A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ORANGE APPROVING AN AMENDMENT
TO THE OPEN SPACE AND CONSERVATION
ELEMENT OF THE CITY OF ORANGE GENERAL
PLAN TO COMPLY WITH THE REQUIREMENTS
OF THE SANTA ANA REGIONAL WATER
QUALITY CONTROL BOARD THIRD TERM
NATIONAL PERMIT DISCHARGE ELIMINATION
SYSTEM PERMIT.
APPLICANT: CITY OF ORANGE
WHEREAS, the 1972 Clean Water Act (CWA) established the National Pollutant
Discharge Elimination Systern (NPDES) permitting program and required the Enviromnental
Protection Agency (EP A) to issue regulations that included storm water runoff from rainfall;
and
WHEREAS, in response to those regulations, in 1990 the County of Orange, the
Orange County Flood Control District and all incorporated cities in Orange County obtained
First Term NPDES storm water permits from the Santa Ana and San Diego Regional Water
Quality Control Boards; and
WHEREAS, the Second Term Permit was issued in 1996 by the Santa Ana Regional
Water Quality Control Board; and
WHEREAS, the Third Term NPDES Permit, was issued in January 2002 to the County
of Orange, the Orange County Flood Control District (OCFCD) and the incorporated cities of
central and northern Orange County (collectively referred to as Permittees); and
WHEREAS, each Permittee is required by the Third Term Permit to minimize short
and long-term impacts on receiving water quality from new development and
significant redevelopment to the maximum extent practicable. Additionally, the Permittees must, at
a minimum, review and update General Plans by July 1, 2004, as necessary, to ensure
watershed and storm water quality and quantity management are considered;
and WHEREAS, the City Council of the City of Orange conducted one duly
advertised public hearing on June 8, 2004 for the purpose of considering General Plan Amendment
No.
2004-0003.NOW, THEREFORE, BE IT RESOLVED that the City Council of the
City of Orange hereby approves General Plan Amendment No. 2004-0003 which brings
the City into compliance with the requirements of its Third Term NPDES Permit
addressing storm water quality based on
1. General Plan Amendment No. 2004-0003 further supports Goal 1.0 of the
Open Space and Conservation Element of the General Plan, which states that the
City will continue to recognize the need to consider environmental issues in
all aspects of land use planning, with special emphasis on regional air
quality,surface and groundwater resources, and enviroument pollution;
and 2. General Plan Amendment No. 2004-0003 brings the City into
full compliance with the requirements of the Santa Ana Region Water Quality
Control Board Third Term NPDES Permit, as well as promotes storm
water
quality management.BE IT FURTHER RESOLVED that General Plan Amendment No.
2004-0003 is categorically exempt from the provisions of the California Environmental Quality
Act per State CEQA Guidelines Section 15308 (Class 8 -- Actions by Regulatory Agencies for
Protection of
the Environment).ADOPTED this 8th day of
June,
2004.
