE MAIN LIBRARY EXPANSION.
WHEREAS, on May 28, 2002 at a regular meeting of its members, the City Council of
the City of Orange (the City Council) approved conceptual design plans for the proposed
expansion of the City's Main Library (the Project) and authorized the City's Director of Pub lie
Works/City Engineer to prepare, or cause to be prepared, final plans and specifications and
contract documents sufficient in detail to invite bids for construction of the Project; and
WHEREAS, prior to approving the conceptual design plans for the Project, an Initial
Study was prepared by the City of Orange, as the lead agency, under the California
Environmental Quality Act (CEQA) to evaluate the Project; i,e" to ascertain whether the
Project, as proposed, would have a significant adverse effect on the environment and whether
there would be any environmental impacts resulting from the Project which might require the
preparation of a negative declaration or an environmental impact report; and
WHEREAS, as a result of the environmental review and because it appeared that the
Project's potential significant advers,e effects could be mitigated to the extent that the Project
would not have a significant effect on the environment, that certain Final Initial Study and
Mitigated Negative Declaration for the Orange Main Library Expansion Project, dated May
2002 (the MND), was prepared by the City and adopted by the City Council in accordance with
CEQA and the State CEQA Guidelines at its regular meeting on May 28, 2002; and
WHEREAS, final plans and specifications and contract documents sufficient in detail
to invite bids for construction of the Project have been prepared by LPA, Inc, at the direction
and under the supervision of the City"s Director of Public Works/City Engineer. The plans and
specifications are entitled City of Orange Main Library Expansion, Stalle Library Project No,
1041 and are dated as of September ]15, 2004 (the Plans), The Plans are public records on file
in the office of the Director of Public Works/City Engineer at 300 E, Chapman Avenue, Orange,
California 92866; and
WHEREAS, as the Plans were being developed for the Project, minor changes and
refinements to the Project were recommended and made, including the incorporation of the
historic civic center fountain, a corresponding decrease in the number of parking spaces, and an
increase in the height of the new building; and
WHEREAS, Section 15164 of the State CEQA Guidelines provides a way for the City
to update, amplify and make changes or additions to a previously adopted negailive declaration
in situations where a subsequent negative declaration is not required, According to Section
15164, the City must prepare an addendum to the MND if some changes or additions are
necessary but none of the conditions described in Section 15162 [of the State CEQA
Guidelines] calling for the preparation of a subsequent [environmental impact report] or
negative declaration have occurred; and
WHEREAS, as a result of those proposed revisions to the Project, the City has prepared
an Addendum to the MND in the form presented to the City Council at its regular meeting of
October 26, 2004 because it appears that "none of the conditions described in Section 15162 [of
the State CEQA Guidelines] calling for the preparation of a subsequent EIR or negative
declaration have occurred"; and
WHEREAS, this City Council has reviewed and considered the infonnation contained
in the Addendum to the MND and, as the "lead agency" under CEQA, finds and determines that
the Addendum is all that is necessary in connection with the proposed Project, as revised, and
the approval of the Plans and all other actions authorized by this Resolution; and
WHEREAS, this City Council desires to approve the Plans and all contract documents
prepared by or at the direction of the City's Director of Public Works/City Engineer (including,
but not limited to, a notice inviting bids and the bid package) (collectively referred to herein as
the Contract Documents) and to authorize the City's Director of Public Works/City Engineer to
advertise for bids for the Project in accordance with the requirements of the City's Purchasing
Ordinance and, specifically, Sections 3,08,530 through 3,08,590 of the Orange Municipal
Code; and
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Orange,
on the basis of the facts set forth in the agenda report presented to it and any testimony received
at the meeting at which this matter was considered, as follows:
1. The City Council finds and determines that the foregoing recitals are true and
correct.
2, Based upon its consideration of the recommendation of staff, testimony received at
its regular meeting, and considering the Addendum to the MND and such other materials which
constitute the record of proceedings upon which its decision was based, the City Council finds
and determines that "none of the conditions described in Section 15162 [of the State CEQA
Guidelines] calling for the preparation of a subsequent EIR or negative declaration have
occurred", Accordingly, this City Council hereby adopts the Addendum to the MND in the
form presented at its meeting,
3, The Plans and all other Contract Documents for the Project are hereby approved
and adopted and the City's Director of Public Works/City Engineer (or his designee) is hereby
authorized and directed to advertise for bids in accordance with the requirements of the City's

Purchasing Ordinance and, specifically, Sections 3,08,530 through 3,08,590 of the Orange
Municipal Code, and to do any and all things he deems necessary or advisable in order to carry
out, give effect to and comply with the terms and intent of this Resolution,
ADOPTED this 26th day of October, 2004,
