RES-9913 Immanuel Lutheran Church Specific Plan ApprovalRESOLUTION NO. 9913 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ORANGE APPROVING THE IMMANUEL LUTHERAN CHURCH SPECIFIC PLAN TO ACCOMMODATE FUTURE DEVELOPMENT OF THE CHURCH AND SCHOOL CAMPUS LOCATED AT 802 EAST CHAPMAN AVENUE, 137 AND 147 SOUTH PINE STREET. APPLICANT: IMMANUEL LUTHERAN CHURCH WHEREAS, the Immanuel Lutheran Church has filed an application with the City requesting a Specific Plan to allow the future development of the church and school campus on property located at 802 East Chapman Avenue, 137 and 147 South Pine Street; and WHEREAS, the Planning Commission reviewed the Immanuel Lutheran Church Specific Plan; and WHEREAS, the City Council has held a duly advertised public hearing on September 14, 2004 for the purpose of considering, among other things, the Immanuel Lutheran Church Specific Plan, the existing boundaries of the Specific Plan as described in Exhibit A; and WHEREAS, in compliance with the California Environmental Quality Act (CEQA) the State CEQA Guidelines the City has prepared Mitigated Negative Declaration (MND) No, 1718-03 to evaluate the potential adverse environmental effects of the project, including the Immanuel Lutheran Church Specific Plan; and WHEREAS, by Resolution No, 9912 the City Council approved and adopted MND No, 1718-03 at a legally noticed public hearing,NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF ORANGE MAKES THE FOLLOWING FINDINGS:L Mitigated Negative Declaration (MND) No, 1718-03 was considered prior to approval of the Immanuel Lutheran Church Specific Plan and determined to adequately address all potential adverse environmental impacts of the proposed project and meets all CEQA and City requirements.2, That findings and a Mitigation Monitoring Program have been adopted in accordance with CEQA Guidelines and the City Council finds that any potential significant adverse impacts can be mitigated to a level of insignificance, and therefore, the project will not significantly impact the environment 3, That the Immanuel Lutheran Church Specific Plan text establishes the development standards for the Public Institution (PI) land use designation for the Immanuel Lutheran Church and School campus established by Zone Change No, 1220-03, Upon City Council approval of the Zone Change the City's Zoning Map will be updated EXHBIT A DESCRIPTION THE LAND REFERRED TO HEREIN IS SITUATED IN THE STATE OF CALIFORNIA. PURPOSE AND INTENT OF THE ILC.SP The Immanuel Lutheran Church Specific Plan ("llC-Specific Plan") is a regulatary plan that establishes the land use and development standards and design guidelines for the subject properties under Immanuel Lutheran Church ("IlC") ownership as shown on Exhibit A and described in Appendix B, The ILC Specific Plan is intended to provide comprehensive guidance for the development, enhancement and preservation of the IlC Campus through policies, procedures and phased de,velopment plans which are specifically tailored to the special physical features and historically significant characteristics of the subject properties,B. AUTHORITY AND SCOPE The IlC Specific Plan has been prepared in accordance with the statutes contained in California Government Code 965450 through 9 65457, which authorizes the preparation and adoption of a Specific Plan as a systematic implementation of the General Plan, A consultant hired by Immanuel Lutheran Church has prepared this Plan.C. PROJECT LOCATION The Immanuel Lutheran Church Campus is located in the City of Orange, California, All of the properties under current church ownership are located within the boundary of the city's Old Towne District, see Exhibit B, as defined by the Historic Preservation Element of the Generai Plan and as delineated on a map entitled "Old Towne Boundaries" on file in the City's Planning Division. I=urther, all of the properties are also within the National Register Historic District contained within Old Towne.The Church Sanctuary is the only building with frontage on East Chapman one of the four Old Towne Spoke Street Corridors. All other prope,rties and buildings on Pine Street are considered to be within a Residential Quadrant of Old Towne.D. SPECIFIC PLAN BOUNDARY L Initial Boundarv The initial Specific Plan boundary proposed by this Plan, at the time of its preparation is defined by the legal property lines of the various parcels as delineated on Exhibit A. See Appendix B for complete legal Descriptions, Grant Deed and Title Report,2, Future Expansion This Specific Plan provides for the expansion of the Plan Boundary through the purchase, lease or other lawful acquisition of real property whether or not contiguous with the currently owned parcels. Boundary modifications require amendment to this plan in accordance with IlC-SP Sec 4, B3.ILC-SP Sectian Immanuel Lutheran Church Specific Plan E. PROJECT BACKGROUND 1. 2004 Zonina and General Plan Boundaries The ILC property is spiit into two General Plan districts, as shown on Exhibit D. The Old Towne Mixed Use (OT) classification covers the property along Chapman Avenue. while the Low Medium Density Residential (LMDR) classification applies to the Pine Street parcels. A Floor Area Ratio ("FAR") of 0,5 is allowed in the OT classification, while a residential density of 6-15 dwelling units per acre is allowed in the LMDR At present, two zoning designations apply to the campus, As delineated on Exhibit C, the Office Professional (O-P) zone applies to the property along Chapman Avenue, while the Duplex Residential R2-6) zone applies to the balance of the site bounded by Pine Street and Alrnond Street.The boundary between the zones bisects the existing fellowship hall resulting in some degree of unnecessary ambiguity as to which development standards actually apply to the structure. The existing Old Parsonage", the school buildings and the temporary modular classrooms are governed by the R2-6 standards that contain development regulations rnore appropriate for residential rather than church or school uses. The R2-6 standards presently allow an FAR of 0,70.These zoning designations require a Conditional Use Permit (" CUP") process for alteration or development projects related to church or school uses. For example, many of the development standards for the R2-6 zone, such as restriction on the number of stories. would require a CUP hearing to construct a two-story expansion onto the existing two-story school building. While this process in itself is not necessarily burdensome for individual projects, the need for repeated rnodlfications to a CUP presents further obstacles to the development of a unified and expanded campus, F. SPECIFIC PLAN OBJECTIVES 1, ILC Development Issues This Specific Plan attempts to address and remedy such issues as: fragmented zoning and development intensity covering the various parcels; an ambiguous zoning boundary that bisects the existing sanctuary/fellowship hall; buildings deemed "contributing structures" which no longer provide adequate floor area or room configurationfor the church's expanding needs; minimal off..street parking;management of vehicular traffic resulting from school activities; and present zoning that requires modification to a Conditional Use Permit for any aiteration to the existing Church or School Uses, G. RELATIONSHIP OF SPECIFIC PLAN TO OTHER REGULATIONS 1, City of Oranae General Plan a) Overall Relationship: The ILC Specific Plan is intended to be consistent with the City of Orange General Plan and form the baSiS for specific implementation of the General Plan; as such the General Plan shall have precedence. Projects that are found consistent with the Specific Plan shall be deemed consistent with the City's General Plan,b) Historic Preservation Element: This Specific Plan is intended to provide regulations, design guidelines, policies and procedures for the orderly development of the ILC Campus in a manner that meets the present and future needs of the church, while recognizing the unique historic and architectural quality of the Old Towne District, as well as the values and goals expressed in the Historic Preservation Element. As such, Historic Preservation Element Goal 1, Implementation 6, shall be the basis for the policies and values contained in this Plan with regard Immanuel Lutheran Church Specific Plan c) Land Use Element: This Specific Plan promotes good urban design in accordance with Land Use Goal 6.0 by recognizing and respecting the architectural style of the 01' the two dominant buildings Church and school) and promoting this style as the official style of the campus; and by promoting sensitive in-fill development along Pine street that both recognizes this streetscape as unique in the City of Orange and enhances the relationship of the building facades to the sidewalk traditionally revered as a key principle of vintage urban design,The design guidelines contained in this Specific Plan enhance and amplify the Old Town Design Standards, which have continued to playa significant role in maintaining the historic character of the district, and this is additional recognition of the importance of a continued commitment to revitalization efforts as expressed in Land Use Goal 7, 0 Conflicts with adjacent neighbors will be minimized in accordance with Land Use Policy 9.1, by means of land planning that maintains the overall pattern of buildings and open space on the carnpus as it has historically developed, The vast majority of building lot coverage will be positioned on the front half of the site towards Chapman, which is a continuation of the historical pattern of density.d) Circulation Element: The implementation of the Parking anel Traffic Management Plan is intended to promote a safe and efficient drop-off and pick-up operation for pre-school and elementary school students. while at the same time respecting and protecting to the greatest extent feasible the existing mature street trees along Pine Street in accordance with Circulation Goal 6.0.e) Housing Element: While this Specific Plan is not intended to directly address specific housing needs in the City of Orange, its implementation will have the beneficial effect of returning an historic home to residential use and thus further Housing Policies 1:' and 2.1,f) Open Space and Conservation Element: Provisions contained in this Specific Plan recognize the uniqueness of the mature Palm trees along Pine Street and are intended to ensure their continued health and preservation in furtherance of Open Space Policy 2.1. The implementation of this Specific Plan will have no adverse effect on local or regional air quality, groundwater replenishment, animal habitats or other natural resources.g) Noise Element: The implementation of this Specific Plan does not significantly alter the nature or location of sources of noise generated by existing uses on the Campus, Outdoor observances,services or other events shall comply with the temporary use permit provisions for Special Events contained in OMC.h) Safety Element: The implementation of this Specific Plan does not si()nificantly alter the public's exposure to either natural or man-made hazards. Appropriate provisions of the City of Orange Safety Ordinance for exterior illumination have been included in ILC- SP Sec 3 - Design Guidelines.2, City of Oranqe Zoninq Ordinance All terms used in this Specific Plan shall have the same meaning ascribed to t11em in the City of Orange Municipal Code ("OMC"), Chapter 17.04. Definitions contained in the OMC shall apply to this Specific Plan, except where terms have been specifically defined herein, In such case, the specific definition contained herein shall govern.The development standards, regulations, guidelines and procedures contain,ed in the City of Orange Zoning Code shall govern development projects covered by this Specific Plan except where those ILC- Immanuel Lutheran Church Specific Plan standards, regulations, guidelines, and procedures have been specifically modified, replaced or enhanced by this Specific Plan, 3, Old Towne Desion Standards This Specific Plan complements the regulations, guidelines and procedures contained in the Old Towne Design Standards ("OTDS''). All italicized terms used in this Specific Plan shall have the same meaning ascribed to them in Appendix A of the Standards, except where terms have been specifically defined herein, In such case, the specific definition contained herein shall govern. 4, California Environmental Qualitv Act Compliance The adoption of a Specific Plan is a "project" under the California Environmental Quaiity Act ("CEQA"), and is therefore subject to CEQA compliance, Based on the findings of an Initial Study, Mitigated Negative Declaration No, 1718-03 has been prepared under separate cover.Future projects and development intensity which are consistent with this Specific Plan and were anticipated in the Initial Study require no additional environmental review. Other future projects that are required to be consistent with this Specific Plan, such as boundary expansion, modifications to properties acquired in the future or changes to contributing structures that could not be identified under the Initial Study, may require additional environmental review depending upon their scope and magnitude,5, California Buildino Standards Codes All demolition, construction, alteration, repair, renovation or addition to buildings, structures or appurtenances covered by this Specific Plan shall comply with the all applicable provisions of the California Building Standards Codes, including barrier-free access requirements, as adopted and/or amended by the City of Orange at the time of permit issuance for such construction.H. PROJECTS REQUIRED TO BE CONSISTENT WITH THE SPECIFIC PLAN All development projects within the Specific Plan boundary including expansion or modification of existing uses and structures; new uses and structures, whether permanent or temporary; demolition or relocation of existing structures; and development agreements that may occur after the adoption of this Plan shall conform to the development standards and design guidelines, and procedurEls set forth in this Plan,All consolidations of real property, including lot ties or lot mergers, that occur after the adoption date of this Specific Pian, that may be undertaken as an implementation measure of tile Phasing Plan contained herein, shall be consistent with and governed by this Specific Plan,ILC-SP Section Immanuel Lutheran Church Specific Plan SECTION 2 LAND USE PLANNING and DEVELOPMENT STANDARDS A. PURPOSE AND INTENT This section establishes the applicable zoning ordinances and development standards for the properties covered by this Specific Plan, Special consideration has been given to ensure the development of a coherent ILC campus, while achieving compatibility with surrounding commercial/residential development. B. LAND USE PLAN 1, Objectives The primary objectives of the proposed Land Use ptan include: the development of a coherent campus environment; the development of physical facilities consistent with the church's educational mission of one-grade-one-c1assroom; the allocation of land uses in a manner that allows for flexibility when future growth occurs; and the creation of a campus that respects neighborhood compatibility,2, Policies As a means of achieving the land use objectives, the following policies shall guide future development:the use of "in-fill" construction as a method of linking existing buildings together physically and visually;the use of common outdoor spaces to functionally link buildings together; the enhancement of the existing pattern of uses and structures as a means for achieving neinhborhood compatibility; and the recognition that the existing church edifice is the dominant functional. symbolic and architectural feature of the campus.3. Development Plan The proposed Land Use Plan shown on Exhibit E integrates the land use objectives and policies of this Plan into the existing physical features of the campus, and shall nuide the development of the new buildings as may be constructed under the Phasinn Plan discussed in Sec 2, C, below, C. THE PHASING PLAN 1. Purpose and Intent The Phasing ptan proposed by ILC as shown on Exhibit F, is intended to clearly identify those projects specifically proposed to occur at the outset of Plan adoption. In addition, the Phasing Plan is intended to:function as one of the methods for the implementation of provisions contained in the Plan; ensure that future incremental growth occurs in orderly manner; enhance the expression of ILC's current religious missions; ensure thatlLC's current and future relinious missions have an ad, equate physical setting; and,form the basis of ILC's project financin~1 anenda,The ILC Specific Plan will implemented in accordance with the following phases:a)Phase 1 - Temporary Structures Already approved and in place)The two (2) existing modular structures erected under Temporary Use Permit #02-01 are intended to remain in place as classrooms until such time as a the New Early Childhood Education ("ECE") structure can be designed, approved and constructed, The modular structures will be removed and the site returned to its original use as a hard surface play ILC- Immanuel Lutheran Church Specific Plan area upon completion of the new facility. Any temporary structures that may from time to time may be required for the implementation of future projects not anticipated by this Phasing Plan shall be subject to the requirements of the Temporary Use Permit Ordinance, Future and existing modular structures shall be subject to the time limitations prescribed in this Specific Plan. See ILC-SP Sec 2, E1 (d) for time limits applicable to modular structures,b) Phase 2 - Kitchen Expansion An approximately 440 square foot kitchen expansion will enhance ILC's current kitchen facilities that are used from time to time for fellowship activities, and accommodate additional food preparGItion capacity as required to meet the school's goal of providing hot student meais, c) Phase 3 - New Early Childhood Education ("ECE") Building The existing "Parsonage" Building: Will be removed from its present location and relocated to another physical site with the intent of rehabilitating and re-using the structure. Site selection for such new iocation shall conform to the procedures described in ILC-SP Sec 4, D5,The existing non-contributing shed and trellis will be demolish<ed and the site prepared for new construction.The proposed ECE Building: Will permanently house three (3) elementary school classrooms presently located in the temporary modular structures erected under Phase One, as well as daycare facilities, faculty offices and educational multi- purpose rooms in an effort to meet the school's goal of "one grade-level - one classroom". It is anticipated that the proposed structure will be a two-story building having a total floor area that will not exceed the range of 8,000 to 1 0,000 square feel. See ILC-SP Sec 2. E5 (a)1 for off-street parking required for completion of this phase.2, Proiect FinancinQ All projects on the tLC Campus, including boundary expansion are dependent upon available funding and anticipated expenditures, as determined solely by ILC.3. Boundary Modifications ILC may amend this Plan from time to time to alter the boundary of the Campus as new parcels are acquired in an effort to accommodate ~Irowth, At the time of Plan adoption, it is anticipated that the Campus will increase in size, and that a decrease in size is highly unlikely even though the Plan contains provisions that address such an event Particular issues related to the incremental growth of the Specific Plan boundary include: the availability and affordability of adjacent parcels for purchase; the nature of the uses and structures, if any, located on such available parcels; and the likelihood that such existing adjacent uses and structures can be incorporated into the pattern of the Campus.ILC- Immanuel Lutheran Church Specific Plan D. LAND USE REGULATIONS 1. Applicable Zone Desiqnation The zone designation applicable to the properties covered by this Specific Plan shall be the Public Institution CPI") zone contained in OMC ~ 17,24, except as may be modified by this Specific Plan. 2. Violations Violations of the provisions and regulations contained in this Specific Plan or other relevant ordinance may be subject to the legal procedures for abatement and removal in accordance with OMC ~ 17,02,030, E. DEVELOPMENT STANDARDS 1 , Principal Uses and Structures Even though the exact nature, location. use and size of all future projects is not fully determinable at the time of Plan adoption. it is the intent of the Plan that future uses and structures be consistent with the Land Use Plan shown on Exhibit E and be implemented in conjunction with the Phasing Plan shown on Exhibit F. The intent of this Section is to ciearly identify possible land uses that will be deemed consistent with the Plan, When any permitted uses are proposed after Plan adoption, they shall comply to the provisions of the Plan, a) Permitted Uses and Structures The following uses and structures are permitted under this Specific Plan: Administrative offices tor church or school Athletic fields and facilities Auditoria and multi-purpose rooms Churches Sanctuaries and chapE, ls Classrooms Day care and child care facilities Educational seminars and conferences Fellowship Halls Faculty offices Kitchen and food preparation facilities Libraries and reading rooms, whether church or school related Open space Permanent outdoor storage, fully screened Parking areas Playground areas, lots and equipment Temporary outdoor storage for construction activities b) Unlisted Uses and Structures Uses not enumerated in ILC-SP Sec 2, E1 (a), above may be found permissible by the Community Development Director when a determination is made that any of the following conditions occur:1) the proposed use is consistent with the intent of this Specific Plan;2) the proposed use is a consequence of or required by other permitted uses; or,ILC-SP Section 2 Page Immanuel Lutheran Church Specific Plan 3) the proposed use is permitted outright or permitted as an accessory use by the Public Institution Zone contained in OMC S 17,24, Determinations rendemd by the Community Development Director are subject to the same processes for resolving plan interpretation and applicability as contained in tLC- SP Sec 4, C3 of this Plan.c) Non-conforming Uses and Structures Land uses and structures lawfully existing at the time of the adoption of this Plan, but which would not be permitted after its adoption by some provision(s) restricting use,location, area. setback, height, or other characteristic, shall be deemed a legal nonconforming use or structure, Such legal nonconforming use or structure may continue and be maintained, provided that it complies with the requirements of OMC S 17.38, except as may be modified by this Specific Plan,Notwithstanding the general prohibitions on expansion or alteration of non-conforming uses or structures contained OMC S 17.38, non-conforming structures may be expanded,altered, added to or changed provided that:1) such alteration or change reduces its non-conformity; or 2) such alteration. expansion or addition is undertaken to increase or enhance barrier-free aceessibility;tn the event that a noneonforming structure is damaged or destroyed by any means, to an extent greater than 75 percent of its replacement cost at the time of such destruction,it shall not be reconstrueted unless it shall thereafter be in eonformance with the provisions of this Plan, Not withstanding this general prohibition, the Church Sanctuary or any portion thereof, may be reconstrueted to the same condition, location, size, floor area and height of its existence at the time of adoption of this Plan regardless of the extent. nature or cause of its damage or destruction. All required building permits shall be issued within two (2) years from the date of damage, with Gonstruetion commeneing within 180 days after permit issuance and pursued diligently to completion, Failure to obtain permits or eommence construction within these specified time periods shall result in the revoeation of the structure's non- eonforming status.d) Temporary Uses and Structures Temporary uses and their assoeiated structures if any, whether of a recurring or nonrecurring nature, shall comply with the temporary use permit provisions contained in OMC S 17,10,035 in effect at the time such use is requested, except as speeifiealiy modified by this Specific Plan.Prefabricated modular structures are temporarily permitted, pmvided that:1) such structures are used for school, classroom or church related uses, and not used as residences;2) the total number of modular structures on the campus at anyone time does not exceed four (4), and;3) such structures as may exist and been lawfully approved at the time of adoption of this Plan shall be allowed to eontinue for a period not exceeding eight (8) years from the date of Plan adoption.Outdoors observances, pageants, memorial services, coneerts, exhibitions. and similar events of a religious or educational nature are permitted on a temporary basis, provided that they complywith tl1e provisions of OMC S 17.46, Special Immanuel Lutheran Church Specific Plan Temporary parking lots or areas that may be required on an interim basis or for a temporary use shall conform to the provisions of OMC S 17,34.140 in effect at the time such use is requested. 2. Specific Plan Floor Area Ratio (FAR.) The Floor Area Ratio ("FAR.") for properties covered by this Specific Plan, whether included presently or in the future, shall not exceed 0,55 as averaged over the aggregate land area covered, See Exhibit G for an inventory of floor areas existing at the time of Plan adoption, and Exhibit H for a summary of the Floor Area Ratios existing at the time of Plan adoption, 3. Buildinq Setbacks and Yard Requirements All building setbacks and yards, as shown on Exhibit I, shall be determined parallel to and as the perpendicular distance from a property line, The Front yard for the campus shall be Chapman Avenue as determined in conjunction with prior City of Orange approvals, a)Front Yard: Chapman Avenue) Ten (10) feet, except where the property fronts on a block within a residential zone, the front yard shall be the same as required for the residential zone b)Side Yard (interior):zero feet; except where a property abuts a residential zone and the structure exceeds one story or t,y,enty (20) feet in height, side yards shall be at least ten (10) feet c)Street Side Yard Pine Street) Ten (10) feet d)Rear Yard: Almond Street) zero feet; except where a property abuts a residential zone and the structure exceeds one story or twenty (20) feet in height, rear yards shall be at least ten (10) feet 4. Buildinq Heiqhts Buildings shall not exceed 32 feet or two (2) stories height, which ever is less with the exception of the tower of the Church Sanctuary which shall be allowed to maintain is current height of 102 feet above grade, Under no circumstances shall any building or structure exceed the height of the bell tower as it exists at the time of Plan adoption, 5, Off-Street Parkinq a) Parking Requirements 1) Required Number of Parking Stalls Shall be in accordance with OMC Table 17,34,060 (B) current at the time of Plan adoption, except as modified by this Specific Plan,School-related required parking shall be 25 stalls, provided that the total number of permanent elementary school classrooms does rlat exceed 9 ( as approved with Administrative Adjustment No, 2002-0004). Any facility expansion beyond the specific activities identified in the Specific Plan phasing shall comply with OMC,ILC-SP Sectian Immanuel Lutheran Church Specific Plan Bicycle storage shall be in accordance with OMC 917,34,080, Motorcycle parking per OMC 917.34080 shall not be required. 2) Parking Area Dimensions Shall be in accordance with OMC 917,34,110 current at the lime of Specific Plan adoption, Stall marking shall conform to OMC 917.34.130 for double striped markings. The maximum vehicle overhang into landscaped areas shall be 2'-0". 3) Parking Setbacks Front Yard: Where parking areas occur in the front yard setback along Chapman Avenue at the time of Specific Plan adoption, they shall be allowed to remain as a legal non- conforming condition, Neither the 10 foot landscaped parking setback required by OMC 917.24,070 nor the 15 foot landscaped par!king setback required by OTDS shall be required along Chapman Avenue, At any point in the future should additional property be acquired for the purpose of expanding parking facilities, new or expended parking facilities shall comply with the landscape standards set forth in OMC 917.34,110, Side Yards Interior Yard: Corner Yard: Zero feet Zero feet Rear Yard:Zero feet. The 3 foot landscaped parking setback required by OTDS shall not be required, For required screening of parking areas that abut resi,jential zones, see ILC- SP Sec 3, F3 - "Site Fences and Walls", 4) t.oading Areas The 50 lineal feet of curb side loading/unloading area required for churches in accordance with OMC 917,34.160 is located along the easterly right of way of Pine Street. The loading/unloading areas for daycare facilities shall be as close as possible to the main building entrance in accordance with OMC 917,34,180, 5) Related Site Design Standards The following sections of this Plan apply to off-street parking areas and shall be incorporated into the design of new areas and majol" modifications of existing areas: ILC-SP Sec 3, F3 - "Site Fences and Walls"; and, ILC-SP Sec 3, F1 -On- site Landscaping",b) Traffic and Parking Study Separate Traffic & Parking Management Plan (dated March 2002 and updated in April 2004) has been prepared that documents school pick-up and drop-off procedures, as well as parking conditions related to special church and school events, This Management Plan is incorporated by reference and shall guide all school- related traffic and parking activities,ILC- Immanuel Lutheran Church Specific Plan 6, Street Trees ILC shall endeavor to preserve the existing Mexican Fan Palm Trees along the easterly Right of way of Pine Street, including their replacement if temporarily or permanently removed for any reason, Any tree removal and replacement shall be subject to compliance with the City's Tree Preservation Ordinance, A Tree Removal Permit shall be obtained for removal of any street trees and refllacement done in consultation with the City of Orange, Street Tree Coordinator. ILC-SP Section 2 Page 15 - Immanuel Lutheran Church Specific Plan SECTION 3 DESIGN GUIDELINES A. PURPOSE AND INTENT This section establishes the design guidelines for the properties covered by this specific plan. The intent of these guidelines is to ensure a high quality campus worthy of one of the cornmunity's prorninent religious congregations by establishing design criteria that will assist design professionals during design and planning of future projects; assist church membership in developing maintenance and repair agendas; and assist governmental review bodies in the determination as to the merits of future project proposals. B. DESIGN GOALS 1, Historic Preservation To preserve the architectural character of the existing church edifice and the original school building, and guide future development in a manner that enhances and respects the prominence of both these buildings, See Exhibit J for a surnrnary of the historic status of buildings on the ILC campus that exist at the time of Specific Plan adoption, See Exhibits K, L, & M for specific data on individual buildings. 2, Neiqhborhood Context To create a campus environment that is compatible with and complements the surrounding residential and commercial neighborhoods, land-uses and architectural characters.3, Campus Quality To create a unified and cohesive campus identity based upon the architectural character of the dominant existing buildings along Pine Street C. SITE PLANNING 1, Buildinq Placement Future buildings shall be placed on the campus in a manner that enhances the streetscapes at the campus perimeter and is consistent with the sense of scale, building massin!J, building setbacks and overall architectural character of the particular street frontage, Buildings immediately adjacent to a street-scape shall have at least one pedestrian entrance that faces the public right of way, Buildings shall not turn their back to the street-scape,2, Open Space The rhythm of buildings and open spaces between buildings shall be consistent with the particular street frontage that the buildings face,Open space intended for recreational and athletic uses shall be grouped together to the greatest extent possible, The fragmentation of such open space is discouraged and shall be minimized to the greatest extent possible,ILC-SP Sectian Immanuel Lutheran Church Specific Plan 3, LoadinQ. BUILDING FORM AND MASSING 1, Overall Form and MassinQ The overall form and massing of proposed buildings shall be consistent with lheir architectural style, For buildings adjacent to the church and scl1ool, low pitched tile roofs typically not 'exceeding 7 inches vertically in 12 inches horizontally with occasional smaller roof areas not exceeding 8 inches vertically in 12 inches horizontally are encouraged.Building massing shall have a clear hierarchy with distinctly dominant and secondary forms.ILC- Immanuel Lutheran Church Specific Plan 2. Roof Stvle, Shape and Geometry a) Towers and Spires The Existing Church tower shall be the dominant vertical arclliltectural element for the campus, and no building or structure shall exceed its height. b) Eaves and Overhangs Small eave overhangs, typically with cornice molding below or exposed rafter tails of nominal 4 inch wide lumber are encouraged, In addition. rake overhangs should be small, typically no more than 8" to 12", E. ARCHITECTURAL CHARACTER 1 , General DesiQn Principles a) Design Standards for Old Towne The design principles contained in this Specific Plan are intended to both complement those contained in the OTDS, and enhance the OTDS principles where appropriate for specific application to tile ILC Campus architecture, b) Historic Elements Exterior alterations, repairs or additions to contributing structures shall avoid possible damage or obscurity to the defining historic features of the olri(Jinal building or structure. c) Church and Old School as Stylistic Anchors This Specific Plan recognizes that the most dominant existing architectural style on the campus is the "Spanish Colonial Revival" Style of the Church edifice, with the Pine street fa~ade of the existing school building as a supportin!l style. Future uses and structures should be compatible with and support the style of these two buildings. In the event that the Specific Plan boundary is altered to include buildings and structures of architectural styles other than Spanish Colonial Revival the following guidelines apply: 1) Exterior alterations, repairs or additions to contributing structures shall be appropriate to and consistent with the style of the existing building: and, 2) Exterior alterations, repairs or additions to non-contlit'uting structures may include modifications intended to bring the existing style more into conformance with the Mission Revival style of the main campus,2, BuildinQ Facade Articulation a) Wall Surfaces Wall surfaces shall be designed to include trim, moldings, recesses and detail sufficient to convey the overall slyte, Large expanses of flat unadorned, un-fenestrated wall are discouraged, Additional detail and articulation along streetscape facades is encouraged to enhance their civic prominence.ILC-SP Sectian Immanuel Lutheran Church Specific Plan b) Columns and Pilasters Columns and pilasters, whether free-standing or part of the fa"ade. shall have sufficient detail at the base and capital to convey the overall stylistic importance of such features.c) Lintels and Trim Lintels and trim should be incorporated around prominent doors, entry-ways and windows particularly along streetscape facades, as a method of unifying fenestration geometry and rhythm,d) Parapets and Com ices Horizontal level parapets shall be capped with clay tile. Sloping parapets may use the same exterior materials of the wall surfaces,3, Doorwavs, Entrances and Windows Doorways and entryways should be emphasized by means of fa"ade articulation treatments that may include lintels, pediments, pilasters or arches,Typical windows should have a rectangular shape with a vertical orientation proportioned appropriately for the style. Window spacing, rhythm, mullion divisions should be appropriate 10 the style as well, Accent windows may be circular, oriel, or arch-topped and placed for emphasis as appropriate to the style,Door and Window frames may be wood or painted metal.Preferred glazing typesinclude clear, Ii!lht solar gray, or a stained glass composition appropriate for ecclesiastical architecture, Contemporary highly reflective glass is discoura(led unless part of a stained glass window composition. Large horizontal expanses of glass are specifically discouraged.4. Porches, Trellises, Canopies and Awninqs Protective coverings for pedestrian protection against weather or sun-shade devices used to control solar access may include porches, colonnades, covered arcades, horizontal or vel1ical trellises provided such features are constructed with exterior materials recognized in Sec 3, E5 of this Plan,Canopies and Awnings shall be used only for sun-shade devices and shall be constructed either with exterior materials recognized by this Plan, or are fabricated with canvas in a color that accents the building,5, Exterior Materials, Finishes and Colors Exterior materials appropriate to the style may include plaster, stucco, wood, timber, stone or brick masonry, iron, clay tile, terra-cotta and copper. Roof covering materials exposed to view may include clay tile, slate, copper standing seam, asphalt shingle, and wood shake. Where roH-roofing or built-up cap sheet roofing are not an integral and defining feature of the style, their exposure to view should be minimized by means of parapets, screens or other vision obscuring architectural devices,Reflective wall and roof Immanuel Lutheran Church Specific Plan Exterior colors for the main body of the building shall be appropriate to the style and may include light earthen tones, Accent colors appropriate to the style are encouraged to accentuate the detailed elements of the style, and the important building components. EXTERIOR LIGHTING 1 , General Liqhtinq Guidelines a) Building Exterior Lighting All exterior commercial doors shall be illuminated for safety and security in accordance with OMC !}15.52, 090,In addition to providing safety and security, exterior building 1i9hting may be used to emphasize the importance of particular buildings; accentuate specific building features;accentuate landscape and hardscape features; orient and direct pedestrians along exterior pathways and at entrances/exits; illuminate signage; and provide illumination during evening and ni\lhttime activities,Not withstanding any provision, the existing spotlighting of the church tower shall be allowed to remain as it exists at the time of Plan adoption.Fixtures shall be selected, placed and integrated with the architecture such that glare from the light source is minimized, and that lights do not shine directiy on neighboring properties,b) Off-Street Parking Area Lighting Off-site parking areas shall be illuminated for safety and seGurity in accordance with OMC !} 15.52,090,Parking lot light fixtures shall be of a type, style, finish and color compatible with the architectural character of the campus and the historic characller of Old Towne, and shall be reviewed and approved by the Community Development Director or his/her designee.Lighting used to illuminate parking areas shall be directed away from neighboring properties. 2. Illumination Levels Off-street parking areas shall have a minimum illumination level of 1 foot-candle at finish grade, with a uniformity ratio of 5 to 1 (maximum to minimum foot-candle).Exterior doors shall have a minimum illumination level of 1 foot-candle at th.~ walking surface at the door Immanuel Lutheran Church Specific Plan 3, Fixture Selection Exterior lighting fixtures shall be compatible in style, design and finish with the architectural character of the campus. Appropriate lamp types include compact fluorescent, incandescent, metal halide and high pressure sodium. Fixtures shall be selected and integrated with the architecture such that glare from the light source is minimized, 4, Prohibited Types Exposed fluorescent lamps, mercury vapor lamps, colored neon lighting, rotating, flashing or animated lighting are prohibited. The permanent use of "rope" or "Tivoli" lights as building or landscape lighting is prohibited, However, they may be used on a temporary basis in conjunction with a permitted activity or event, provided the duration of the activity or event does not exceed fourteen (14) days. Such temporary lighting may have blinking lights. H. EXTERIOR SIGNAGE Exterior signage for the ILC Campus shall be in accordance with the City of Orange Sign Code, OMC ~ 17,78 and the Old Towne Design Standards current at the time of Plan adoption, except as specifically modified herein, In the event of conflict between the Sign Code and the Old Towne Design Standards, the Old Towne Design Standards shall supercede. Awnings shall not be used as part of the signage program and shall not contain signs, graphics, letters or logos. Notwithstanding any restrictions contained in the Sign Code, the Old Towne D,esign Standards, or this Plan, all freestanding signage existing at the time of Plan adoption shall be deemed compliant and in accordance with the intent of this Plan, ILC-SP Section 3 Page Immanuel Lutheran Church Specific Plan SECTION 4 SPECIFIC PLAN ADMINISTRATION & IMPLEMEIf.JTATION MEASURES A. PURPOSE AND INTENT This section establishes policies and procedures for the adoption, arnendment and administration of the Plan, as well as a program of implementation measures intended to achieve the Pian'S objectives, B. SPECIFIC PLAN ADOPTION, AMENDMENT and REPEAL 1, Adoption The adoption of a Specific Plan is a tegislative act that requires City Council to hold at least one public hearing prior to adoption, In accordance with California Government Code ~i (i5850, this Specific Plan shall be adopted by ordinance because it requires the re-zoning of property. Amendments to the Zoning Ordinance and Zoning Map shall be in accordance with the provisions of OMC !j17,10, 020.During the adoption process of this Specific Plan, the general public will havl3 numerous opportunities to comment on the process and express their concerns about project and neighborhood issues, These opportunities include: neighborhood meetings, informal discussions with Old Town Preservation Association, Planning Commission Hearings, Traffic Commission Hearings and City Council Hearings.2. Amendment Amendments may be initiated by ILC or City Council, and may include only those sections of this Specific Plan affected by the proposed change. In accordance with California Government Code !j 65453, this Specific Plan may be amended as often as deemed necessary and as many times as necessary, by the same manner in which it was adopted, by ordinance, Both the Planning Cornmission and City Council must hold at least one public hearing for each of them prior to the adoption of an amendrnent.3. Procedures for Boundary Modifications In the event that ILC acquires additional property in the future and elects at their discretion to include such property into the boundary covered by this Specific Plan, it shall do sa by amendment as described herein, In addition, boundary change arnendments shall include the submission of a revised written legal description, a map showing those parcel(s) proposed for inclusion, and revised Plan Exhibits showing the proposed change. If the boundary change amendment is adopted, then said Ilarcel(s) become part of this Specific Plan and shall be governed its provisions, zoning designation, clevelopment standards and design guidelines.C. GENERAL ADMINISTRATION 1. Adrninistration and Enforcement The City of Orange Community Development Department shall administer and enforce the provisions of this Specific Plan in accordance with the provisions of OMC,ILS-SP Section 4 Page Immanuel Lutheran Church Specific Plan 2, Administrative Adiustments and Minor Modifications Administrative adjustments, that will not adversely affect the properties surrounding the ILC campus, may be made to particular provisions of this Specific Plan in accordance with OMC S 17,10.050, In addition to administrative adjustments, the Community Development Director may make the following minor alterations to this Specific Plan without requiring public hearing before the Planning Commission or the City Council: a) Addition of information including maps, diagrams or text that does not change the effect of any of its provisions; b) Minor revisions or clarifications of Plan provisions that do not change the intent of any of the provisions, including determinations that may be reasonably inferred from the stated provisions; b) Determination that a proposed unlisted use is permissible, Determinations rendered by the Community Deveiopment Director are appealable to the Planning Commission whose determinations are in turn appealable to the City Council. 3. Procedures for Resolvinq Plan Interpretation In the event that portions of this Plan require interpretation as to their meaning or applicability; that disagreements arise with ILC regarding the applicability or implementation of any of its provisions; or that development proposals require the resolution of ambiguities or contradictions the Community Development Director shall resolve such uncertainties, Determinations by the Community Development Director may be appealed in accordance with OMC S 17,08.050, Upon a finding by the Community Development Director that significant alterations or additions are required to clarity the meaning or applicability of Pian provisions, or that significant omissions have occurred to the Plan, the proposed remedies shall be submitted as a Plan Arnllndment, with review and approval by the Planning Commission and City Council. D. REVIEW AND APPROVAL 1, Site Plan Review Purpose and Intent The process of Site Plan Review by various City reviewing bodies is intended to ensure that proposed development projects are: consistent with and conform to the relevant provisions of this Specific Plan; consistent with and conform to the General Plan and its related implementin(1 ordinances; implemented in a manner that responds to the availability of city services and infrastructure. The Site Plan Review process is requimd for all of the following projects, unless specifically listed as exempt in Subsection 3, below: to construct a new building or to expand an €,xisting structure as described in ILC-SP Sec 4, D6,2, Desiqn Review Purpose and Intent The process of Design Review by the Design Review Committee ("DRC") is inllended to ensure that proposed projects are: consistent with and conform to the Design Guidelines of this Specific Plan;consistent with and conform to the Old Towne Design Standards; and are compatible with the surrounding neighborhood uses and structures.ILS-SP Section 4 Immanuel Lutheran Church Specific Plan The Design Review process is required for all of the following projects, unless specifically listed as exempt in Subsection 3, below: to construct a new building; to expand an existing building; or to renovate, alter, improve or rehabilitate the exterior of an existing structure where a building permit is required; and those projects described in ILC-SP Sec 4, D6,3, Proiects Exempt from Review Projects, uses, and activities that are specifically exempt from both Site Plan Review and Design Review include, but are not limited to the following:1) Interior alterations, improvements or maintenance not involving an increase in building area or an intensification of use, including plumbing, HVAC, fire sprinkler, alarm, lighting or electrical repairs or improvements and their related equipment and appurtenances where the primary work of the project is interior to thebuildin( J;2) Routine exterior maintenance, including window and door repair or replacement; repainting of exterior surfaces where colors match existing or are consistent with any previous approvals;duplication, repair or replacement of damaged, missing or deteriorated architectural features,including siding and trim;3) Maintenance, repair or replacement of mechanical or electrical equipment, whether roof mounted or located at ground level;4) Maintenance, repair or replacement of exterior lighting and signage provided that such work is consistent with the lighting and signage provisions of this Plan;5) Maintenance, repair or replacement of roofing with materials similar to existing or previously approved materials;6) Maintenance, repair, replacement or installation of site amenities including sidewalks and slabs;site furnishings; playground and recreational equipment; and site fences and walls;7) Removal, replacement or installation of landscaping provided that such work is consistent with the landscaping provisions of this Plan;8) Repair, resurfacing or re-striping of parking areas provided that the quantity, size, and configuration are not altered as the result of such work, whether or not such existing conditions are in strict compliance to the provisions of this Plan;9) Projects otherwise exempt from Demolition Review under the provisions of the Old Towne Design Standards, such as demotition of a non-historic resource which has a floor area less than 120 square feet.Even though certain projects may be exempt from either Site Plan Review 01C Design Review, such exemption is not intended to relieve projects from conformance to the provisions of this Specific Plan, the Old Towne Design Standards or any other relevant ordinance or regulation, and shall not be construed as a grant ta violate any of the same. Certain exempt activities and projects may nevertheless require the obtaining of some other permit precedent to the commencement of the work.Activities or projects that are not listed as exempt, may be found exempt by the Community Development Director when a determination is made that such activity or project is:1) similar to one listed as exempt;2) a reasonable consequence diro~ctly related to an exempt project;ILS-SP Section Immanuel Lutheran Church Specific Plan 4. Staff Level Counter Review Projects, uses and activities that shall be reviewed by staff over the counter without requiring Staff Review or Design Review include, but are not limited to the following: 1) Exterior building or site modifications for barrier-free access;2) Construction of accessory structures less than 120 square feet in an~a such as trash enclosures and storage sheds;3) Installation of new HVAC equipment or electrical service meters;5, Review of Parsonaqe Relocation At the commencement of Phase 3 of the Phasing Plan, the Parsonage will be relocated to another physical site, Because the window of opportunity may present itself for only a limited period of time, and may close before a replacement structures can be designed, approved and permitted, ILC shall be allowed to complete such relocation without prior review, approval and permitting of the replacement structure, as otherwise normally required by OMC S 17,10, 090,Site selection for such new location shall proceed in the following order of geographic preference and tiered criteria that optimize the structure's historic character:1) A site with the boundaries of Old Towne, residentially zoned and suitably sized for preserving the house's dimensions and access to open space;2) Sites outside Old Towne, shall be evaluated using the following priorities:Firstly, sites which are residentially zoned and suitably sized for preserving the house' s dimensions and access to open space;Secondly, sites which are located in a single-family neighborhood with structures compatible in size, massing, character and streetscape that will complement the house;Thirdly, sites which are located in an historic single- family nei9hborhood consisting primarily of other contributing structures.In the event that a suitable site is not found within the Old Towne District. ILC shall provide documentation that such search was u1successful. Any site located outside the Old Towne District may require additional review and approval.6. SRC, DRC and Planninq Commission Review When either Site Plan Review, Design Review or Planning Commission review is required it shall comply with the procedures and provisions contained herein for the appropriate tevell of review, All approvals shall be obtained prior to the issuance of any permits for demolition, construction or alteration, If projects are found consistent with the provisions of this Specific Plan and other relevant laws and ordinances, they shall be approved by the Community Development Director.a) Design Review Committee: Projects and uses that shall be reviewed by the Design Review Committee without requiring review by Staff Review Committee include the following:1) Installation of new signage where such installation is not limited to maintenance, repair or replacement of existing;2) Fa~ade renovations on URM buildings,ILS-SP Immanuel Lutheran Church Specific Plan b) Staff Review Committee, Community Development Director & Design Review Committee Review: Projects and uses that shall be reviewed by the Design Review Committee and the Community Development Director inctude the following: 1) Installation or relocation of temporary modular structures onto the Campus; 2) Additions or alterations to non-contributing and non-historic resources provided that the project is two-stories or less in height, that no more than 25 porcent of the existing floor area will be removed, and that the changes will not have an adverse impact on the existing structure, the ILC Campus or the Historic District;3) Additions or alterations to non-contributing and non-historic resources that result in the building being enlarged by more than 20 percent of the original floor area;4) New accessory structures enclosed by walls and roofs where the enclosed floor area is greater than 120 square feet;5) Infill construction whether or not related to the partial or total demolition of non-contributing or non-historic resources where no adverse impacts will occur to the existing buildings, the ILC Campus or the Historic District;6) Alterations or additions to a contributing building or structure where such change is not visible from the street,lIoor area increase does not exceed 201 percent of the original floor area, does not exceed the height of the original building, and the alteration or addition is in accordance with other design guidelines set forth in this Plan.7) Alterations or additions to a contributing building or structure where such change involves any of the following: tho change is visible from the street, the floor area increase exceeds 20 percent of the original floor area or the proposed change exceeds the height of the original building;Any of the projects listed above with a greater magnitude shall be subject to the procedures set forth in the OTDS and Orange Municipal Code.c) Planning Commission and City Council Review: Amendments to the Specific Plan text and area boundaries, or any projects and uses that require further environmental review beyond that provided in the environmental document associated with initial Plan adoption, shall be reviewed by the Planning Commission and City Council in accordance with the procedures set forth in Chapter 17, 08 of the Orange Municipal Code.7. Submittal Requirements In addition to completed application forms, Immanuel Lutheran Church shall prepare and submit scaled plans, drawings, diagrams, reports, or illustrations of development proposals in quantities sufficient to satisfy the requirements of the reviewing body as published in the retevant City standards,8. Time Limits Site plan and design review approval shall be valid for a period of twa (2) years from the date of approval.In the event that construction does not GQmmence within that period the approval shall expire.
