HomeMy WebLinkAboutORD 06-17 Amending Chapter 17.34 For Off Street Parking & Loading RequirementsORDINANCE NO. 06-17 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ORANGE AMENDING CHAPTER 17.34 OF THE ORANGE MUNICIPAL CODE TO MODIFY THE CITY'S OFF - STREET PARKING AND LOADING REQUIREMENTS FOR MULTI- FAMILY RESIDENTIAL DEVELOPMENT. WHEREAS, the City's parking standards were last comprehensively updated in 1995; and WHEREAS, in late 2016, the City Council reviewed and approved a number of multi- family residential projects. During deliberations for those projects, the Council expressed a concern that Code provisions related to required number of parking spaces for multi - family residential uses may be insufficient and out -of -date; and WHEREAS, at the November 9, 2016 Council meeting, the City Council requested that staff review the multi - family residential parking standards and bring back a Code amendment to modify the standards, if necessary; and WHEREAS, the City desires to require sufficient off - street parking for its land uses in order to minimize parking spillover and to avoid negative effects to the quality and character of the neighborhoods; and WHEREAS, the City also desires to ensure that parking requirements are not unnecessarily stringent such that they function as a hindrance to the reasonable development of property; and WHEREAS, the subject Ordinance is categorically exempt from the California Environmental Quality Act (CEQA) under CEQA Guidelines Section 15305 (Class 5, Minor Alterations in Land Use Limitations) according to Section III of the findings herein; and WHEREAS, the subject Ordinance revising provisions of the Code related to parking standards for multi - family residential uses is consistent with the goals and policies of the General Plan; and WHEREAS, the Planning Commission having conducted a duly advertised public hearing held on September 18, 2017 including review of the staff report and receiving public testimony on the item, has determined the subject Ordinance is reasonable, appropriate and justified and recommends approval thereof; and WHEREAS, the City Council conducted one duly advertised public hearing on October 24, 2017, at which time interested persons had an opportunity to testify either in support of or in opposition to the subject Ordinance; and WHEREAS, the October 24, 2017, public hearing was conducted, continued, and duly advertised as a continued City Council public hearing on December 12, 2017, at which time interested persons had an opportunity to testify either in support of or in opposition to the subject Ordinance; and WHEREAS, the City Council believes the proposed amendment will serve the public health, safety and welfare of the City. NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF ORANGE HEREBY ORDAINS AS FOLLOWS: SECTION I: Section 17.34.060 (Required Number of Parking Spaces) is hereby amended to add text as follows, under a new Subsection D (to follow Subsection C): D. Tandem parking, mechanical lifts, or other similar parking solutions may be allowed in multifamily residential developments in cases where tandem or vertical parking spaces are assigned to the same unit and meet required findings for site plan review. Tandem parking mechanical lifts, or other similar parking solutions may be approved through a Minor Site Plan Review process described in Section 17.10.060D of this Code. Mechanical lifts and other similar equipment shall be user - friendly, maintained in good operating condition, and enclosed within a structure that is visually compatible with the primary structure(s) on the site. SECTION II Table 17.34.060.A (Required Number of Parking Spaces for Residential Uses), with text changes made related to "Multifamily Residential (3 units or more) ", is hereby amended and replaced as follows: Table 17.34.060.A REQUIRED NUMBER OF PARKING SPACES FOR RESIDENTIAL USES USE REQUIRED NUMBER OF SPACES Single - 2 enclosed garage spaces /unit up to 4 bedrooms accessed by a 12 foot wide 20 foot long family driveway. For 5 or more bedrooms, 1 additional enclosed space. For bedroom additions to Dwelling homes built prior to the effective date of Ordinance 17 -08, refer to Section 17.34.020(A). For PUDs, units with 3 or more bedrooms shall provide an additional 1.5 guest parking spaces per dwelling unit. Of this requirement, 1 open parking space may be provided at the residence subject to compliance with Section 17.16.060. Ordinance No. 06-17 3 If a space that would otherwise meet the definition of a room or bedroom omits one of four encompassing walls, that room shall not be counted as a bedroom for purposes of calculating required number of parking spaces. Parking spaces may be enclosed or unenclosed, but are encouraged to be unenclosed. Student housing dormitory, 0.5 space /student resident, plus l space /each resident staff person fraternity, sorority) Trailer park, 2 spaces /unit, (1 of which shall be covered, where at least 2 sides of the carport shall be at a mobilehome minimum 50% open and= unobstrdcted) plus 1 guest space /3 trailers or mobilehomes shall park be provided as easily accessible and distinguishable guest parking. Tandem parking is permitted for the mobilehome. Ordinance No. 06 -17 4 SECTION III: The subject Ordinance implements the goals and polices of the City's General Plan. Specifically, the Ordinance implements Land Use Element Policy 1.6 which calls for the City to minimize the effects of new development on the privacy and character of surrounding neighborhoods. The subject Ordinance adjusts the parking requirements for multifamily residential uses for the purpose of ensuring parking standards reflect parking demand, thereby accommodating parking for new residential developments onsite and minimizing the potential for adverse effects associated with off -site parking spillover into surrounding communities. SECTION IV: The subject Ordinance is exempt from the provisions of the California Environmental Quality Act CEQA) per State CEQA Guidelines Section 15305 (Class 5, Minor Alterations in Land Use Limitations) because it involves a modification to a citywide development standard related to required parking. It does not involve a specific site, development project, or focused geographic area, does not change permitted land use or density, and does not otherwise result in a physical change that could cause an impact to the environment. Further, parking is not considered an impact to the environment under CEQA. As such, no further analysis is warranted or required. SECTION V: A summary of this Ordinance shall be published and a certified copy of the full text of this Ordinance shall be posted in the Office of the City Clerk at least five (5) days prior to the City Council meeting at which this Ordinance is to be adopted. A summary of this Ordinance shall also be published once within fifteen (15) days after this Ordinance's passage in a newspaper of general circulation, published, and circulated in the City of Orange. The City Clerk shall post in the Office of the City Clerk's a certified copy of the full text of such adopted Ordinance along with the names of those City Council members voting for and against the Ordinance accordance with Government Code Section 36933. This Ordinance shall take effect thirty (30) days from and after the date of its final passage. Immediately after the effective date of this Ordinance the City shall include summary of the adopted Ordinance in a general mass mailing, such as the City water bill, to its citizens.
